Wing) Tuesday, March 9, 2004 6:00 p.m. Town Of Prosper 1. Call to Order/ Roll Call. Meeting was called to order at 6:08 p.m. Roll call was taken by the Town Secretary Council present included: Mayor Charles Niswanger, Ane Casady, Lisa Dritschler, and Kane Dalton. Mayor Pro -Tem Michael Perry and Russell Kaker were absent. Staff present included: Town Administrator, Doug Mousel; Director of Planning, 'Mitch Humble; Town Secretary, Shanae Jennings. 2. Discuss potential Zoning of properties In Denton County. Craig Curry, 10950 Research Road, Frisco, Texas 75034. He represented the property owners for both Mahard Ranch and the Legacy Pointe Properties, which is owned by the Rudman Partnership, Beall Legacy Partners, L.P. and West Prosper Investment Partners, Ltd. He approached Council to discuss zoning issues relating to all of these properties. The proposed Mahard Ranch zoning includes three districts: Residential Village, Business Park, and Business Center, The Residential Village would allow a maximum of 5,880 lots of a minimum 5,500 square feet on the property north of Fishtrap Road. The district also specifies three retail locations. The Business Park and Business Center would allow a mixture of light industrial, commercial, retail, multifamily, townhome, and single family units of a minimum of 5,500 square feet. The location of this area is generally located between US 380 and Fishtrap Road. The multifamily units are proposed to be capped at 1,200 units and the townhomes at 500 units. All of this together in acres would be approximately 60 acres. The second proposed zoning location is called Legacy Pointe, and is very similar to the Mahard Ranch, including the same three districts with similar proposed standards. Townhome and single family unites would not be permitted In the Business Center portion of this property. Townhome and single family units are proposed to be permitted in the Business Park portion of the property with a cap of 300 townhome units and a minimum lot size of 5,500 square feet for the single family lots. The multifamily unit cap is proposed to be 600. The main difference between the two properties is that a portion of the Legacy Pointe property is governed by the Reynolds Annexation agreement. The property governed by the Reynolds agreement is bound by Fishtrap Road, County Line Road, and Prosper Road. The Town has already agreed to allow a maximum of 902 - 5,000 square foot lots and two -23 acre retail corners within this property. The future Land Use Plan designates low-density residential uses for the majority of the Residential Village portions of the two zoning requests. Lisa would like to see some areas that contain larger lot sizes than the 5,500 square foot lots. She likes the idea of multi family as a buffer to the Business Park, but is not as fond of the single family in the Business Park. She feels that Prosper is known for their pastoral feel, and time after time when she speaks to people about why they moved to Prosper they speak of the large lot sizes. She hates to see such a large, beautiful piece of land cut up into small sized lots. Mayor Charles Niswanger is concerned about the retail on the Reynolds property in combination with the property being proposed for retail. Page 1 of 2 Lisa Dritschler asked if then= has been any talk about there being a potential school site somewhere between the four or five parcels that are being proposed. The applicant said they have not yet spoken to the school district, but that they do pian to speak with them. Mayor Charles Niswenger asked Mr. Curry to work with staff on the zoning and that Council will try to oblige them in any way passible. 3.
