V22-0004 1710 Whitetail Encroachment AgreementTHE VILLAGES OF STAR TRAIL HOMEOWNERS ASSOCIATION March 15, 2023 Matthew Owens 1710 White Tail Drive Prosper, TX 75078 RE: Non -Encroachment Agreement Mr. Owens, This letter shall serve as a non -encroachment agreement between The Villages of Star Trail Homeowners Association (Star Trail HOA), which is the owner of Lot 8X, Block G of Star Trail Phase One A in the Town of Prosper, Collin County, Texas and Matthew Owens (Owens) who is the current owner of Lot 4, Block G of Star Trail Phase One A in the Town of Prosper, Collin County, Texas (1710 White Tail Drive, Prosper, Texas). As the owner of the previously mentioned Lot 8X, Star Trail HOA herewith agrees that it will not now or at any time in the future encroach within three (3) feet of the proposed back of beam of the pool currently proposed by Owens as shown on the attached exhibit. Owens agrees that the back of beam of the proposed pool shall not encroach beyond the existing common property line between Lot 8X and Lot 4. Nothing in this agreement shall be construed to cause the relocation of any part of the currently existing stone and ornamental iron fence owned by the Star Trail HOA in this area. Sincerely, Wm.
