03.05.2002 Town Council Minutes SpecialSpecial City Council Meeting First Baptist Church Youth Building 601 S. Church Street, Prosper, TX Tuesday, March 5, 2002 at 7:00 p.m. Those Present: Mayor Jim Dunmire, Charles Niswanger, Larry Tracey and Janet Phillips. Jeff Walker and Michael Perry were absent. Call to order: Mayor Dunmire called the meeting to order at 7:06 p.m. Consideration and possible action upon an Interlocal Agreement with Denton County to Regulate Subdivision Plats and Related Permits in the Town's Extraterritorial Jurisdiction (E.T.J.): Motioned by Charles Niswanger and seconded by Larry Tracey to approve the Agreement for regulation of subdivision plats and permits in the ETJ. Motion carried. - Consideration and possible action upon an Agreement for the Reduction of the Extraterritorial Jurisdiction (E,T.J.) of the Town of Prosper. Texas, by and between the Town of Prosper and Denton County Fresh Water Supply District No. 10 and Valerian Properties_ Association, L.P.: Janet Phillips was not in favor of acceptance of the Agreement until the Agreement with Denton County to regulate the subdivision plats has been executed by both parties. Charles Niswanger voiced the opinion that Prosper has the water CCN in the ETJ and that potential developers will have to come to the council prior to development. Representative, Elvio Bruni of Huffines was present and explained that drainage areas have already been staked off in the 800 acres of land. Lot sizes will be approx. 40 feet x 110 feet. Houses will range from 1200 sq. ft. to 2500 sq. ft. The area will be in Denton School District and have police and fire stations for protection. The developer does not anticipate -� the area pursuing incorporation as a city in the future. There will be commercial property along US 380 screening the residential development. The first phase "� , will be built on the Eastern portion of the property along FM 1385 and will include 01 an amenity center with a pool. No multi -family has been designated as a part of the development. Motioned by Charles Niswanger and seconded by Larry Tracey to accept the agreement for the reduction of the ETJ.
