Church Street Prosper First Baptist Church Children's Building (south wing) Tuesday, June 10, 2003, 6:30pm to 7:OOpm 1. Call to Order/Roil Call. Mayor Niswanger called the meeting to order at 6:33pm. Council Members present: Mayor Charles Niswanger, Mayor Pro -Tem Michael Perry, Lisa Dritschler, Karie Dalton and Russell Kaker. Ane Casady was not present. Also present: Town Administrator Jennifer Finley, Town Engineer Travis Roberts and Town Secretary Amber Phillips. 2 Review and discuss itgMs posted on the June 10, 2003. Regular Council Agenda. Mayor Niswanger updated Council on the background of Item #10, adjustments to Gentle Creek Subdivision water bills. He explained that valves had inadvertently been turned on which resulted in the subdivision using the Town's water supply to irrigate around the golf course rather than using their own wells. No one was certain how the mistake was made or who was at fault. David Whitsett, Gentle Creek developer, called Jennifer and requested consideration of a 50% reduction to the water bills for those particular months. Jennifer explained that in the past, the Town generally made 25% adjustments for situations similar to this, and she felt that would be appropriate for this situation versus the 50% requested by Mr. Whitsett. The total amount owed on these bills was approximately $15,000.00. Michael Perry asked if measures had been taken to prevent this situation from happening in the future. Jennifer stated "yes" and explained the measures. Jennifer explained that Item #11, the TXU gas rate case, had been turned over to the Town Attorney, but the attorney did not yet have a recommendation for Council. Gerald Perrin, Oncor Representative, presented Council and explained that the rate case had been filed in all cities where TXU had facilities. He recommended denial or deferral of the case. A deferral would mean that instead of taking rate changes back to the cities each time, they would go straight to the Railroad Commission. He advised that some cities had chosen to suspend the case for 90 days. If Prosper chose to suspend, it would require the Town Attorney draft a letter or resolution. Mr. Perrin explained that some form of action by the Town would be required by June 27, 2003, or the rate would automatically go into effect. Lisa Dritschler felt Council should table until recommendation could be made by the Town Attorney. 3. Review and discus May 2003 Activity Reports for the f2lJowing de en and committees: a.
