Discussion regarding the review of the Town’s Charter. (MLS)
Charter Review Commission Guidelines
•Requires review every 10 years or earlier
•Consists of ten (10) citizens
1.Inquire into the operation of the Town government under the Charter and
determine whether any provisions require revision. To this end, public
hearings may be held. The Commission may compel the attendance of
any officer or employee of the Town and require submission of any Town
records;
2.Propose any recommendations it deems desirable to ensure compliance
with the Charter of the Town government; and
3.Report its findings and present its recommendations to the Town Council.
Charter Review Commission Guidelines
•The Town Council shall receive and have published in the official newspaper
of the Town a comprehensive summary of the report presented by the
Commission, shall consider any recommendations made, and may order any
amendments suggested to be submitted to the voters of the Town in the
manner provided by state law as now written or hereafter amended.
•The term of office of the Commission shall be for not more than six (6)
months, at the end of which time a report shall be presented to the Town
Council and all records of proceedings of the Commission shall be filed with
the Town Secretary and become a public record.

Discussion regarding the Town’s Park Development Agreement Policy

Overview
•Review park dedication and park fees related to development
•Considerations for negotiating park improvement agreements
•Review current proposals
Park Development Land Dedication/Fees
•Parkland Dedication – land dedicated for parks based on parks
master plan. If no park is planned, developer pays market
value of required acreage. (1 acre/35 units under previous
requirements)
•Park Improvement Fees – fees based on residential unit
numbers resulting in cash for future park development
•Tree Mitigation – must replace trees greater than 6 inches. If
trees can not be replaced then fee equal to the cost of replacing
each tree is paid.

approximately 288 homes.Phase 1 will deliver in July
2026 with home sales beginning in late 2026.

•Park Improvement Fees:
•Per the Agreement between the Town of Prosper,104 Prosper and 310 Prosper (recorded in 2005),the Mirabella
project (fka Rutherford) is required to pay a $1,200/lot in Park Improvement Fees.
•Total Park Improvement Fees for the project =$345,600
•Phase 1 –142 lots x $1,200/lot =$170,400 (~June 2026)
•Phase 2 –146 lots x $1,200/lot =$175,200 (~July 2030)
•Park Dedication:
•Mirabella is also required to either 1)dedicate park land,or 2)make a payment in lieu of park land dedication.
•The rate for payment is fixed at one acre of land per 35 residential units.

•REQUEST:Dedicate 8.3 Acres located at the southwestern edge of the existing SCS lake to the Town of
Prosper in lieu of payment of a park dedication fee.

1.The proposed park land is outside the gates of the private Mirabella community and will have its
own separate entrance off 380.
2.Mirabella is constructing a public trail at the north end of the spine road at the Custer Road entrance
and not requesting an offset from Mirabella’s required Park Improvement Fees.
•Mirabella will pay the $345,600 in required Park Improvement Fees to the Town of Prosper and
the Town of Prosper can decide how to use those funds.
3.There is approximately 1,100 feet of shoreline on the proposed park land for the Town of Prosper’s
residents to enjoy.This passive park experience cannot be found elsewhere in the Town of Prosper.
4.Connectivity to adjacent parcels:
•The Town of Prosper owns the two-acre tract directly to the south of the proposed park land.
•Prosper ISD owns the tract to the northwest of the SCS pond.
5.The Town of Prosper already has a hike and bike trail easement around the SCS pond.
