Commissioners present included: Chair Mark DeMattia, Vice Chair Mike McClung, Bruce Carlin, Craig
Moody, Bill Senkel, and Chris Keith.
*Commissioner Turner informed of his absence prior to the meeting.
Staff present included: Chris Copple, Director of Development Services; Alex Glushko, Senior Planner;
and Melanie Videan, Planning Technician.
2. Recitation of the Pledge of Allegiance.
CONSENT AGENDA
3a. Consider and act upon minutes from the following Planning & Zoning Commission
meeting:
January 21, 2014 Regular Meeting
3b. Consider and act upon an amended plat of Whitley Place, Phase 5, being 60 single family
residential lots on 29.2f acres, located on the north side of First Street, 500f feet west of
Whitley Place Drive. The property is zoned Planned Development-49 and Planned
Development-50. (PD-49 & PD-50). (D14-0001).
3c. Consider and act upon an amended plat of Whitley Place, Phase 10, being 21 single family
residential lots on 10.9f acres, located 2,500f feet west of Custer Road and 1,000± feet north
of First Street. The property is zoned Planned Development-49 (PD-49). (D14-0002).
Motioned by Carlin, seconded by Moody to approve the consent agenda subject to staff's
recommendations. Motion approved 6-0 at 6:01 p.m.

4. Conduct a Public Hearing, and consider and act upon a request to rezone 0.7f acre from
Single Family-15 (SF-15) to Downtown Single Family (DTSF), located on the north side of
Third Street, 200f feet west of Church Street (309 E. Third Street). (Z14-0001).
Summary
Glushko: Summarized the zoning of surrounding properties, uses on the subject property, and the request
to rezone. Confirmed the request is in conformance with the Comprehensive Plan's Old Town Core

District Future Land Use Plan (herein called the Old Town FLUP). Informed notification was given in
accordance with state law, and the Planning Division has not received any public hearing notice reply
forms. Recommended approval.
Discussion with Staff
Carlin: Asked about downtown zoning.
Glushko: Explained the development standards for the Downtown Single Family District.
Motioned by Carlin, seconded by McClung to open the public hearing. Motion passed 6-0 at 6:05 p.m.
Public Flearina Discussion
Jim Bridges (property owner): Noted there is a house on the western edge of the property, and rezoning
allows him to replat the lot into two lots and possibly sell the second lot.
Carlin: Asked Mr. Bridges if the home is his primary residence.
McClung: Asked Mr. Bridges if he plans to develop the second lot.
Jim Bridges: Addressing Carlin, informed the property is a rental, and answering McClung, unsure if he
would develop the second lot, but preferred to keep his options open.
Motioned by Carlin, seconded by Moody to close the public hearing. Motion passed 6-0 at 6:07 p.m.
Motioned by Carlin, seconded by Keith to approve a request to rezone 0.7± acre from Single Family-15
(SF-15) to Downtown Single Family (DTSF), located on the north side of Third Street, 200f feet west of
Church Street (309 E. Third Street). Motion approved 6-0 at 6:07 p.m.
5. Conduct a Public Hearing, and consider and act upon a request to rezone 0.3f acre from
Single Family-15 (SF-15) to Downtown Retail (DTR), located on the west side of Coleman
Street, 100f feet south of Fifth Street. (Z14-0002).
Summary
Glushko: Summarized the zoning of surrounding properties, the request to rezone, and the downtown
retail development standards, noting the property is vacant. Confirmed the request is in conformance with
the Old Town FLUP. Informed notification was given in accordance with state law, and the Planning
Division received two public hearing notice reply forms, neither in opposition. Recommended approval.
Discussion with Staff
McClung: Asked for the difference between the Main Street Retail described in the Old Town FLUP and
the Downtown Retail District described in the Zoning Ordinance.
Carlin: Asked questions regarding the alley south of the property, concerned it will be vacated or
developed on. Asked about the future widening of Coleman Street.
Glushko: Explained to McClung the key differences between Main Street Retail, which primarily guides
intentions, and Downtown Retail, which regulates development standards. Addressing Carlin, informed
the ultimate Coleman Street width will be 85 feet and intentions for the alley will be determined at the
time the property is developed

Copple: Informed the alley is Town property.
Motioned by Carlin, seconded by Moody to open the public hearing. Motion passed 6-0 at 6:15 p.m.
Public Hearine Discussion
McClung: Asked what the plans are for the property.
Keith: Inquired how long the property owner has possessed the property.
Sherry Geer -Williams (applicant): Informed McClung the purpose for rezoning is to match the
surrounding zoning for whoever develops the property in the future, but the current property owner does
not plan to develop it himself. Answering Keith, reported Mr. Stroope has owned the property for a very
long time.
Motioned by Carlin, seconded by Keith to close the public hearing. Motion passed 6-0 at 6:18 p.m.
Motioned by Carlin, seconded by Senkel to approve a request to rezone 0.3f acre from Single Family-15
(SF-15) to Downtown Retail (DTR), located on the west side of Coleman Street, 100f feet south of Fifth
Street. Motion approved 6-0 at 6:18 p.m.
6. Conduct a Public Hearing, and consider and act upon a request to rezone 0.4f acre from
Single Family-15 (SF-15) to Downtown Office (DTO), located on the northwest corner of
Craig Road and First Street (713 E. First Street). (Z14-0003).
Summary
Glushko: Summarized the zoning of surrounding properties, the request to rezone, and the downtown
office development standards, noting the single family and office use on the property. Confirmed the
request is in conformance with the Old Town FLUP. Informed notification was given in accordance with
state law, and the Planning Division received one public hearing notice reply form not in opposition.
Recommended approval.
Discussion with Staff
McClung: Asked if architectural standards will apply if the home undergoes significant renovations.
Keith: Inquired if the home is adequate for office use, specifically noting ADA issues, and whether the
structure will need renovations to maintain an office use. Asked, if after rezoning approval, the residential
use must be abandoned within a given timeframe.
Glushko: To McClung, confirmed architectural standards would apply. Addressing Keith, reported the
home is currently a residential and office use but rezoning will bring the property into conformance.
Noted a plat and site plan will be required, at which time all development and ADA issues will be
addressed. Informed studio dwelling uses are allowed in the Downtown Office District.
Carlin: Questioned how the properties on the southwest corner of First Street and Craig Road rezoned to
downtown office, as they are currently residential uses. Also, concerned the property cannot be sold if it
has a non -conforming use.
Copple: Answering Carlin, reported the following: The properties on the southwest corner of First Street
and Craig Road were rezoned Downtown Office while the uses were residential. The properties are non -

conforming, which the Zoning Ordinance allows; however, should the residential uses cease for longer
than six months, any new use must conform to the current zoning district. Stated Town Council has the
authority to reinstate non -conforming status to a property. Informed conformance stays with the property,
not the property owner, and this conformance regulation is applicable to all Town properties.
Motioned by Carlin, seconded by Moody to open the public hearing. Motion passed 6-0 at 6:26 p.m.

Motioned by Carlin, seconded by McClung to approve a request to rezone 0.4± acre from Single Family-
15 (SF-15) to Downtown Office (DTO), located on the northwest corner of Craig Road and First Street
(713 E. First Street). Motion approved 6-0 at 6:27 p.m.
7. Possibly direct Town Staff to schedule topic(s) for discussion at a future meeting.
