10.09.2002 Town Council, School Board Joint Work Session MinutesV Minutes Approved 11112102 Joint Work Session of the Prosper Town Council and Prosper School Board Prosper Middle School Library 605 East Seventh Street Wednesday, October 9, 2002, 7:30pm Call to order/Roll Call. Council Members: Mayor Dunmire, Jeff Walker, Charles Niswanger, Larry Tracey, Michael Perry and Russell Kaker; Town Administrator, Jennifer Finley. School Board Members: Chuck Stuber, Wanda Gammons, Robbie Reynolds, Daniel Jones, David Toney, Johnny Warren, Dan Tolleson; Superintendent, Drew Watkins. 2. Discussion regarding a request presented by the Prosper Independent School District (PISD) for a variance from the Town's Comprehensive Zoning Ordinance No. 84-16 as amended by, among others, Ordinance No. 99-24, Section 2A, Subsection 1.9.1 (Exterior Walls), authorizing the use of walls partially composed of metal materials for a new field house and practice facility. The subject property is located east of BUS289 on the current site of the Prosper High School in Prosper, Texas. Mayor Dunmire opened the meeting by stating that the Town is responsible for establishing Ordinances and Codes for the protection of its citizens. The Corridor Ordinance was not designed to overly restrict development, but to overlay the Zoning Ordinance and give the Council some control over certain building situations. A variance is designed for unique situations that are not clearly defined in an Ordinance, but the School's situation is clearly defined. The Planning and Zoning Commission determined on two separate occasions that the building should comply with the Corridor Ordinance and they recommended that the Town Council deny the variance request. The Council concurred with the P&Z that the building should comply. Mayor Dunmire stated that the Council has no right or intent to determine how the school appropriates its funds. The building itself is the only issue in question and the Council does not want to go to litigation. Mayor Dunmire asked the school board that as they plan projects in the future, to make effort to involve the Town Council and comply with all of the Town's Ordinances. The Council can begin planning for additional infrastructure to service new facilities, if they know about them in advance. Mayor Dunmire stated that he and the Town Administrator were involved in a meeting several months ago with the school board regarding school improvements. The only items discussed in the meeting were the Middle School improvements and the possible looping of a 12" water line at the Elementary School. Nothing was discussed on renovations to the High School. School Board President, Chuck Stuber stated that all school board meetings are open to the public and that the council is always welcome to attend. Mr. Stuber stated that a Building Permit should have never been issued if the building plans were not in compliance with all Town Ordinances. Mayor Dunmire explained to Mr. Stuber that the School's Architect, Huckabee, was notified immediately followina the elan review that the building did not meet code and would have to be modified. Mr. Stuber stated that the school board was never notified of that. Mi. Stuber also stated that the school was not notified of the first meeting that was held before the P&Z, and was told that their presence was not required at the second meeting, when the variance was denied for the second time. Robbie Reynolds explained that the facility was something that would benefit both the Town and School, as the facility would be open to the public. Michael Perry proposed that the council and school board have quarterly meetings, beginning immediately. Mayor Dunmire brought up the issue of the school contributing to the looping of the 12" water line at the Elementary School. The school board said they would look into it. 3. Adjourn.
