PUBLIC HEARING - LAND USE PLAN
TUESDAY AUGUST 16, 1994
CITY HALL - 109 SOUTH MAIN STREET 7:00 P.M.
THOSE PRESENT: MAYOR SMOTHERMON: COUNCILMEMBERS; STEPHEN COFFMAN, BILL
CROSSWHITE AND RALPH BOYER. DON BROWN AND MIKE DALTON WERE ABSENT.
ADVISORY COMMITTEE PRESENT: PHIL COOPER, CHAIRiā¢IAN AND DAVID FERGUSON. LINDA
MAHARD, MARK CAREY AND GEORGE BOYCE WERE ABSENT.
HUNTER & ASSOCIATES PRESENT: HAL JONES AND MARK HILL
CITIZENS IN ATTENDANCE: SHEET ATTACHED
CALL TO ORDER: MAYOR SMOTHERMON CALLED THE MEETING TO ORDER.
THE PROSPER CITY COUNCIL HELD A PUBLIC HEARING ON THE LANE USE ASSUMPTION PLAN
RELATING TO POSSIBLE ADOPTION OF IMPACT FEES ON THE ABOVE TIME, DATE AND PLACE.
MAYOR SMOTHERMON CALLED THE MEETING TO ORDER AT 7:00 P.M. AND TURNED THE FLOOR
OVER TO PHIL COOPER, CHAIRMAN OF THE ADVOSORY COMMITTEE. THE FIVE MEMBER ADVISORY
COMMITTEE WERE THE ONES WHO CAME UP WITH THIS PLAN. PHIL EXPLAINED HOW THE COMM-
ITTEE CAME UP WITH THE DIFFERENT LAND USES SHOWN ON THE MAP DISPLAYED AND THAT
THEY HAVE USED THEIR BEST JUDGEMENT IN THE ASSUMPTIONS OF WHAT PROSPER WILL SEE
IN THE WAY OF GROWTH IN THE NEXT TEN YEARS.
HAL JONES WITH HUNTER ASSOCIATES WAS INTRODUCED AND GAVE THE AUDIENCE AN EXPLANATION
OF WHAT THE LAND USE ASSUMPTION PLAN IS ALL ABOUT AND THE REASON FOR IT. THIS IS
THE FIRST STEP IN THE IMPLEMENTING OF IMPACT FEES FOR THE CITY . THIS PLAN IS HOW
THE COMMITTEE FEELS THE CITY WILL GROW WITHIN A TEN YEAR TIME PERIOD. THE CITY
HAS 16,803 ACRES WITHIN IT'S E.T.J. AND THE COMMITTEE HAS USED A GROWTH RATE OF
4.2% PER YEAR. THIS PLAN WILL PROVIDE A BASIS FOR DETERMINING THE NEED FOR
CAPTIAL IMPROVEMENTS FOR EXISTING AND FUTURE POPULATION.
AT THIS POINT THE MAYOR OPENED THE MEETING UP TO DISCUSSION FROM THE AUDIENCE.
SEVERAL SIGNED IN WISHING TO ADDRESS THE COUNCIL AND/OR ADVISORY COMMITTEE. THE
MAYOR CALLED THE FIRST NAME OF FRED WILSON. MR. WILSON HAD A CONCERN ABOUT THE
LAND USE PLAN AFFECTING EAST FIFTH STREET, AS SHOWN ON THE MAP TO BE PUBLIC OR
SEMI-PUBLIC LAND. MR. WILSON OWNES A LOT IN THIS SECTION AND WANTED EVERYONE TO
KNOW THIS IS PRIVATE LAND NOT PUBLIC AND HE THINKS IT WHOULD BE CHANGED. THE COMM-
ITTEE EXPLAINED THAT THIS LAND IS IN THE ARE OF THE EXISTING SCHOOL AND THE MAP IS
ON A SCALE OF 1" TO 2000' AND THEY ARE AWARE OF THE FACT THAT THE NORTH SIDE OF E.
FIFTH STREET IS PRIVATE LAND NOT PUBLIC.
SECOND, THE MAYOR CALLED RAY SMITH, RAY IS A REPRESENTATIVE OF OKLAHOMA PUBLISHING
COMPANY (OPUBCO) OPUBCO OWNES SEVERAL HUNDRED ACRES WITHIN OUR E.T.J. AND HAS A
VERY STRONG INTEREST IN THE WAY THE LAND IS PLANNED FOR USE. RAY WAS CONCERNED ABOUT
THE RETAIL/COMMERCIAL AREA ALONG THE SOUTHERN BOUNDRY BEING SH 38Q. HE WOULD LIKE
TO SEE THIS STRIP, WHICH IS PROPOSED TO BE APPROXIMATELY 900',WIDENED. HE ALSO
HAD SOME CONCERNS AS TO THE SPECIAL DEVELOPMENT AREA, AT THE ENTRANCE WAY OF THE
CITY.
THIRD, THE MAYOR CALLED HELEN EVE LIEBMAN WITH THE NELSON CORPORATION REPRESENTING
OPUBCO LAND ALSO. HELEN BROUGHT ALONG MAPS SHOWING THE SAME CONCERNS ADDRESSED BY
MR. SMITH. THE MAPS SHOWED EXACTLY HOW THEY WOULD LIKE TO SEE THE CHANGES MADE IN
THE RETAIL/COMMERCIAL AND SPECIAL DEVELOPMENT AREAS.

PHIL COOPER EXPRESSED HIS GRATITUDE FOR THEIR CONCERNS AND HOW MUCH THE
COMMITTEE AND COUNCIL APPRECIATED THEIR INPUT,BUT FOR THE CITY AT THIS TIME
THEY FEEL THE PROPOSED LAND USE AS IS WOULD BE BETTER FOR THE PRESENT BUT
MIGHT BE CHANGED BY NEXT YEAR.
NEXT, THE MAYOR CALLED TOM JONES WITH THE ARCHER CORPORATION. THE ARCHER
CORPORATION OWNES A PIECE OF LAND ON SH 289 AND FTI 1193. MR. JONES WAS
CONCERNED BY THE THOROUGHFARE PLAN PROPOSED BY THE COTf1ITTEE. THEY ARE
SHOWING ON THE MAP A THOROUGHFARE ROAD, EAST & WEST ALONG THE NORTHERN
BOUNDRY OF THE ARCHER TRACT. THEY FEEL THIS IS UNFAIR AND THAT THE ROAD
SHOULD BE MOVED TO THE EXISTING HICKORY CREEK DRIVE SO THEY DO NOT HAVE TO
BARE THE BURDEN ALONE FOR THE MAJOR ROAD.
THE MAYOR ADDRESSED THIS WITH THE FACT THAT THE CITY DOES NOT OWN HICKORY
CREEK DRIVE AND NO ONE IS QUITE SURE WHO DOES AND NOTHING WILL BE DONE UNTIL
THE OWNERSHIP OF THE ROAD IS IDENTIFIED.
MOTTON BY RALPH BOYER AND SECONDED BY BILL CROSSWHITE TO CLOSE THE PUBLIC HEARING
AND BRING FORTH A RESOLUTION FOR ADOPTION OF LAND USE ASSUMPTIONS FOR IMPACT
FEES AT THE REGULAR SCHEDULED CITY COUNCIL MEETING, TUESDAY SEPTEMBER 13, 1994.
