Church Street Prosper First Baptist Church Children's Building {South Wing) Monday, January 13, 2003, 7.00pm I.Callto Order/Roll Call. Mayor Dunmire called the meeting to order. Council Members present: Mayor Jim Dunmire, Mayor Pro -Tem Jeff Walker, Charles Niswanger, Lary Tracey, Michael Perry and Russell Kaker. Also present: Town Administrator Jennifer Finley, Town Attorney Richard Abernathy and Town Secretary Amber Phillips. 2. Act to adopt Ordinance No. 02-47, annexing a tract of land containing approximately 187.03 acres located in the Collin County School Land Survey, Abstract No. 147 and being more clenerally located a3c-y uel < iSluI e of +l.n-A west of the- railroad tracks. CUllirr i3Ounijl-, Texas. Motioned by Larry Tracey and seconded by Michael Perry to adopt Ordinance No, 02-47, annexing the proposed property. Motion carried. Vote 5 to 0. Town Attorney Richard Abernathy explained that he met with Councilman Kaker, applicant representatives and two Mesa consultants last week to negotiate the final terms of the Planned Development Standards and Council's concerns. He presented Council with the finalized version of the Rezoning Ordinance and the attached exhibits. Mr. Abernathy advised that he was comfortable with the finalized document and felt that it adequately addressed the concerns of all parties. Mayor Dunmire invited Council to ask questions regarding the document. Councilman Walker asked for clarification regarding several issues, and Council agreed to make the following change to the finalized document: add language to Section 2.10 of the Development Standards requiring the smooth side of the fence to face the right-of-way. Motioned by Russell Kaker and seconded by Larry Tracey to adopt Ordinance No. 02-48, rezoning the proposed property from Single Family Residence District (SF -1) to Planned Development (PD) with the following change: add language to Section 2.10 of the Development Standards requiring the smooth side of the fence to face the right-of-way_ Motion carried.
