THOSE PRESENT: JIM DUNMIRE, CHARLES NISWANGER, LARRY TRACEY BONNIE TUCKER, BILL LIT'llE, PAUL BROWNING & LOWELL BROOKS CALL TO ORDER: JIM DUNMIRE, MAYOR PRO -TEM, CALLED THE MEETING TO ORDER THE PUBLIC HEARING WAS ON UNSIGHTLY PROPERTY AT 410 WEST BROADWAY STREET. THE CITY POSTED THE DOOR OF SAID BUILDING ON 5-23-00, MAILED CERTIFIED LETTER AND ONE BY REGULAR MAIL ON 5-25-00, AND PUBLIC BEARING ON 5-30-00 TO GET THIS PROPERTY CLEANED UP. MR. BROOKS WAS PRESENT AND ASK FOR THE COMPLAINT BEFORE HE SPOKE. Jim DUNMIRE GAVE HIS VIOLATIONS AND ORDINANCE HE IS IN VIOLATION OF. HE INFORMED MR. BROOKS HE HAS BEEN CONTACTED OVER THE PAST 2 TO 3 YEARS ON THIS SAME MATTER AND NOTHING HAS BEEN CLEANED UP. MR. DUNMIRE ASK MR. BROOKS TO REMOVE ALL MATTER FROM PROPERTY AS QUICKLY AS POSSIBLE. MR, BROOKS INFORMED THE COUNCIL THAT THEY ARE INTERRUPTING HIS BUSINESS. JIM DUNMIRE SAID HE DOES NOT HAVE ENOUGH LAND TO DO WHAT HIS BUSINESS RI?QUIRES, THE CITY HAS NOT ENFORCED OUR ORDINANCES BEFORE, BUT NOW WE ARE TRYING TO GET THE DOWN TOWN AREA LOOKING GOOD, RONNIE TUCKER, FIRE MARSHALL, TO MR. BROOKS THAT HE MAY CLEAR SOME OF THE DEBRIT OFF, BUT MORE IS JUST MOVED IN, IT IS AN ON GOING THING. JIM DUNMIRE TOLD MR. BROODS WE ARE NOTTRYING TO CLOSE HIS BUSINESS, WE JUST WANT THE PROPERTY CLEANED UP. EVEN IF SURROUNDING PROPERTY OWNERS HAVE GIVEN YOU PERMISSION, IT ALL NEEDS TO BE CLEANED UP. BILL LITTLE TOLD MR. BROOKS HE IS IN VIOLATION OF ORDIANNCE #84-16, WHEN IN VIOLATION OF THIS ORDINANCE, YOU HAVE TO MEET REQUIREMENTS OF THE NEW 289/380 CORRIDOR ORDINANCE. SAFETY IS ONE OF THE COUNCILS MAIN CONCERNS WITH CHILDREN OUT FOR THE SUMMER AND THE BALLFIELDS SO CLOSE TO THE SUBJECT PROPERTY. BILL LITTLE TOLD MR. BROOKS HE COULD FIND NO PATHWAY TO THE FRONT DOOR WHEN HE CAME TO POST NOTICE. MR. BROOKS INFORMED THE COUNCIL THEY WERE HOLDING AN ILLEGIAL MEETING. HE WAS NOT GIVEN 10 DAYS. OUR ORDINANCE CAN REQUIRE A LESSER PERIOD OF TIME, AS WE DID IF THERE IS A CLEAR AND PRESENT DANGER. MR. BROOKS WAS TOLD TO MOVE ALL DEBRIT WITHIN A REASONABLE LENGTH OF TIME OR THE CITY WILL CLEAN IT ALL UP AT OWNER EXPENSE. JIM DUNMIRE ASK MR. BROOKS WHAT BE IS WILLING TO DO. MR. BROOKS SAID BE NEEDS 5 MONTHS TO CLEAN UP, MR. DUNMIRE TOLD HIM THIS IS NOT ACCEPTABLE. COUNCIL DOIS NOT WANT THESE MATERIALS IN AN OPEN AREA UNSCREENED. OVER ALL APPEARANCE OF PROPERTY HAS BEEN UNCHANGED FOR 2 TO 3 YEARS, MOTION BY CHARLES NISWANGER AND SECONDED BY LARRY TRACEY TO GIVE MR. BROOKS 14 DAYS, OR UNTIL REGULAR COUNCIL MEETING ON JUNE 13, 2000 TO CLEAR FIRE LANE, AND RIGHT-OF-WAYS, AND SEE 14OW FAR HE GET WITH THE CLEAN UP, BILL LITTLE, BUILDING INSPECTOR, WILL MONITOR 'THE PROGRESS AND REPORT TO COUNCIL. AT nmr TIME, THE COUNCIL WILI., DETERMINE IF HE, WILL BE GIVEN VARIANCE TO INSTALL A FENCE FOR A BARRIER AND MORE TIME TO COMPLETETHE CLEAN UP OR IF IT WILL BE REQUIRED FOR THE CITY TO TAKE FURTHER STEPS.
