The meeting was called to order at 6:00 p.m. Roll call taken by Melanie Videan, Planning Technician. MINUTES Regular Meeting of the Prosper Planning & Zoning Commission 108 W. Broadway St., Prosper, Texas Town of Prosper Municipal Chambers Tuesday, November 5, 2013, 6:00 p.m. Commissioners present included: Chair Mark DeMattia, Vice Chair Mike McClung, Secretary Rick Turner, Bruce Carlin, Chris Keith, Craig Moody, and Bill Senkel. Staff present included: Chris Copple, Director of Development Services; Alex Glushko, Senior Planner; and Melanie Videan, Planning Technician. 2. Recitation of the Pledge of Allegiance. CONSENT AGENDA Keith pulled item 3c 3a. Consider and act upon minutes from the following Planning & Zoning Commission meeting: October 15, 2013 Regular Meeting 3b. Consider and act upon a final plat of Windsong Ranch, Phase 2A, being 51 single family residential lots on 19.1f acres, located on the east side of future Windsong Parkway, 900f feet south of Fishtrap Road. The property is zoned Planned Development-40 (PD-40). (D13- 0046). 3c. Consider and act upon a final plat of Lakes of Prosper North, Phase 2, being 59 single family residential lots on 21.7f acres, located 3,300t feet north of Prosper Trail and 1,000± feet east of Dallas Parkway. The property is zoned Planned Development-8 (PD-8). (D13- 0050). Discussion Keith: Concerned about the amount of traffic traveling through Lakes of Prosper to Lakes of Prosper North. Questioned Lakes of Prosper North having only two points of access. Asked if another point of access will be provided for Lakes of Prosper North in the future, possibly from Frontier Parkway or the Tollway. Also inquired if the developer from Lakes of Prosper North has an access agreement with the Lakes of Prosper developer. Glushko: Noted arterial roads may feed into Lakes of Prosper North in the future, but there is no timeline on construction. Informed the access roads into Lakes of Prosper North are public right-of-ways; therefore, no agreement is required. Page 1 of 4 Copple: Explained during the rezoning of the property, there were no triggers to warrant a traffic impact analysis and the zoning of the property conforms to the Future Land Use Plan (herein called the FLUP). Motioned by Keith, seconded by Moody to approve item 3c subject to staffs recommendations. Motion approved 7-0 at 6:09 p.m. 3d. Consider and act upon a final plat of Prosper Town Center, Block A, Lot 7, on 2.5f acres, located on the east side of Preston Road and 600f feet north of First Street. The property is zoned Planned Development-7 (PD-7). (1313-0051). 3e. Consider and act upon a final plat of The Parks at Legacy, Phase 1, being 86 single family residential lots on 34.Of acres, located on the south side of Fishtrap Road, 3,700f feet east of Teel Parkway. The property is zoned Planned Development-14 (PD-14). (1313-0041). Motioned by McClung, seconded by Turner to approve the balance of the consent agenda subject to staff s recommendations. Motion approved 7-0 at 6:02 p.m. REGULAR AGENDA 4. A public hearing to consider and act upon a request to rezone 76.1t acres, located on the east side of Legacy Drive, 1,400t feet north of Prosper Trail, from Agricultural (A) to Planned Development -Single Family-15 (PD-SF-15). (Z13-0016). Summary Copple: Summarized the request to rezone and the surrounding zoning. Specified the following: density, number of lots, minimum lot square footage, average lot square footage, and minimum dwelling square footage. Noted the following proposed standards exceed the regulations set forth in the Town's Zoning Ordinance: open space, fencing, retention ponds (which will include fountains), exterior lighting packages for homes, elevations, garages, prohibition of carports, minimum dwelling square footage (which exceeds the Zoning Ordinance by 700 square feet), and a minimum of fifty percent impervious front yard area. Informed the FLUP recommends low density residential for the property, and the request conforms to the FLUP. Informed notification was given in accordance with state law, and the Planning Division received one public hearing notice reply form in opposition to the request. Reminded the Commission of the email he had forwarded from a Celina ETJ (Extra Territorial Jurisdiction) resident in opposition to the request. Recommended approval. Discussion with Staff Keith: Asked how the minimum impervious front yard area compares to other subdivisions in Prosper. Turner: Asked staff questions regarding the average lot square footage. Carlin: Inquired about the subdivision's exterior fencing along Legacy Drive. Copple: Answering Keith, informed there is no standard in the Zoning Ordinance regarding minimum front yard impervious area. Responding to Turner, explained the smallest lot allowable is proposed at 13,500 square feet, but the plat will be required to show an overall minimum average of 15,000 square feet for all single family lots. Addressing Carlin, briefed on the thoroughfare screening requirements in the Subdivision Ordinance. Motioned by Keith, seconded by Turner to open the public hearing. Motion passed 7-0 at 6:18 p.m. Page 2 of 4 the motion. Carlin noted his opposition stems from the proposed rear yard setbacks and two -car garage orientation. 5. Possibly direct Town Staff to schedule topic(s) for discussion at a future meeting. Discussion Keith: Inquired if a joint work session has or will be scheduled for the Commission and Council. Commission members informed there has been no discussion on a joint work session. Turner: Asked for clarification on appeal items that appear on the Council agendas. Copple: Explained the appeals process for preliminary site plans and site plans. 6. Adjourn Motioned by Keith, seconded by Moody to adjourn. Motion approved 7-0.
