10.13.2009 Town Council MinutesISPER OWN OF 1. Call to Order / Roll Call. The meeting was called to order at 6:02 p.m. Roll call was taken by the Town Secretary. MINUTES Regular Meeting of the Prosper Town Council Town of Prosper Municipal Chambers 108 W. Broadway, Prosper, Texas Tuesday, October 13, 2009 at 6:00 p.m. Council present included: Mayor Pro -Tem Ray Smith, Deputy Mayor Pro -Tem Kenneth Dugger, Dave Turley, David Vestal, Meigs Miller, and Danny Wilson. Staff present included: Mike Land, Town Manager; Hulon Webb, Director of Development Services; Dan Tolleson, Executive Director of Economic Development; Chris Copple, Senior Planner; Matthew Garrett, Finance Director; Wade Harden, Senior Planner; and Matthew Denton, Town Secretary. 2. Invocation and Pledge of Allegiance. The Invocation was given by Councilmember Meigs Miller. Mayor Pro -Tem Smith led the Pledge of Allegiance. 3. Announcements of dates and times of upcoming community events. Mike Land announced the October 17'h Serve Prosper has been cancelled due to the rain, the Prosper Trail construction has been put on hold until October 19"', and there will be a Blood Drive at the Community Library on October 27"'. CONSENT AGENDA 4. Consent Agenda MINUTES a. Consider and act upon minutes from the following Council meetings. (MD) September 21, 2009 — Special Town Council Meeting September 22, 2009 — Town Council Meeting September 29, 2009 — Joint Town Council / Parks and Recreation Board Meeting ORDINANCES RESOLUTIONS AND AGREEMENTS b. Consider and act upon an ordinance for the voluntary annexation of approximately 33.026 acres of land generally located north of West First Street and east of the Dallas North Tollway. (MD) C. Consider and act upon an ordinance rezoning 33.0± acres, located on the northeast corner of Dallas Parkway and First Street, from Agricultural (A) to Retail (R). (Z09-6). (CC) d. Consider and act upon an ordinance rezoning 5.9± acres, located on the west side of Coleman Street, 500± feet north of Prosper Trail, from Agricultural (A) to Commercial (C). (Z09-11). Consider and act upon an ordinance amending Chapters 10 and 14 of the Prosper Code of Ordinances to remove Ordinance Nos. 03-05 (Prosper Subdivision Ordinance) and 05-20 (Prosper Zoning Ordinance) from the Prosper Code of Ordinances to allow such ordinances to serve as stand-alone ordinances. (CC) f. Consider and act upon 1) an interlocal agreement between the Town of Prosper and the City of Frisco regarding the provision of Geographic Information Systems (GIS) Services to the Town and 2) a resolution authorizing the Town Manager to execute the same. (CC) g. Consider and act upon a resolution rescinding Kenneth Dugger's appointment to the MMD No. 1 Board of Directors. (ML) ANNEXATION PETITIONS h. Consider and act to accept a petition presented by Prosper Independent School District and the Town of Prosper to set dates for two public hearings and call for a service plan for the voluntary annexation of approximately 126.50 acres of land generally located South of Frontier Pkwy and west of N. Wesley Drive. (MD) Motioned by Deputy Mayor Pro -Tem Dugger, seconded by Councilmember Vestal to approve the consent agenda. Motion approved 6-0. CITIZEN'S COMMENTS 5. Other Comments by the Public. Linda Shaw, Town Librarian, updated the council on the Community Library. REGULAR AGENDA PUBLIC HEARINGS 6. A public hearing to consider and act upon a request to rezone 1.7f acres, located on the southeast corner of Fifth Street and McKinley Street, from Downtown Retail (DTR) to Downtown Commercial (DTC). (Z09-10). (CC) Chris Copple, Senior Planner, informed council the applicant is requesting the item be tabled until the November 24, 2009 Town Council meeting. Motioned my Councilmember Turley, seconded by Deputy Mayor Pro -Tem Dugger to open the public hearing. Motion approved 6-0. Mayor Pro -Tem Smith opened the public hearing at 6:08 p.m. There were no comments by the public. Motioned by Deputy Mayor Pro -Tem Dugger, seconded by Councilmember Miller to continue the public hearing to the November 24, 2009 Town Council meeting. Motion approved 6-0. DEPRTMENT ITEMS 7. Receive a presentation from Tracy Pounders regarding the delinquent tax turnover report. Tracy Pounders, LGB&S, gave council a presentation regarding the delinquent tax turnover report. Page 2 of 3 8. Discussion and update on the Town Community Park. (WH) Wade Harden, Senior Planner, gave council background information on this item. 9. Consider and act upon adding persons to the Visioning Committee. (ML) Motioned by Deputy Mayor Pro -Tem Dugger, seconded by Councilmember Turley to table until the October 27, 2009 Town Council meeting. Motion approved 6-0. 10. Possibly direct Town Staff to schedule topic(s) for discussion at a future meeting. 11. Adjourn. Motioned by Deputy Mayor Pro -Tem Dugger, seconded by Councilmember Miller to adjourn.
