Tuesday, September 18, 2001, 7:00 p.m.
Those Present: Jim Dunmire, Charles Niswanger, Darin Riggs, Jeff Walker, Michael Perry
and Janet Phillips.
Call to order. Mayor Dunmire called the meeting to order.
Invocation: No invocation given due to absence of clergyman.
Public Hearino for Discussion and Action on Possible Variance for Pot -Bellied Pio residino at
1812 Waterwood Drive: Residents at 1812 Waterwood Drive, The McCrackens, were not
present for the meeting. Motioned by Michael Perry and seconded by Charles Niswanger to
deny the requested variance for a pot-bellied pig residing at 1812 Waterwood Drive. Motion
carried to deny variance.
The McCrackens have 30 days to remove the pig from their residence. At which time, the
residence will be inspected by Bill Little to ensure that the McCrackens have come into
compliance with our ordinance.
Pgblic Hearino -2001 Tax Rate: Public hearing opened at 7:10pm. Citizen Randy Turner
inquired on the tax rate. Mayor Dunmire explained that the City's estimated growth should
be able to bring in enough revenue to cover any additional expenses. Public Hearing closed
at 7:17pm.
First PLL lic Hearing — La Cima Annexation: Public hearing opened at 7:17pm. Steve Folsom
explained where the property is located, the acreage and that it is currently in the process of
being rezoned as Planned Development. Questions arose regarding CR78. Mr. Folsom
explained that should be an issue discussed with the developer, John Pappagolos. CR73 will
also be an issue at the time this property is annexed. Public Hearing closed at 7:22pm.
First Public Hearing, — Chuck Green Annexation: Public hearing opened at 7:22pm. Chuck
Green was not present. Mike Beaty explained this property will be traded to Blackard
Development in the near future, and negotiations are currently taking place in that regard.
Public hearing closed at 7:25pm.
Consent Items: Motioned by Janet Phillips and seconded by Darin Riggs to accept the
consent items. Motion carried.
Comments from Citizens.; Jean Mullendore addressed the Council regarding concrete trucks
driving up and down Broadway. She explained that it is dangerous; and it is ruining the
street. The Mayor advised that Broadway is a state highway, and we have addressed the
State requesting proper maintenance of the street. The City may prohibit the concrete trucks
from using city streets but cannot control their use of state highways.' Mayor Dunmire
suggested the concrete plants be revisited regarding proper routes throughout the Town. He
also requested Chief McFarlin prepare a proposed truck route for the City Attorney and
Council to review.
Lloyd Rucker. presented Council regarding the collection of paper and aluminum cans. The
Mayor explained that the City Administrator is currently in the process of researching new
providers that offer recycling. The City's sanitation contract is up for renewal in November.

Second, Mr. Rucker requested that the Council speak louder so that the citizens could hear
more clearly.
Radean Herron, Tax A/C, Ret: Radean presented Council with the August Tax Report.
Motioned by Charles Niswanger and seconded by Darin Riggs to accept the Tax Report.
Motion carried.

Kirk McFariin _.R tig Chief Rer)ort: Chief McFarlin presented Council. He acknowledged a job
well done by the Fire Department during the recent tornadoes. Kirk mentioned the City's
sirens are in poor condition and should have some advances made to update them. -
Chief McFarlin announced that a new Reserve, William (Bill) Hyde, will begin work as early as
next week.
He has been researching the traffic at the Middle School with the aid of Lloyd Rucker. There
is no formal report at this time, but he did mention the need to redefine some, if not all, of
the school zones.
Kirk is currently studying various options for concrete routes and talking to potential
Reserves.
Prosoer E,D.C. Reoort: Mr. Herblin was out of town. No report made. No action taken.
Action on Adootion of Ordinance rvre_ tina Planning and Zoning. Committee: Motioned by
Darin Riggs and seconded by Janet Phillips to adopt ordinance creating Planning and Zoning
Committee. Motion carried to adopt ordinance.
Action on A000intment of 5 members to the Planning and Zoning Committee: Motioned by
Charles Niswanger and seconded by Janet Phillips to appoint the following citizens to the
Planning and Zoning Committee: Larry Tracey, Shephen Coffman, Ane Casady, Michael
Wadsworth, Michael Parkinson and Erika Kruckenberg as alternate. Motion carried for the
appointment of members to the Planning and Zoning Committee.
The Planning and Zoning Committee will be effective in October. The Council will attempt to
complete any work currently on agendas.
Citizen Randy Turner inquired about the appointment of Ane Casady to the Planning and
Zoning Committee. He feels that Ane's occupation of real estate agent could be a potential
conflict of interest. Mayor Dunmire explained that all appointees will be sworn in to act in
the best interests of the City and not themselves. The Mayor mentioned the Council feels the
appointees are citizens of high moral standards.
'V9tiperl�a-rrn Annexation Ordinance Adoot by_Cour�cii: Mike Beaty explained that
the treatment plant will most likely be on the south/southeast portion of the Whispering
Farms property.
George Boyce was present and requested that he be kept informed on the sewer plant issue.
Mr. Boyce does not reside within the City Limits of Prosper but does live very near the future
site for the treatment plant. It appears the potential run-off from the plant may be dumping
into a creek that runs across Mr. Boyce's property. Mike Beaty advised that he will be

meeting with George regarding this issue. Mr. Boyce and other concerned property owners
will also be given the opportunity to voice their concerns at the upcoming TNRCC hearings.
Motioned by Darin Riggs and seconded by Janet Phillips to adopt the annexation ordinance
for Whispering Farms. Motion carried to adopt the annexation ordinance for Whispering
Farms.
Workshop frith John Harris on Development on SH289: John Harris not present. Workshop
tabled to October 2, 2001. No action taken.
