PUBLIC HEARING - LAND USE ASSUMPTION PLAN
THURSDAY NOVEMBER 1, 1994
CITY HALL - 109 SOUTH MAIN STREET 7:00 P.M.
THOSE PRESENT: MAYOR SMOTHERMON: COUNCILMEMBERS; BILL CROSSWHITE, DON BROWN,
MIKE DALTON AND STEPHEN COFFMAN. RALPH BOYER WAS ABSENT.
ADVISORY COMMITTEE PRESENT: MARK CAREY, DAVID FERGUSON AND GEORGE BOYCE. LINDA
MAHARD AND PHIL COOPER WERE ABSENT.
HUNTER & ASSOCIATES PRESENT: HAL JONES
ATTENDANCE: CRAIG CURREY WITH THE NELSON CORPORATION REPRESENTING OPUBCO AND
ROANLD UNDERWOOD.
CALL TO ORDER: MAYOR SMOTHERMON CALLED THE MEETING TO ORDER.
HAL JONES TOOK OVER THE HEARING AFTER BEING CALLED TO ORDER. HAL EXPLAINED THE
FIRST PUBLIC HEARING ON THE LAND USE ASSUMPTION PLAN WAS HELD ON THE 16th OF
AUGUST, 1994 AT 7:00 P.M. AT THE PROSPER CITY HALL. THE RESOLUTION APPROVING
THE LAND USE ASSUMPTION PLAN WAS PRESENTED TO THE CITY COUNCIL AT THE SEPTEMBER
13th, 1994 MEETING OF THE COUNCIL. THE RESOLUTION WAS NOT APPROVED BY THE
COUNCIL ON THIS DATE, THE COUNCIL WANTED TO DISCUSS THIS FURTHER WITH THE ADVISORY
COMMITTEE. THE 30 DAYS YOU HAVE TO APPROVE THE RESOLUTION RAN OUT AND THE PROCESS
STARTED OVER AGAIN.
THE REASON THE RESOLUTION WAS NOT APPROVED WAS THE REPRESENTATIVE FROM THE NELSON
CORPORATION REPRESENTING OPUBCO WANTED TO SEE THE RETAIL/COMMERCIAL DISTRICT AND
THE SPECIAL DEVELOPMENT DISTRICT ENLARGED. AFTER A WORK SESSION BETWEEN THE
COUNCIL AND THE ADVISORY COMMITTEE ON THE 22nd OF SEPTEMBER, 1994 IT WAS AGREED
TO LEAVE THE PLAN AS PRESENTED ORIGINALLY.
AT THIS POINT THE AUDIENCE WAS ALLOWED TO SPEAK. CRAIG CURREY WITH THE NELSON
CORPORATION REPRESENTING OPUBCO SPOKE TO THE COUNCIL AND ADVISORY COMMITTEE
WITH THE HOPE THAT THE LAND USE ASSUMPTION PLAN WOULD BE CHANGED TO ENLARGE THE
RETAIL/COMMERCIAL DISTRICT AND THE SPECIAL DEVELOPMENT DISTRICT. THEY UNDERSTAND
THIS IS A LAND USE MAP AND NOT A ZONING MAP BUT FEEL THAT ONCE A PIECE OF LAND
IS ON THE MAP FOR A PARTICULAR USE THAT EVENTUALLY IT GETS ZONED THAT WAY.
THIS PROCESS BY LAW MUST BE REVIEWED EVERY THREE (3) YEARS. COUNCIL INFORMED -
MR. CURREY THIS PLAN MAY BE REVIEWED BY THE ADVISORY COMMITTEE AND THE COUNCIL
WITHIN ONE (1) YEAR.
MARK CAREY AND DAVID FERGUSON EXPLAINED THAT THIS IS A LAND USE PLAN THEY FEEL
SUITS PROSPER NOW BUT MAY BE CHANGED IN THE FUTURE.
GEORGE BOYCE EXPRESSED FEELINGS ABOUT NOT REMEMBERING THE RETAIL/COMMERCIAL AND
SPECIAL DEVELOPMENT SECTIONS BEING A BIG ISSUE DURING THE DEVELOPMENT PROCESS
OF THE PLAN AND WONDERS WHY IT IS NOW, THAT THE PLAN IS BEFORE THE COUNCIL.
THE COMMITTEE PLANNED THE LAND EAST OF PROSPER FOR LARGE ESTATE LOTS ON SEPTIC
SO THE CITY DID NOT HAVE TO PROVIDE SEWAGE SINCE EVERYTHING EAST OF PROSPER
ALONG HIGHWAY 380 WILL HAVE LIFT STATIONS BACK TO THE EXISTING SEWAGE TREATMENT
PLANT.

ORDINANCE ACCEPTING THE LAND USE ASSUMPTION PLAN WILL BE PRESENTED TO THE CITY
COUNCIL FOR APPROVAL AT THE REGULAR SCHEDULED MEETING ON THE 8th OF NOVEMBNN ,
1994.
