The meeting was called to order at 6:02 p.m. Roll call taken by Melanie Videan, Planning Technician. MINUTES Regular Meeting of the Prosper Planning & Zoning Commission 108 W. Broadway St., Prosper, Texas Town of Prosper Municipal Chambers Tuesday, February 5, 2013, 6:00 p.m. Commissioners present included: Chair Mark DeMattia, Bruce Carlin, Rick Turner, Bill Senkel, and Craig Moody. *Commissioners McClung and Keith informed of their absence prior to the meeting. Staff present included: Hulon Webb, Director of Development Services/Town Engineer; Chris Copple, Planning Director; and Melanie Videan, Planning Technician. 2. Recitation of the Pledge of Allegiance. CONSENT AGENDA 3a. Consider and act upon minutes from the following Planning & Zoning Commission meetings: • January 15, 2013 Regular Meeting 3b. Consider and act upon a final plat of Andrews Addition, Block A, Lot 1, on 19.0± acres, located on the north side of Prosper Trail, 2,700f feet west of Dallas Parkway. The property is zoned Agricultural (A). (D13-0003). Motioned by Carlin, seconded by Turner to approve the consent agenda subject to the revision to the January 15, 2013 Planning & Zoning Commission meeting minutes on item 3a and staff's recommendations on item 3b. Motion approved 5-0 at 6:03 p.m. REGULAR AGENDA 4. A public hearing to consider and act upon a request to rezone 0.5f acre, located on the southwest corner of Coleman Street and Third Street (202 S. Coleman Street), from Single Family-15 to Downtown Office (DTO). (Z13-0001). Summary Copple: Relayed the applicant's request to table and continue the public hearing to the February 19, 2013 Planning & Zoning Commission meeting. Recommended opening the public hearing, receiving comments from the public, and tabling and continuing the public hearing to the February 19, 2013 Planning & Zoning Commission meeting. Motioned by Turner, seconded by Carlin to open the public hearing. Motion passed 5-0 at 6:04 p.m. Motioned by Carlin, seconded by Moody to table the item and continue the public hearing to the February 19, 2013 Planning & Zoning Commission meeting. A public hearing to consider and act upon a request to rezone 124.7t acres, located on the south side of Frontier Parkway, 800f feet east of Preston Road to amend Planned Development-15 (PD-15), Exhibit C, Section 2.05 (Streets). (Z13-0003). Summary Copple: Summarized the request to amend Exhibit C, Section 2.05 (Streets) of PD-15, noting the Town's residential paving width standard. Informed notification was given in accordance with state law and that the Planning Division received five public hearing notice reply forms, three of which were in opposition to the request. Recommended approval. Discussion with Staff Carlin: Asked for confirmation that discussions are to be specific to Exhibit C, Section 2.05 of PD-15. Copple: Confirmed the applicant is requesting to amend Exhibit C, Section 2.05 of PD-15. Motioned by Turner, seconded by Moody to open the public hearing. Motion passed 5-0 at 6:08 p.m. Public Hearin,, Discussion DeMattia: Asked the applicant if they are willing to discuss other elements of PD-15. Jennifer Haynes (applicant): Preferred to not subject additional sections of PD-15 for amendment at this time. Mark McGuire (Highland Meadows resident): Concerned about the following: 1) the lot sizes along the eastern border of Frontier Estates, requesting a twenty (20) foot buffer with a living screen, and 2) the disproportionate look of small lots in Frontier Estates located across Frontier Parkway from one acre lots in the City of Celina. Tom Beitel (Highland Meadows resident): Commented on the side yard setbacks for the lots in Frontier Estates adjacent to Post Oak Court, noting the Highland Meadows homes at the end of Post Oak Court are fifty and seventy feet from the edge of pavement. Concerned the location of the homes on Post Oak Court in Frontier Estates will look disproportionate to the location of the homes in Highland Meadows. Bruce Mueller (Highland Meadows resident): Concerned about the side yard setback for the lots in Frontier Estates adjacent to Post Oak Court. Requested the trees within PD-15 be saved and a buffer be added between the Frontier Estates lots and the Highland Meadows lots. Motioned by Carlin, seconded by Turner to close the public hearing. Motion passed 5-0 at 6:21 p.m. Discussion Senkel: Noted the Commission's limitations, as the applicant is only requesting an amendment to Section 2.05 and prefers to not amend any other portion of PD-15 at this time. Carlin: Noted the concerns of the Highland Meadows residents, but agreed with Senkel regarding the Commission's limitations. Turner: Asked staff for confirmation that Post Oak Court will continue into Frontier Estates at a paving width of twenty-six (26) feet. Asked the applicant if additional lots will be created due to the reduction in right-of-way acreage. Carlin: Asked the applicant if they would be willing to increase the setbacks along Post Oak Court. Page 2 of 5 Copple: Confirmed for Turner that Post Oak Court will continue with a paving width of twenty-six (26) feet. Robert Homes (developer): Answering Turner, informed the area savings will add to lot depth; thereby allowing for larger pad sites. Noted the PD allows for a maximum of sixty-five (65) lots at 10,000 square feet and a maximum of 205 lots at 12,500 square feet; however, the subdivision design does not include 10,000 square foot lots and only includes approximately eleven (11) lots less than 12,500 square feet. Addressing Carlin, assured they have considered increasing the setbacks. Moody: Concurred with Commissioners and appreciated that the saved right-of-way acreage will be used to increase lot depth. DeMattia: Asked the applicant to consider tabling the item and allowing more of the PD to be amended with regards to the property's eastern boundary, screening, and other concerns of the Highland Meadows residents. Robert Holmes: Asked the Commission to act on the request. Informed a preliminary plat has been submitted to the Planning Division. Copple: Informed the Commission that the applicant's request is to amend Exhibit C, Section 2.05 (Streets) only. Should other exhibits or sections of the PD be amended, the applicant must submit a separate zoning request. Motioned by Carlin, seconded by Turner to approved the request to rezone 124.7f acres, located on the south side of Frontier Parkway, 800f feet east of Preston Road to amend Planned Development-15 (PD- 15), Exhibit C, Section 2.05 (Streets). Motion approved 5-0 at 6:33 p.m. 6. Consider and act upon a request to rezone 0.3f acre, located on the north side of First Street, 1,500f feet east of Legacy Drive from Agricultural (A) to Planned Development - Agricultural (PD-A). (Z12-0004). Summary Copple: Summarized the request to rezone and briefed on discussions from the January 15, 2013 Planning & Zoning Commission meeting. Informed the applicant's request has been revised from allowing a 120 foot antenna pole to allowing a 100 foot antenna pole. Noted the Future Land Use Plan (herein called the FLUP) recommendation. Informed notification was given in accordance with state law and that the Planning Division received three public hearing notice reply forms, two of which are in opposition to the request. Recommended denial. Discussion with Staff DeMattia: Asked for confirmation that the only change to the request is to allow a 100 foot antenna pole rather than a 120 foot antenna pole. Turner: Asked if the recommendation for denial is based off of a commercial use in a residential area according to the FLUP. Asked about the regulations regarding a flag pole without an antenna. Carlin: Asked questions about the surrounding zoning. Copple: Answering DeMattia, confirmed the antenna pole height change is the only revision to the request. Addressing Turner, clarified the recommendation for denial is primarily due to the allowable height within residential districts and less intense non-residential districts. Noted the Sign Ordinance restricts flagpoles to forty (40) feet in height. Clarified the area included in the request and the surrounding zoning for Carlin. Page 3 of 5 Peter Kavanagh: Requested the item be tabled to the February 19, 2013 Planning & Zoning Commission meeting in order to allow time to discuss the proposal with Blue Star. Motioned by Turner, seconded by Carlin to table the item to the February 19, 2013 Planning & Zoning Commission meeting. Motion approved 4-0 at 7:00 p.m. 7.
