Meeting was called to order at 6:05 p.m. Roll call was taken by the Town Secretary Minutes (approved) Special Meeting of the Prosper Town Council 601 South Church Street Prosper First Baptist Church Children's Building (S. Wing) Tuesday, May 3, 2005 at 6:00 p.m. Council present included: Mayor Charles Niswanger, Mayor Pro -Tem Lisa Dritschler, Ane Casady, Kevin Drown, Mike Wadsworth, and David Bristol. Staff present included: Town Administrator, Doug Mousel; Planning Director, Mitch Humble and Town Secretary, Shanae Jennings. 2. Consider and act upon minutes from the Special Called Council meeting on April 19, 2005 and the Regular Council meeting on April 26, 2005. Motioned by Mayor Pro -Tem Lisa Dritschler, seconded by Ane Casady to approve the minutes for the Special Called meeting on April 19, 2005 and the Regular Council meeting on April 26, 2005. Motion approved 5-0. 3. Consider and act upon 1) an agreement for CR 73 (Lovers Lane) between the Town of Prosper and Blue Star Land and 2) a resolution authorizing the Mayor to execute the agreement. )tioned by Mike Wadsworth, seconded by David Bristol to approve 1) an agreement for CR 73 (Lovers Lane) between the Town of Nrosper and Blue Star Land and 2) a resolution authorizing the Mayor to execute the agreement. Motion approved 5-0. 4. A public hearing to consider and act upon the adoption of a proposed new Zoning Ordinance (Z05-1). (MH) Mitch proposed the Zoning Ordinance with the recommended changes from the prior council meeting on April 19, 2005 when Council last discussed the Zoning Ordinance. He proposed the lot sizes as requested by Council, which were one acre, 17,500 and 12,500 square foot lots with some equivalency districts incorporated to make the square footage of the lots work regarding the equivalency issues. Motioned by Mike Wadsworth, seconded by Mayor Pro -Tem Lisa Dritschler to open the public hearing. Motion approved 5-0. Mayor Charles Niswanger opened the public hearing at 6:18 p.m. Dawn Oldfield, 41A Rhea Mills Circle, Prosper, TX — She said they chose to move from McKinney to Prosper for the large lot sizes. They didn't just want a larger house which they could have gotten in McKinney, Plano or Frisco; they moved so they could live on big lots with large houses. David Bristol asked Ms. Oldfield if she could define what she meant by "big". She said that one house per half acre would be what she considers big or adequate. Mark Webb, 6324 Bandera Suite D, Dallas, TX — He is a developer and he feels strongly that the Council should keep the 10,000 square foot lot as an option for an area in which to build. Peter Shaddeck, 2400 Dallas Parkway, Suite 560, Plano, TX — He stated that he is a landowner and currently owns the Shanahan tract in Prosper. He stated that he would like to address medium density lot sizes. He would like for the Council to stay at 8,500 square foot lots t could live with a 10,000 square foot lot option; however, he encouraged the Council to stay away from 12,500 square foot lots. He udlieves that by creating larger lot sizes it affects the ability of people to live in Prosper, and it also affects the bottom line tax base. Page 1 of 3 Robert Shaw, 4400 Hidden Lakes Drive, Prosper, TX — He felt that what the staff was recommending for the Zoning Ordinance was reasonable and good for Prosper. 'dick Oldfield, 41A Rhea Mills Circle, Prosper, TX — He asked if there was a ratio that the Town was looking for regarding the SF 4 zoning. Motioned by Mike Wadsworth, seconded by Ane Casady to close the public hearing. Motion approved 5-0. Mayor Charles Niswanger closed the public hearing at 6:45 p.m. Mike Wadsworth asked Mitch Humble and the Council what is going to happen if a developer comes in and requests SF 10,000 lots, but the Council has passed SF 12,500 and SF 17,500. Mitch Humble said that if a situation like that occurred he would have to send the developer back to the drawing board to change his request and resubmit a new one with the appropriate lot sizes proposed or submit a planned development (PD) with some trade offs within the requested PD. Ane Casady said she would support the 12,500 square foot lots and would request they bring the 12,500 square foot lots back in a proposal instead of 10,000 square foot lots. Mayor Pro -Tem Lisa Dritschler said she feels the bar should be raised to 12,500 square foot lots, and she feels even those are small lots compared to what the citizens of Prosper appear to want. Kevin Drown stated that he understands the need for small lots, and if a developer came in with the proposal of 10,000 square foot lots across the board he would have to ask that larger lots be incorporated with the 10,000 square foot lots. Mike Wadsworth said he would support the larger lots at 12,500 and 17,500; however, he wants to see the Council support it wholly if that is what is to be decided. David Bristol said he is not convinced that 12,500 square foot lots are necessarily the best way to go; however, he does believe that it is the will of the people for 12,500 square foot lots to be the minimum for high density lots, so he will support it. Joe Anselmo, 36A Rhea Mills Circle, Prosper, TX — He is a member of the Zoning Ordinance Committee and he said that this proposal looks like a good compromise to him, and he supports it at this point. Dave Turley, 660 Toledo Bend, Prosper, TX — He also is a member of the Zoning Ordinance Committee and he supports what is being proposed and feels this is a good compromise by the Council. otioned by David Bristol, seconded by Ane Casady to approve the Zoning Ordinance as submitted below with the recommended change in the front yard building setback for the Single Family -10 District (SF -10) from 30 feet to 25 feet. Motion approved 5-0.
