08.28.2001 Town Council Minutes (Special)WN Special City Council Meeting City Hall — 109 S. Main Street Tuesday, August 28, 2001, 7:00 p.m. Those Present: Jim Dunmire, Charles Niswanger, Darin Riggs, Jeff Walker, Janet Phillips and Michael Perry. Call to order: Mayor Dunmire called the meeting to order. Workshoo with North Texas Municipal Water District on water/sewer issues: Executive Director Jim Parks and Engineer Randall Dobbs, both with the North Texas Municipal Water District (NTMWD), presented Council regarding various water and sewer issues. Mr. Parks explained that they have a large diameter line coming from Wylie to Custer Rd and Hwy 121 (Plano #5 Delivery Point). The line is 72" to Virginia Pkwy and 48" after that. Plans are currently underway for Plano #5 to meet McKinney #3 just south of 380 and east of Custer Rd. This line will help service McKinney and Frisco with surface water and has been engineered to meet their need for the next 10 years. The completed project is estimated to be in service by summer of 2003. This line would be the closest location for the City of Prosper to tie in. Mr. Parks feels that Prosper's interest in this project is coming at a very good time. In order for Prosper to tie onto this line, the City needs to send a written letter of request and an engineer study to the NTMWD. The engineer study should include Prosper's water needs over time with projections at 5, 10 and 20 years. After receipt and review of these documents, the NTMWD will return to Council with a formal presentation. The City will need to have a means of transportation available for the water upon completion of the project. Mayor Dunmire advised that he will consult with Travis Roberts to prepare a letter of request and engineer study for the water line coming to Custer Rd and Hwy 380. Jim Parks addressed Council regarding sewer issues on the east side of the City. Although the NTMWD is in the process of expanding their Lavon plant in our direction, it would be difficult for us to get online. He would like to see the east side of our City come into their regional system but does not know how it could be done. Mr. Parks also addressed sewer issues for the west side of Town. The NTMWD is in the process of filing for a permit for a regional plant near Panther Creek. The timeline for permitting is difficult to estimate; therefore Mr. Parks was unable to give a very firm date of when the system will be online. He feels it will be at least 2-1/2 to 3 years before completion of the wastewater project. The City of Prosper tying onto this project would make very logical sense from a location and gravity standpoint. Mr. Parks advised that the NTMWD would need a letter of request and an engineer study indicating the City's capacity needs over time on the west side of Town. Mayor Dunmire advised that he will consult with Travis Roberts to prepare a letter of request and engineer study for the wastewater plant planned for the Panther Creek area. Mr. Parks advised Council of the NTWMWD's ability to handle solid waste needs as well. They operate disposal facilities but do not pickup the waste. If the City ever decided to do their own sanitation pick-ups, then we could quite possibly use their landfill. No action taken on Workshop with North Texas Municipal Water District. Letters of request will be drafted to inform them of the City's intent to be part of the upcoming NTMWD's Water and Wastewater projects. Action on aooroval of PD for Northridge Addition: Motioned by Janet Phillips and seconded by Charles Niswanger to approve the Planned Development Agreement for the Northridge Addition contingent upon noted changes and the following conditions: Section 1.11— The word "reimbursed" will be changed to "credited". Section 1.15 — Added wording to include, "any wooden privacy fence facing the street that the house is addressed on must be board -on -board construction for that portion of the fence facing the street. Furthermore, those corner lots backing to the main road and siding to any entry street will utilize board -on boards construction for that section of the wooden privacy fence facing the entry street. Stuart Jackson is to return to future Council Meeting and make presentation of design for entryways at CR77 and CR78. Motion carried to approve PD for Northridge contingent upon the above conditions. Action on adootion of Rezoning! Ordinance for Northridoe Addition: Motioned by Darin Riggs and seconded by Charles Niswanger to accept Rezoning Ordinance for the Northridge Addition. Motion carried. Action on entering into Develooment Agreement with Blackard: Jeff Walker advised Council of the work that he has been doing with Blackard and recommended the Development Agreement be accepted. Travis Roberts recommended we proceed as planned with the sewer plant and monitor the situation as it goes along. Motioned by Jeff Walker and seconded by Janet Phillips to accept the Developers Agreement with Blackard. Darin Riggs opposed. Voted 4 to 1. Motion carried. Action on acceptance of Rezonino Petition for Whisoerina Farms: Motioned by Jeff Walker and seconded by Charles Niswanger to accept the Rezoning Petition for Whispering Farms. Motion carried. Action on aooroval of PD for Whisoerina Farms: Motioned by Jeff Walker and seconded by Janet Phillips to accept the Planned Development for Whispering Farms contingent upon marked changes, which includes the allowance of 100% Hardi-Plank on 100% of the lots. Motioned by Charles Niswanger to include the following amendment with the original motion: • Regarding Section 1.11 — The first floor of the village units shall accommodate a minimum of 25% retail usage. Secqnded by Darin Riggs to accept the amendment. Michael Perry opposed. Voted 4 to 1. Motion carried to accept the amendment. Motion carried to accept Planned Development Agreement for Whispering Farms contingent upon the marked changes, including the allowance of 100% Hardi-Plank on 100% of the lots, and the above amendment regarding a minimum of 25% retail usage on the first floor of the village units. Darin Riggs will "tighten up his numbers" regarding Parks/Recreation and report back to Jim Herblin so that the EDC may budget amore realistic number. Michael Perry recommended agreater portion Ofthe EDC budget gotoendeavors toattract business to Prosper. Jeff Walker suggested allocating a portion of the EDC money to hive a consulting firm in an attempt to bring in business. Walker also suggested having the firm research grants for restoration of the historical district. Jennifer Finley distributed ahandout listing Street Repairs. Charles NisvYangeradvised that he will meet with Mickey Clark regarding these issues and prepare a 3 -year pu}pmaa| in which 1/3 of the streets are repaired each year. Janet Phillips announced the proposed budget has adeficit situation. Jennifer Finley explained that this year's budget would be ending |Asurplus, which should make upfor the foreseen 2001-2002 deficit. Budget hearing dosed at1U:55pnn.
