Regular Meeting of the Prosper Town Council

Call to Order/Roll Call
Mayor Niswanger called the meeting to order at 7:43 pm. Roll call was taken by the Town
Accounting Clerk.
Council members present: Mayor Charles Niswanger, Mayor Pro -Tem Michael Perry, Russell
Kaker, Karie Dalton, Lisa Dritschler, and Ane Casady
Town Administrator Doug Mousel and Town Accounting Clerk Kelly Reed were also present.
Consider and act upon the adoption of a Future Land Use Plan and Thoroughfare Plan
Glen Gammons with the Prosper Economic Development Corporation addressed the Council. He
stated that the plan was presented to the Master Plan core team. He reminded the audience and
Town Council that this would be a plan and was subject to change. Mr. Gammons gave an
overview of the major components of the Master Plan. He stated that the plan does not affect any
current zoning, but protects the Town involving future development. It will serve as a guide for
future zoning.
Lisa Dritschler asked about the several different districts on Preston Road. Robin McCaffrey with
MESA Design Group stated there would be transitions between districts to complement each other.
Charles Hodges of Hodges & Associates at 5426 LaPella, Dallas, Texas stated that he has an
interest in the intersection of Preston Road and First Street. His development at that intersection is
considered a historic district by the proposed plan. He indicated that the property is zoned as retail
and should be depicted as such. He feels the overlay would place his property under heavier
restrictions. Lisa Dritschler asked Doug Mousel if he Was familiar with the concept plan for this
site. Doug gave a brief overview of this site and stated that a portion of the property would begin
construction in the next 3-4 months.
Tom Clark of 18409 Tumbridge, Dallas, Texas stated that he is one of the owners of the same
property referred to by Mr. Hodges. He stated that he doesn't agree with the proposed Master
Plan. He wasn't satisfied with the initial proposal and doesn't see enough change on the final draft.
He also stated that if this plan is approved, he hopes it will only be used as a guideline.
Craig Curry of Frisco, Texas spoke representing Blue Star Land Company and other property
owners including Jobe Properties. He stated that Blue Star Land Company's position is generally
favorable to the proposed plan. Some concerns they do have are related to there not being any
descriptions for each individual land use classification. He also stated he would like to see

something in writing saying that no current zoning would be changed in the future as a result of the'
Master Plan.
Lisa Dritschler asked about the connections along Legacy Drive and the lack of retail on the west
side of Town. In addition, Lisa stated that the residents on the west side near FM 1385 have no
major thoroughfares to get to Town. Robin McCaffrey stated the plan was intentionally prepared to
limit the crossing of flood plains.
Doug Mousel stated that the Town has recently entered into an agreement on the Reynold's
property to have retail on the west side of Town. Lisa Dritschler and Michael Perry both requested
that retail land use be depicted an the pian.
John Hams of the Strafford Group stated that he has spoken to several of the property owners
along First Street and they are interested in dedicating rights of way to the Town for First Street,
Michael Perry stated he had some concerns with the close proximity of the couplet entry west of
Preston Road and north of SH 3800. He also stated he had some concerns with the proximity of the
north couplet entry street to FM 1461 and feels it should be moved further south.
Charles Hodges asked for information related to signal lights on Preston Road. Doug Mousel
stated the potential number of signal lights along Preston Road between FM 1461 and CR 48 could
be reduced from four to three provided the entry street is moved to the south.
Robin McCaffrey stated that TXDOT has no plans to widen Preston Road in the next 30 years.
The current thoroughfare plan shows Coleman as a 4-lane road, Mayor Niswanger stated that he
understood TXDOT's intentions differently. Lisa Dritschler asked if it would be possible to organize
a work session between the Council and staff regarding these latest issues.
An audience member who stated her name as Twila expressed concerns with the notifications for
public hearings. She feels posting at the Town Hall and on the Town's website is not adequate.
She asked if the Council could consider other options for notifications. Doug Mousel stated that

options. Janet Phillips of the Eagle Talon offered to post any public meeting free of charge in
upcoming issues. Mayor Niswanger stated that he was unaware of any other way to post but that
the Council and staff would look into researching other ways of posting notifications for Town
meetings.
Russell Kaker stated that if there is a work session planned, the Economic Development
Corporation should be included with the Council, staff and MESA Design Group.
Mayor Niswanger expressed his dissatisfaction with the lack of ability to have a Future Land Use
Plan approved after more than 2 years.
Motioned by Ane Casady, seconded by Russell Kaker to table the adoption of a Future Land Use
Plan and Thoroughfare Plan. Motion carries. Vote 5 to 0.
Council recessed for a short break at 9:38 pm. The Council reconvened at 9:49 pm.
3, Consider and act to accept a Petition presented by Metten Real Estate L.P., and to set dates
for two public hearings and call for a service plan for the voluntary annexation of a tract of
land situated in the Collin County School Land Survey, Abstract No. 147, Collin County,

Texas, containing 80.4+ acres at the southeast corner of County Road 49 and County Road'

Motioned by Lisa Dritschler, seconded by Ane Casady to accept the petition. Motion carries. Vote
5 to 0,
4. Public Hearing: Presentation of service plan and second public hearing to consider the
voluntary annexation of a tract of land situated in the J. Horn Survey, Abstract No. 41, Collin
County, Texas, containing 65.593+ acres, at the northwest corner of Custer Road (FM 2478)
and US 380.
Motioned by Russell Kaker, seconded by Ane Casady to open the public hearing. Motion carries.
Vote 5 to 0. Mayor Niswanger opened the public hearing at 9:52 pm.

5. Public Hearing: Presentation of service plan and second public hearing to consider the
voluntary annexation of a tract of land situated in the Spencer Rice Survey, Abstract No.
787, Collin County, Texas, containing 65.593= acres, at the northwest corner of Custer Road
(FM2478) and US380.
Motioned by Russell Kaker, seconded by Ane Casady to open the public hearing. Motion carries.
Vote 5 to 0. Mayor Niswanger opened the public hearing at 9:53 pm.

6. Public Hearing: Zoning Case #03-2 - Consider and act upon a request to rezone 19.4+ acres
on the southwest corner of SH289 (Preston Road) and FM 1461 from Single -Family - 1 to
Planned Development - Retail.
Motioned by Kade Dalton, seconded by Russell Kaker to open the public hearing. Motion carries.
Vote 5 to 0. Mayor Niswanger opened the public hearing at 9:56 pm.
Frank Abbott with Kimley Horn of 9300 Wade Boulevard, Frisco, Texas spoke on behalf of the
applicant.
Michael Perry expressed concerns with the outcome of this particular property because it is one of
the "gateways" to the Town. Lisa Dritschler asked if there would be a possible easement
dedication for a "Welcome to Prosper' sign. Property owner Brad Camp stated he would be
entertain the idea.
Russell Kaker asked what the expected start date would be for construction. Brad Camp stated
that it would be in the next 12-18 months.
Mayor Niswanger, Lisa Dritschler, and Ane Casady stated that they had received at least one
phone call from a resident who expressed opposition to this request being approved.
Mayor Niswanger closed the public hearing at 10:08 pm.

Motioned by Lisa Dritschler, seconded by Russell Kaker to approve the request for rezoning"
subject to Council approval of the ordinance to annex the property, publication of the annexation
ordinance as required by law, and an easement for a "Welcome to Prosper" sign. Motion carries.
Vote 4 to 1 with Ane Casady opposing.
7. Public Hearing: Zoning Case #03-1 - Consider and act upon a request to rezone 61.7+ acres
on the northwest corner of the Burlington Northern -Santa Fe Railroad and CR4 (future
Prosper Trail) from Single -Family -1 to Planned Development -Single -Family -2
Motioned by Michael Perry, seconded by Lisa Dritschler to open the public hearing. Motion carries.
Vote 5 to 0. Mayor Niswangeropened the public hearing at 10:12 pm.
Ryan Betz with the Skorburg Company of 3838 Oak Lawn in Dallas, Texas represented the
applicant.
Ane Casady asked for examples of other projects completed by the Skorburg Company. She also
asked what builders would be utilized for the subdivision. The applicant listed builders including
David Weekly, Drees, Paul Taylor, Grand and Highland.
Lisa Dritschler asked the applicant why they were approaching the Council with even smaller lots
than previously submitted. Mr. Skorburg with the Skorburg Company stated that he was
responding to previous Council comments. Town Administrator Doug Mouse[ stated there were
specific statements made by at least one Council Member at a previous meeting requesting lot size
minimums of 10,000 square feet or greater.
Ryan Betz stated that out of 174 total lots, only 17 are less than 10,000 square feet. He also
stated that this application included more open space than the previous one.
Mayor Niswanger asked if the berming that would be required is included as part of the open
space. Mr. Betz stated that it is included. Mayor Niswanger stated it should not be included in the
open space acre total. He also stated that he'd like to see more curvature in the streets within the

Mr. Skorburg stated that berms are used to some degree by the residents of the subdivision. He
stated that there would be trails leading to an amenity center instead of various pocket parks. He
also stated that the neighboring subdivision was used as a template for the lack of curvature in the
street layout.
The Council asked that the applicant revise the request to include 90 percent of the lots with an
area of 10,000 square feet or greater and 10 percent of the lots no smaller than 9,000 square feet,
three to four acres of open space, curvilinear streets, and an amenity center.
Motioned by Lisa Dritschler, seconded by Ane Casady to close the public hearing. Mayor
Niswanger closed the public hearing at 10:56 pm.
Motioned by Lisa Dritschler, seconded by Russell Kaker to table the item until the October 21St
Planning & Zoning meeting. Motion carries. Vote 5 to 0.
8. Consider and act upon an ordinance for the voluntary annexation of a tract of land located
in the Collin County School Land Survey No. 12, Abstract No. 147, Prosper, Collin County,

Texas, containing 61.70 acres, more or less, and being more generally located on the north'"
side of C114 (Prosper Trail) near Coleman Street.
This application was withdrawn by the applicant.
Motioned by Ane Casady, seconded by Lisa Dritschler to accept the applicants' withdrawal. Motion
carries. Vote 5 to 0.
9. Adjourn
Motioned by Michael Perry to adjourn the meeting, seconded by Ane Casady. Mayor Niswanger
adjourned the meeting at 11:01 pm.
