Public Hearing
Tuesday, February 25, 1986
City Hall 7:00 PM
Call to Order: The Public Hearing was called to order with
the mayor and all Council members present.
At this time the Mayor read the petition for annexation as
presented to the Council for consideration by Glazer and Luzzatto
fully describing the property and its location. He then asked
for any public comment. Mr. Luzzatt, representing the Purchasers
of the property, made a presentation of the Purchaser's position
with regard to the rezoning of the property after annexation. He
stated several reasons why the property should be zoned commercial
and, upon hearing concerns about multi -family use, agreed to deed
restrict the property until the year 2000 against any multi -family
development. There were no other comments and the public hearing
was adjourned.

Those Present: Mayor Cockrell; Council members: Cecil Norris,
Doyce Stanton, Steve Bell, John Johnson, John Christie.
Call to Order: The meeting was called to order by Mayor Cockrell.
Discussion and Consideration of a Buildinq Permit Request by Mr.

Dee Hooper: Mr. Christie represented Mr. Hooper in this
presentation admitting that he had not taken the appropriate
steps in the application for a building permit before a slab
was poured, that such was a mistake on his part and he took full
responsibility for it. After describing the development and
after substantial discussion with regard to parking, Mr. Christie
agreed to provide satisfactory plans to the City and on motion
by Cecil Norris and seconded by Doyce Stanton, the variance was
granted unanimously.
Discussion and Consideration of a buildinq Permit Request by Mr.

Joe Templin. Mr. Templin was present and stated that he was
unsure where his property line was and it was possible that the
existing building encroaches five feet into the City property.
Mr. Templin agreed to obtain satisfactory evidence, whether by
survey or otherwise, as to where his property line lay. He
noted that a 25 foot setback off McKinney street would make it
impossible for him to build on that side of the lot and subsequent
discussion indicated that it would be the concensus of the Council
that a variance could be granted in the set back off McKinney
if the building front were set back from Broadway to assure the
ability to see oncoming traffic. Doyce stanton made a motion
to grant a variance for the existing building as well as the
building under construction from the setback requirements off
Broadway provided only that the property line be identified and
that no encroachment onto City property exists for the new
building.
Consideration and approval of the Amendment of Ordinance 84-9:
Ordinance 84-9, concerning the appointment of a court clerk,
was discussed and the City Attorney was directed to prepare for 40
review, as soon as possible, a pay ordinance covering all the
positions and their duties as well as the benefits paid by the
City to its employees. Cecil Norris made a motion to direct the
above and to table any action on the amendment of the ordinance.
Doyce stanton seconded the motion. Motion carried.
Consideration and Approval of the Establishment of a City Court Fund:

Cecil Norris made a motion to create a seperate fund for the
deposit of monies collected from the City Court and to write
checks from the fund only for the purpose of quarterly fine payments
to the State comptroller , bond or fine returns, and transfer
checks to the General Fund to pay bills. Doyce Stanton seconded
the motion. Motion carried.
Personnel: It was agreed that the Council meetings should
be recorded in the future to enable the preperation of the
minutes with less effort. In addition, it was agreed that
all employees working more than 20 hours per week in an
average week should receive insurance benefits currently
paid to only full-time employees and on mation by Steve Bell
and seconded by Doyce Stanton it was approved.
Steve Bell than made a motion to approve the purchase of a
data base as recommended by the City Engineer. Cecil Norris
seconded the motion. Motion carried.
Adjourn: Doyce Stanton made a motion to adjourn. Cecil Norris
seconded the motion. Motion carried.
