04.20.2004 Town Council Minutes Work SessionMinutes (approved) Work Session of the Prosper Town Council 601 South Church Street Prosper First Baptist Church Children's Building (S. Wing) Tuesday, April 20, 2004 6:30 p.m. Town Of Prosper 1. Call to Order/ Rall Call. Meeting was called to order at 6:54 p.m. Roll call was taken by the Town Secretary Council present included: Mayor Charles Niswanger, Ane Casady, Lisa Dritschler and Mayor Pro -Tem Michael Perry. Kane Dalton and Russell Kaker were absent. Staff present included: Town Administrator, Doug Mousel; Town Secretary, Shanae Jennings; Director of Planning, Mitch Humble 2. Discuss a request to rezone 2,110.9± acres located at the northwest vomer of U.S. 380 and Fields Road from Single Family -Ito Planned Development -Mixed Use. (204.6) (MH) Doug Mouse] discussed the Town of Prospers anticipation of the potential annexation of the Mahard property for some time now, in part to prevent Municipal Utility Districts from moving into the Town. Craig Curry, representative for the applicant spoke regarding the Mahard rezoning issues and said he does not have a whole lot to say about it at this time. He said the Mahard's decided to annex, then decided to pull the annexation, and then decided to go ahead and go forward with the annexation if they could get their zoning. At this time, they would still like to move forward with the annexation but are still in the process of working through the terms of the potential zoning of the property and they are not sure zoning can be agreed upon on the short time table that is currently in existence. Mayor Pro -Tem Michael Perry stated that he believes Moth Council and Staff have been willing to dedicate the time and energy to this annexation, and that given the parameters for the annexation process in conjunction with the timing of the local option election, that the Mahard's should proceed with the annexation of the property. Lisa Dritschler stated that Council is here to go through all the information regarding zoning of the property and that because there is no information being presented by the applicant tonight the Council cannot re -think or add to anything since all parties last met. Craig Curry stated that in all reality because everyone is so pressed for time that the Mahard's will likely be looking at withdrawing the annexation, but iff there was more time it might be a different story. Mayor Charles Niswanger stated that the Council and Staff have been and continue to be committed to working with the Mahard's to get where they would like to go with the zoning issues related to their property. He also believes the Mahard's will be better protected with the land being annexed into Prosper. He suggested to Craig that he go back to the Mahard's and encourage them to annex this land, and that he would like to see it annexed before the election. Lisa Dritschler asked if Mr. Cunt' would expect us to zone this land as presented right now, and Mr. Curry said no, he didn't. Mr. Cunt' then suggested that the Mahard's had something different envisioned when they had originally decided to annex than what the Town has envisioned. 3. Discuss a request to rezone 702.2* acres located at the northwest comer of the Denton/Collin County line and US 380 from Single Family -1 to Planned Development -Mixed Use (ZO4.7) (MH) Mr. Curry has been working on a conceptual pian for the business district and business park. He also put a section in the handouts regarding residential buffering, and staffed there has to be buffering but that the Council needs to spell out what they want with that. Mr. Curry stated that he has not changed the commercial area of the zoning. Page 1 of 2 Mitch Humble stated that he briefly looked through the packet presented by Mr. Curry, and that he believes it is very close to being ready to go. Mayor Pro -Tem Michael Perry did have one major concern and stated that he does not support multi -family use beim proposed. Doug Mousel asked what the thoughts of Council were on removing the multi -family from the comer of County Line Road and Prosper Trail, and puffing single family or office; or, is it a wash and do they just want to remove it altogether. Lisa Dritschler stated that what can be placed on the comer is limited as indicated on the plan However, 10,400 square foot lots would not successfully sell, Mr. Curry said that if they did single family they would even work with the Town to dedicate right-of-way. He said if there is no multi- family on this lot, that retail doesn't work for him. Mayor Charles hliswanger asked what will work if mufti -family and office won't work. He asked if a hospital would work. Mr. Curry said they are open to it being used as a site for a high school or middle school. 4. Adjourn.
