Commissioners present included: Chair Mark DeMattia, Secretary Chris Keith, Bill Senkel, Bruce Carlin
and Rick Turner.
*Commissioners McClung and Moody informed of their absence prior to the meeting.
Staff present included: Alex Glushko, Senior Planner; and Melanie Videan, Planning Technician.
2. Recitation of the Pledge of Allegiance.
CONSENT AGENDA
3a. Consider and act upon minutes from the following Planning & Zoning Commission
meetings:
a July 16, 2013 Regular Meeting
3b. Consider and act upon a final plat of Windsong Ranch, Phase 113, being 23 single family
residential lots on 7.2f acres, located on the west side of future Windsong Parkway, 1,100f
feet south of Fishtrap Road. The property is zoned Planned Development-40 (PD-40). (D13-
0030).
3c. Consider and act upon a preliminary plat of Windsong Ranch, Phase 2A, being 51 single
family residential lots on 17.4f acres, located on the east side of future Windsong Parkway,
1,200f feet south of Fishtrap Road. The property is zoned Planned Development-40 (PD-
40). (D13-0031).
3d. Consider and act upon a final plat of Saddle Creek, Phase 2A, being 20 single family
residential lots on 8.0± acres, located 1,000± feet west of Preston Road and 1,400f feet north
of Prosper Trail. The property is zoned Planned Development-31 (PD-31). (D13-0032).
Motioned by Carlin, seconded by Senkel to approve the consent agenda subject to staffs
recommendations. Motion approved 5-0 at 6:01 p.m.
REGULAR AGENDA
4. A public hearing to consider and act upon a request to rezone 0.5f acre, located on the
north side of First Street, 200f feet west of Craig Street (705 E. First Street) from Single
Family-15 (SF-15) to Downtown Office (DTO). (Z13-0012).

Summary
Glushko: Summarized the request to rezone. Noted the request conforms to the Future Land Use Plan.
Informed notification was given in accordance with state law and that the Planning Division received
three reply forms, none in opposition. Recommended approval.
Discussion with staff
Carlin: Asked if there are plans for development on the subject property.
Glushko: Informed there are no current plans for development of the subject property.
Motioned by Turner, seconded by Carlin to open the public hearing. Motion passed 5-0 at 6:03 p.m.
Public Hearing Discussion
Bill Perman (representative): Reconfirmed there are no current plans to develop the subject property, but
noted intentions to develop the adjacent property to the west, which is also zoned Downtown Office.
Informed that rezoning the subject property will establish new setbacks, thereby assisting development of
the adjacent property.
Glushko: Explained the setbacks of the Downtown Office district and informed of the submittal received
for the adjacent property to the west.
DeMattia: Asked staff the following questions: 1) if the subject property's use is single family, 2) if
single family is a permitted use in the Downtown Office district, 3) what percentage of destruction to the
existing structure would not allow for the reconstruction of a single family structure in the Downtown
Office district, and 4) how long can the residential use be dormant before the property must conform to
the Downtown Office district.
Perman: Confirmed the current use is residential.
Glushko: Stated that single family uses may be permitted in Downtown Office districts and
reconstruction may be allowed.
Videan: Noted that if the residential structure is damaged beyond sixty percent (60%), new construction
must conform to the Downtown Office development standards. Reported that once a use ceases for six
months, the property's use must conform to the property's current zoning district.
Motioned by Carlin, seconded by Turner to close the public hearing. Motion passed 5-0 at 6:08 p.m.
Discussion
Glushko: Clarified that single family uses are not permitted in Downtown Office districts; however, if
such a use exists at the time a property is rezoned, the use may continue.
Motioned by Turner, seconded by Carlin to approve the request to rezone 0.5± acre, located on the north
side of First Street, 200t feet west of Craig Street (705 E. First Street) from Single Family-15 (SF-15) to
Downtown Office (DTO). Motion approved 5-0 at 6:10 p.m.
5. Possibly direct Town Staff to schedule topic(s) for discussion at a future meeting.
Discussion
Turner: Inquired about the different titles used to describe the Old Town Core District, the Future Land
Use Plan, and the Zoning Map.

Glushko: Clarified the purpose and language used to describe the Old Town Core District,
Comprehensive Plan, and the Zoning Map.

Motioned by Turner, seconded by Keith to adjourn. Motion approved 5-0.
