The meeting was called to order at 6:00 p.m. Roll call taken by Melanie Videan, Planning Technician. MINUTES Regular Meeting of the Prosper Planning & Zoning Commission 108 W. Broadway Street, Prosper, Texas Town of Prosper Municipal Chambers Tuesday, April 3, 2012, 6:00 p.m. Commissioners present included: Chair Mark DeMattia, Vice Chair Mike McClung, Bill Senkel, Bruce Carlin, Jim Cox, and Rick Turner. *Chris Keith informed of his absence prior to the meeting. Staff present included: Hulon Webb, Director of Development Services/Town Engineer; Chris Copple, Planning Director; Wayne Snell, Building Official; and Melanie Videan, Planning Technician. 2. Recitation of the Pledge of Allegiance. CONSENT AGENDA 3a. Consider and act upon minutes from the following Planning & Zoning Commission meeting: • March 6, 2012 Regular Meeting 3b. Consider and act upon a final plat of Willow Ridge, Phase 4B, being 81 single family residential lots on 29.1f acres, located on the east side of Lovers Lane, 600f feet south of Preston Road. The property is zoned Planned Development-2 (PD-2). (D12-0011). Motioned by McClung, seconded by Turner to approve the consent agenda subject to staff's recommendation. Motion approved 6-0 at 6:02 p.m. 4. A public hearing to consider and act upon a site plan for Prosper ISD Bus Parking Lot Addition and a final plat of Prosper High School and Middle School Addition, Block 1, Lot 1R, being a replat of Prosper High School and Middle School Addition, Block 1, Lot 1, on 73.8f acres, located on the southeast corner of Coleman Street and Eagle Lane. The property is zoned Single Family-15 (SF-15). (D12-0009). Summary Copple: Summarized site plan and clarified the need for a public hearing. Briefed on the history of the property and on the screening for the parking addition. Informed the baseball field will be removed. Recommended approval subject to the conditions listed in the staff report. Discussion Carlin: Asked questions regarding the walkway lights. Page] of 4 DeMattia: Asked if the item would be presented to Council. Copple: Answering Carlin, informed the applicant may address questions regarding the walkway lights. Addressing DeMattia's inquiry, informed the site plan will not be discussed by Council, unless they vote to appeal the Commission's decision. Motioned by Turner, seconded by Senkel to open the public hearing. Motion passed 6-0 at 6:09 p.m. Public Hearing Discussion McClung: Asked applicant why a variance has been granted to the only bus yard in town when the Zoning Ordinance has specific requirements for such. DeMattia: Asked applicant if the purpose for the variance is cost related. Carlin: Asked applicant questions regarding walkway lighting between the residences. Concerned the buses could be vandalized. Chris Schmitt (representative): Answering McClung, informed he cannot provide details on why the variance from the ordinance has been sought. Answering DeMattia, briefed on the continuation of this site plan from the last site plan that was approved. Addressing Carlin, explained that there are no lights on the east side of the proposed improvement area; that all the lights are centrally located. Carlin: Addressing Michael Goddard, voiced concerns about the disruption to residents when the buses are in reverse during the early morning hours. Asked for clarification on the existing parking lot versus what is being proposed. Senkel: Clarified Carlin's concerns regarding buses pulling through the parking lot versus backing up. McClung: Asked if the walkway will be properly maintained. Cox: Asked questions regarding the maintenance between the parking lot screening and the residents' fences. Michael Goddard (Prosper ISD representative): Explained that the proposed parking lot expansion will alleviate some of the noise issues since there will be more space for buses to pull through but that the reverse warning beep on school buses are federally regulated. Addressing McClung and Cox, assured that the ISD does not want excessive vegetation around walkway or between the screening fences. Motioned by Carlin, seconded by McClung to close the public hearing. Motion passed 6-0 at 6:19 p.m. Motioned by Turner, seconded by Carlin to approve item 4 subject to staff's recommendation. Motion approved 6-0 at 6:21 p.m. 5. A public hearing to consider and act upon a request to rezone 1.4f acres, located on the west side of Preston Road, 1,600f feet south of Prosper Trail (787 N. Preston Road), from Commercial (C) to Planned Development -Retail (PD-R). (Z12-0003). Summary Copple: Summarized the request to rezone. Briefed on surrounding zoning and history of the property; specifying that the structure has long been vacant. Noted the request does not conform to the Future Land Use Plan (herein called the FLUP), but informed that the property was zoned Commercial in 1996, which was prior to the adoption of the FLUP in 2004. Informed notification was given in accordance with state Page 2 of 4 McClung: Noted the use proposed is already permitted under the existing zoning and that the transformation of the structure is a positive one. Asked applicant if he would be willing to revise the PD to reflect the following: 1) the automobile repair use will be closed on Sundays, and 2) removal of the two uses Turner has concerns about. Senkel: Agreed with Commissioners. Carlin: Concerned about the following uses: 1) equipment sales and rental, 2) laundromat, 3) mobile food vendor, and 4) private club. DeMattia: Conveyed that the elevations look appropriate but is opposed to the use being on Preston Road, noting that the use is inconsistent with the draft Comprehensive Plan. Suggested tabling the item so that further discussions may be had. Copple: Explained the conditions and regulations regarding the uses Carlin listed. Boueri: Answering McClung, agreed to revise the PD accordingly. Motioned by Cox, seconded by McClung to approve request to rezone 1.4t acres, located on the west side of Preston Road, 1,600t feet south of Prosper Trail (787 N. Preston Road), from Commercial (C) to Planned Development -Retail (PD-R) subject to the following revisions to the PD: 1) automobile repair use are not permitted to operate on Sunday; and 2) remove automobile paid parking lot or garage, recycling collection point, private club, and laundromat from the list of permitted uses. Motion approved 4-2 at 6:54 p.m., with DeMattia and Turner in opposition. DeMattia cited his opposition to the use being in that particular location, while Turner cited the preference to wait for the adoption of the Comprehensive Plan before rendering a decision. 6. Receive an update on items discussed by the Comprehensive Plan Advisory Committee. Copple: Informed of the Planning & Zoning public hearing, which is anticipated to be held on May 1, 2012 at the Prosper ISD Administration Building. 7. Possibly direct Town Staff to schedule topic(s) for discussion at a future meeting. There was no discussion on this item. 8. Adjourn Motioned by Carlin, seconded by Turner to adjourn.
