The meeting was called to order at 6:00 p.m. Roll call taken by Melanie Videan, Planning Technician. MINUTES Regular Meeting of the Prosper Planning & Zoning Commission 108 W. Broadway St., Prosper, Texas Town of Prosper Municipal Chambers Tuesday, February 18, 2014, 6:00 p.m. Commissioners present included: Chair Mark DeMattia, Vice Chair Mike McClung, Bruce Carlin, Craig Moody, Bill Senkel, and Rick Turner. *Commissioner Keith informed of his absence prior to the meeting. Staff present included: Hulon Webb, Executive Director of Development and Community Services; Chris Copple, Director of Development Services; Alex Glushko, Senior Planner; and Melanie Videan, Planning Technician. 2. Recitation of the Pledge of Allegiance. 3. Consider and act upon minutes from the following Planning & Zoning Commission meeting: ■ February 4, 2014 Regular Meeting Motioned by McClung, seconded by Turner to approve item 3. Motion approved 6-0 at 6:01 p.m. REGULAR AGENDA 4. Conduct a Public Hearing, and consider and act upon a request to rezone 357.3f acres from Planned Development-14 (PD-14) and Planned Development-43 (PD-43) to Planned Development -Single Family/Retail/Commercial (PD-SF/R/C), located on the north side of U.S. 380, 3,800f feet west of Dallas Parkway. (Z13-0011). Summary Copple: Summarized the zoning of surrounding properties and future thoroughfares in the area. In briefing on the request to rezone, compared the number of existing residential units versus the number of proposed residential units, retail acreage in the existing planned development (herein called the PD) versus the proposed PD, and commercial acreage in the existing PD versus the proposed PD. Described the location of the residential area, which has three types based on lot size, the retail area, the commercial area, and the location of parks. Noted the fencing and architectural standards exceed the standards set forth in the Zoning Ordinance. Explained the Future Land Use Plan's (herein called the FLUP) recommendations for the area and why the proposed PD generally conforms to the FLUP. Listed the three conditions of approval set by the Parks and Recreation Board as a recommendation for the Commission and Town Council. Informed notification was provided in accordance with state law, and the Planning Division received one public hearing notice reply form, not in opposition. Recommended approval Page 1 of 3 subject to the applicant revising the proposed PD to address the Parks and Recreation Board's recommendation. Discussion with Staff Craig: Asked for clarification that, with a few exceptions, the development standards for the proposed PD's commercial area generally follow the same standards permitted in the Town's Commercial Corridor and Commercial Districts. Copple: Provided confirmation regarding the development standards for the proposed PD's commercial area, noting the main difference is the height restriction for hotel, office, and hospital uses — which is eight stories, no greater than 100 feet — while the height standards for the remaining uses are two stories, no greater than 40 feet. Motioned by Carlin, seconded by Turner to open the public hearing. Motion passed 6-0 at 6:11 p.m. Public Hearinm Discussion Clint Richardson (applicant): Briefed on the proposal's past and recent history, noting the reduction in commercial acreage and single family lots. Noted their progress in conforming with the FLUP. Regarding the parks, conveyed their intent to utilize the floodplain area in the community park for sports uses, though it will also provide traditional uses. McClung: Asked applicant if he would accept the Parks and Recreation Board's recommendation and revise the following in Exhibit C: 1) Add Type C single family lots to Section 1.6.3.4, 2) Delete Recycling Collection Point in Section 2.2, and 3) Delete Recycling Center and Recycling Collection Point in Section 3.2. DeMattia: Asked applicant if he would remove Major Equipment and Machinery Sales and Rental and Commercial Antenna and/or Antenna Support Structure uses from the permitted uses list for the commercial area. Turner: Asked about the location of single family Type C lots. Carlin: Asked applicant what the average home sales price will be and who the builders will be. Richardson: Responding to McClung, agreed to revise Exhibit C to reflect McClung's suggestions. With regard to the parks, informed of discussions with staff on how to calculate the money in lieu of land, but with intentions for the neighborhood park to function as a community park, preferred to receive park land credit for the neighborhood park. Addressing DeMattia, agreed to remove Major Equipment and Machinery Sales and Rental from the commercial area's permitted uses, but before agreeing to remove the Commercial Antenna and/or Antenna Support Structure use, confirmed with staff that the Stealth Antennas use is not included in that use. Confirmed for Turner that larger lots were spread along the northern and eastern boundaries of Tract 2 as a concession for reducing the amount of small lots north of Prairie Drive. Answering Carlin, estimated the average home sales price to be in excess of $400,000 and that Coventry Homes may be one of the builders. Copple: Informed the definition for the Stealth Antennas use differs from that of Commercial Antenna. Motioned by Turner, seconded by Moody to close the public hearing. Motion passed 6-0 at 6:21 p.m. Page 2 of 3 Discussion McClung: Voiced support for the request, as the applicant has worked in good faith to conform to the FLUP, has reduced the commercial acreage, and the building standards exceed those in the Zoning Ordinance. Senkel: Voiced support for the request, as it conforms to the Commission's preferences for new PDs. Noted his experience of parks being located away from floodplains; therefore, favored utilizing the natural amenities the floodplain offers for parkland use. Moody: Preferred large lots, but understood the proposal is a substantial improvement from the existing zoning. Voice support. Turner: Voiced support, as the proposed PD conforms to the FLUP. DeMattia: Voiced support subject to the Parks and Recreation Board's recommendation, as the proposed PD conforms to the FLUP, the existing commercial area won't immediately be built and its uses are more restrictive than the existing PD, it generally complies with park land dedication requirements, and smaller lots are closer to the commercial section along U.S. 380. Motioned by McClung, seconded by Moody to approve a request to rezone 357.3f acres from Planned Development-14 (PD-14) and Planned Development-43 (PD-43) to Planned Development -Single Family/Retail/Commercial (PD-SF/R/C), located on the north side of U.S. 380, 3,800f feet west of Dallas Parkway subject to the following conditions: 1) Parks and Recreation Board's recommendations, 2) add Type C single family residential lots to Exhibit C, Section 1.6.3.4, 3) delete Recycling Collection Point in Exhibit C, Section 2.2, and 4) delete Recycling Center and Recycling Collection Point; Antenna and/or Antenna Support Structure, Commercial; and Equipment and Machinery Sales and Rental, Major in Exhibit C, Section 3.2. Motion approved 6-0 at 6:28 p.m. 5. Possibly direct Town Staff to schedule topic(s) for discussion at a future meeting. There was no discussion on this item. 6.
