02.10.2004 Town Council Minutes SpecialOf Prosper Call to Order/Roll Call Minutes (approved) Special Called Meeting of the Prosper Town Council 641 South Church Street Prosper First Baptist Church Children's Building (S. Wing) Tuesday, February 14, 2444 6:34 p.m. Special called meeting of the Prosper Town Council was called to order at 6:36 pm Roll call was taken by the Town Secretary Council present included: 'Mayor Charles Niswanger, Mayor Pro Tem Michael Perry, Ane Casady, Lisa Dritschler, Karie Dalton. Russell Kaker arrived at 6:37 pm. Staff present included: Town Administrator, Doug Mousel; Town Secretary, Shanae Jennings; Director of Planning, Mitch Humble. Motioned by Mayor Pro -Tem Michael Perry, Seconded by Russell Kaker to recess into closed session. Council recessed into executive session at 6:38 p.m. Recess into Closed Session in compliance with Section 551.001 et. Seq. Texas Government Code, to wit: Section 551.071. Consultation with City Attorney regarding: (a) legal aspects of operating a home occupation as K relates to the zoning ordinance; (b) legal aspects and responsibility of street lighting costs in subdivisions; (c) legal aspects of the "citizen input" portion of meetings as it reales to the Open Meetings Act; (d) legal aspects of fireworks stands in the ETJ and the 'town limits; (e) legal aspects of abatementlamortization of existing signs; (f) Cause No. 366-1326-03; Brow Outdoor Advertising, LLC v. The Town of Prosper, Texas and William A. Little, in his OfiScfal Capacity as BuhVing Official of the Towyn of Prosper, Texas, in the 3661h Judicial District Court, Collin County, Texas; (g) Cause No. 189-00878-03; In Re: Collin County, Texas, Celina, Texas, McKinney, Texas, Prosper, Texas and Weston, Texas, in the 199'h Judicial District Court, Collin County, Texas; and (h) Cause No. 401-00199-02; Tracy Boston v. The Town of Prosper! Texas, in the 401s' ,judicial District Court, Collin County, Texas. 3. Reconvene into regular session and take any action necessary as a result of the closed session. Council reconvened from closed session at 7:33 pm. Motioned by Russell Kaker, seconded by Ane Casady to reconvene. Motion accepted 5-0. No action was taken as a result of the executive session. 4. Consider and possibly act upon authorization for the Mayor and Town Attorney to take any and all possible action necessary In response to the lawsuit styled in Re: Collin County Texas, Celina Texas, McKinney Texas, Prosper Texas, and Westin Texas, flied in cause number 199-08878.03, Collin County Texas. No action was necessary on this item. 5. Consider and possibly act upon approval of the boundaries and or final judgment made the subject of the lawsuit styled.. In Re: Collin County Texas, Celina Texas, McKinney Texas, Prosper Texas, and Westin Texas, filed in cause number 199—=78-03, Collin County Texas. No action was necessary on this item.
