Consider and act upon the minutes from the October 22, 2024, Town Council Work Session meeting. (MLS) Agenda Item 3. Consider and act upon authorizing the Town Manager to execute a Professional Services Agreement between GEOTEX Engineering, and the Town of Prosper, Texas, related to construction materials testing for Fire Station 4 with a cost not to exceed $78,787. Consider and act upon authorizing the Town Manager to execute an agreement with DAC, Inc. to upgrade fire and security systems for Fire Station No. 3 for $67,904. (CE) Agenda Item 17. Consider and act upon approving the renewal of an Enterprise License Agreement for term license software between Environmental Systems Research Institute, Inc., a sole source provider, and the Town of Prosper, Texas; and authorizing the Town Manager to execute an agreement for $142,029. Consider and act upon whether to direct staff to submit a written notice of appeals on behalf of the Town Council to the Development Services Department, pursuant to Chapter 4, Section 1.5(C)(7) and 1.6(B)(7) of the Town’s Zoning Ordinance, regarding action taken by the Planning & Zoning Commission on Preliminary Site Plans and Site Plans. (DH) Information Purpose: •Construct an 11,735 square foot medical office/retail building and associated parking. •Medical Office (3,114 SF) •Retail (8,621 SF) Citizen Comments Regular Agenda Pursuant to Section 551.007 of the Texas Government Code, individuals wishing to address the Council for items listed as public hearings will be recognized when the public hearing is opened. Agenda Item 19. Consider an appeal to the requirements of the Town of Prosper Fence Regulations permitting alternate fence materials at 980 English Ivy. (CE) Appeal to Fence Material Requirements •Property at 980 English Ivy has mesh/other screening over ornamental fencing •Fence Regulations prohibit placement of material over open fencing that does not maintain over 50 percent through vision. •Subdivision Ordinance prohibits any material be placed parallel to ornamental fencing. •Fence Regulations permit an appeal to the Town Manager, then to Town Council if denied, to allow alternate materials Appeal to Fence Material Requirements •Notice Sent March 2023 •Appeal to Town Manager submitted April 14, 2023 •Appeal denied effective December 4, 2023 Appeal to Fence Material Requirements Agenda Item 20. Consider and act upon authorizing the Town Manager to enter into a second contract amendment with Republic Services to convert to once-a-week residential bulk pick-up and to approve a revised fee schedule effective February 1, 2025, adjusting commercial and residential prices for the twelve-month CPI change. (CL) Solid Waste Contract Amendment # 2 Increasing Frequency of Bulk Pick Up to Weekly Minor Contract Adjustments Annual Price Adjustment Solid Waste Contract Price Change •In June 2023, Republic Services was awarded an exclusive franchise for all solid waste related services following a competitive RFP process •Effective date was February 1, 2024 with provision for annual rate adjustments on each contract anniversary date. •The adjustment is based on the 12 month change in CPI-All Urban Consumers for the “Garbage and Trash Collection” sub-category •The September 2023 to September 2024 change in this index is 3.8% •This percentage will be applied to all residential and commercial service categories Solid Waste Contract Price Change •For base residential services this will increase the 2024 monthly rate from $18.55 to $19.15 for 2025. •Both 2024 and 2025 rates include a $2.00 cart repayment fee and a $0.80 Town administrative fee. The CPI adjustment is applied only to the Republic charges. Service Enhancement for 2025 •While the transition to the new provider has substantially reduced Solid Waste related complaints for both residential and commercial customer categories, there continues to be confusion regarding which week each month, a neighborhood’s bulk is picked up. •To address this area, the Town requested a quote from Republic for weekly bulk pick-up on the same day as all other services and received the following: •Weekly bulk pick-up with no Saturday drop-off service offered or one-time box pick up for new move-ins- $1.98 over currently quoted prices or a total of $21.13 base charge. •Weekly bulk pick-up while continuing Saturday drop-off service and box pick up-$3.20 over currently quoted prices or a total of $22.35 base charge. Council Direction •At the October 22, 2024 work session Council provided the following direction: •Annual CPI adjustment effective February 1, 2025 should be brought back for approval November 12, 2024. •Council chose weekly bulk with no reduction in other services which will also be approved as a contract amendment November 12th effective February 1, 2025. •Certain “housekeeping” clean up item naming September CPI as the month used for pricing adjustments and raising replacement carts from current $25 to $60 (Town’s cost is $55) should also be added. Benchmark City Comparison Agenda Item 21. Discuss and consider Town Council Subcommittee reports. (DFB) Possibly direct Town Staff to schedule topic(s) for discussion at a future meeting. Section 551.071 - To consult with the Town Attorney regarding legal issues associated with code enforcement activities and substandard structures, law enforcement activities, and all matters incident and related thereto. Section 551.071 - To consult with the Town Attorney regarding legal issues associated with Article 3.19 of the Code of Ordinances, and all matters incident and related thereto. The Town Council will reconvene after Executive Session. Reconvene into Regular Session and take any action necessary as a result of the Closed Session. Adjourn.
