Town Secretary Amber Phillips
2, RUBLIG NEARING on the nrono§pd 2002-21163 lax 13ate. Mayor Dunmire opened the Public Hearing at 7:02pm. Lary Tracey advised that
the Budget Committee's recommendation is to maintain a $0.36 Property Tax Rate. The Town of Prosper has been able to maintain a $0.36
Property Tax Rate for the past 4 years.
Forrest Bentley, 1707 Colonial Court, explained that with the increase in water, sewer and electric rates and an overall Increase In property tax
values, he does not understand why the Council feels they should maintain a $0.36 Property Tax Rate. Mr. Bentley requested the Council rollback
the Property Tax Rate. Mayor Dunmire responded, explaining that the much needed infrastructure projects will require the Town maintain the $0.36
Property Tax Rate. He further explained that Prospers Tax Rate Is lower than any of the surrounding cities. Michael Perry read aloud the property
tax rates of surrounding cities. Mr_ Bentley stated that the City of Frisco is planning a rollback, The Mayor explained that Frisco is able to rollback
their property taxes because they have a substantial commercial tax base, Mr. Bentley recommended Council work to attract more commercial
businesses. Mr. Bentley advised that he is prepared to get a petition together that may require the Town hold an election if they wish to maintain the
$0,36 Property Tax Rate rather than opting for a rollback. Town Administrator Jennifer Finley advised Mr. Bentley that he would need to obtain the
necessary paperwork for a petition from the Collin County Elections Office in Plano.
Mavor Dunmire closed the Public Hearing on the proposed 2002-2003 Property Tax Rate at 7:07pm.

Council Members and citizens to present comments and/or questions regarding the proposed 2002-2003 Budget. He advised that the proposed
budget is Inclusive of the $0.36 property tax rate. No comments or questions from Coundt or citizens. Mayor Dunmire closed the Public Hearing on
the proposed 2002-2003 Budget at 7:08pm. No action taken.

site of the Prosiper i in Prosiper. Rxas, Mayor Dunmire invited representatives from Prosper Independent School District (PTSD) and
Huckabee, the architectural firm, to speak on behalf of the variance request. PISD Superintendent Drew Watkins addressed Council and introduced
Mr. LUGLn, Hucna bc.+ Architects.

Mr. Lueck explained that he worked with Building Inspector Bill Little, former Town Planner Edward McRoy and Fire Chief Ronnie Tucker prior to
beginning construction, and building permits were issued for both the addition to the gymnasium and the field house/practice facility. At the time
permits were issued, he was not advised that they needed a variance for the addition to the gymnasium; however, Bill Little dia advise :il9i o
variance would be required for the field houselpractice facility. Mayor Dunmire reiterated the fact that a variance is not required for the addition to
the gymnasium. Mr. Lueck presented Council with an outline of the timeline of events and walked them through the additional actions that had taken
place to date.
Mr. Lueck explained that there had been some miscommunication when working with Mr. McRoy, and the variance request was previously denied
by the Planning & Zoning Commission and Council.
Mr. Lueck provided Council with site plans and advised that the use of metal on the exterior of the facility will make it look more like the existing
facilities. Huckabee felt this was more aesthetically pleasing to the eye. He explained that several other materials could possibly work as
alternatives: however, it would be more costly, and he would not advise using more than 2 different materials on the exterior.
Michael Perry stated that one goal of the Council is to maintain quality throughout the Town; however, they also desire to work with the School
Board. He felt that a "metal barn" does not reflect quality and is not what visitors should see when entering Prosper. Mayor Dunmire advised that
the Council tries to set standards for the entire Town that can be enforced for a duration of time.
Lueck agreed that all buildings need to be quality. He explained that an ethos material is not durable enough to use for a school building because it
is easily damaged. Stucco could possibly work, but it is more costly.
Lueck advised that Huckabee typically uses as much masonry as possible on main buildings; however, metal is often used for career technology
facilities, maintenance buildings, practice facilities, etc.
Council thanked representatives for their time and honesty in answering the questions.

construct the entire building of blocks, but it was not affordable. He stated that the School Board is committed to quality as much as the C'ourigil[,3VJ
they have to make decisions as to what they can afford and where the tax dollars can best be spent. There are 300 to 400 children in athletics that
greatly need this facility. Furthermore, they also designed the facility with the idea of having a joint -cooperative agreement with the Town to provide
a fitness facility for Prosper residents. He felt that the High School is clearly the nicest looking building on BUS289, and the field house/practice
facility will not take away from, but compliment, the existing High School Building. Mr. Stuber stated that he does not feel it will. look like a "tin
building' but rather a high school facility. He advised that if they are required to attach an exterior material other than metal, it will cost
approximately an additional $200,000.00 that will not be available to be spent elsewhere.
Mayor Dunmire requested they have cost -comparison information readily available at the Public Hearing to illustrate the up -charges that may be
involved with various forms of masonry compared to metal.
Michael Perf l asked Mr. Sluber what the school intended to do about drainage off of the high school property. Stuber advised that they would be
digging a ditch, installing a concrete pipe and routing the drainage to the creek. Council requested the school have all their drainage plans approved
through Town Engineer Travis Roberts. Stuber agreed. Mayor Dunmire recommended school board and representatives attend Regular Council
Meetings with their architects to keep the Council current on the construction and issues surrounding it. Stuber agreed and suggested Council set
them as a re -occurring item on each month's Regular Agenda.

asked Town Administrator Jennifer Finley for her recommendation on a date for a Public Hearing. Ms. Finley advised that Staff recommendation is
October 8, 2002, which will provide ample time for the publication of required legal notifications.
.)Motioned by Russell Kaker and seconded by Charles Niswanger to set the Date, Time and Place to hold a Public Hearing to consider and act upon
granting a request presented by Prosper Independent School District (PISD) for a variance from Prosper's Comprehensive Zoning Ordinance, No.
84-16, Section 3A, Subsection 1.9.1 (Exterior Walls), authorizing the use of walls partially composed of metal materials for a new field house and
practice facility, as Tuesday, October S. 2002, 7:00PM, at the First Baptist Church Youth Building, 601 S. Church Street, Motion carried. Vote 4 to 0.
Mayor Dunmire advised that an agenda item will be posted following the public hearing for consideration and possible action on the variance.
7. Action on a oraval of the settlemen agreement with Edward S. Mg E c v. Mayor Dunmire asked Council to review the copies
of the settlement agreement provided to them prior to the meeting. Mr. McRoy signed the settlement agreement, as outlined in
Council's September 5, 2002.Special Called Meeting, on Friday, September 13. 2002. Motioned by Larry Tracey and seconded by
Russell Kaker to aoorove the settlement agreement with Edward S. McRoy. Michael Perry opposed. Motion carried. Vote 3 to 1.
8 Review and discussion of the Seotember 171N Town Flall ItAeetinu, Mayor Dunmire asked Council to review the Town Hall,
Meeting materials that were provided to there prior to the meeting. Jennifer Finley advised Council of the various committees and
departments that have agreed to be available to answer citizens' questions from 6 to 7pm.
Mayor Dunmire reviewed the presentation outline, and Council discussed how they would transition between various topics and
speakers. Michael Perry ad,. . amu; r, ;; ,,; .. a'w slides and Ms. Finley added since Council's last review of the slide
presentation. No action taken.
