The meeting was called to order at 6:00 p.m.

Tuesday, February 10, 2009 at 6:00 p.m.
Council present included: Mayor Charles Niswanger, Mayor Pro -Tem Ray Smith, Deputy Mayor Pro -Tem
Kenneth Dugger, David Vestal, Meigs Miller, and Danny Wilson.
Staff present included: Mike Land, Town Manager; Hulon Webb, Director of Development Services; Chris
Copple, Senior Planner; Kirk McFarlin, Police Chief, David Ledwitz, Code Enforcement Officer; and Matthew
Denton, Town Secretary.
2. Invocation and Pledge of Allegiance.
The Invocation was given by Pastor Mark Rylander, Prestonwood Baptist Church.
Mayor Niswanger led the Pledge of Allegiance.

b. Consider and act upon an ordinance amending the Town's Thoroughfare Plan (Section 13 of the
Town's Comprehensive Plan) regarding the alignment of Richland Boulevard and Hillcrest Road.

C. Consider and act upon an ordinance amending Planned Development -2 (PD -2), Sections 1.05
(building height), 1.10 (screening), and 1.12 (parking), located on 80.7± acres on the northeast corner
of U.S. 380 and La Cima Boulevard. (Z08-19). (CC)
d. Presentation of the 2008 Racial Profiling Report for the Prosper Police Department. (KM)
e. Consider and act upon a resolution ordering a General Election to be held jointly between the Town
of Prosper and the Prosper Independent School District to be administered by the Collin County

Elections Administration on May 9, 2009, for the purpose of electing two (2) members, Place 2, and
Place 6, to the Town of Prosper Town Council to fill expired terms. (MD)
Motioned by Mayor Pro -Tem Smith, seconded by Deputy Mayor Pro -Tem Dugger, to approve the consent agenda
items a through e.
Motion approved 6-0.

DEPARTMENT ITEMS
6. Discuss and provide direction on adoption of the 2006 International Property Maintenance Code
(IPMC). (DL)
David Ledwitz, Code Enforcement Officer, gave council a presentation on the current property maintenance codes
and the proposed codes.
7. Discuss and give direction on the 2009 Town Council Work Plan. (ML)
Mike Land, Town Manager, answered questions for council.
Council directed staff to bring the item back on the February 24, 2009 agenda.
8. Discuss and possibly appoint a member to the Planning and Zoning Commission to fill an unexpired
term.
Motioned by Mayor Niswanger, seconded by Mayor Pro -Tem Smith to table item 8 until the February 24, 2009
Town Council meeting.
Motion approved 6-0.
9. Possibly direct Town Staff to schedule topic(s) for discussion at a future meeting.
10. Adjourn.
Motioned by Deputy Mayor Pro -Tem Dugger, seconded by Mayor Pro -Tem Smith to adjourn.
Motion approved 6-0.
