ORDINANCE NO. 2024-27
AN ORDINANCE OF THE TOWN COUNCIL OF THE TOWN OF PROSPER,
TEXAS, CHANGING THE NAME OF A NORTH -SOUTH SEGMENT OF FIRST
STREET IN THE TOWN OF PROSPER TO "WILDCAT WAY" AND CHANGING
THE NAME OF AN EAST -WEST SEGMENT OF FIRST STREET TO "WEAR
CEMETERY LANE"; PROVIDING FOR REPEALING, SAVINGS, AND
SEVERABILITY CLAUSES; PROVIDING FOR AN EFFECTIVE DATE OF THIS
ORDINANCE; AND PROVIDING FOR THE PUBLICATION OF THE CAPTION
HEREOF.
WHEREAS, the Town of Prosper, Texas (the "Town"), has reconstructed and realigned a
portion of First Street, between Coit Road and Custer Road, and as a consequence, there is a
portion of former First Street that no longer is considered a part of First Street, as depicted in
Exhibit 1, attached hereto and incorporated by reference; and
WHEREAS, due to such reconstruction and realignment of First Street, the Town wishes
to rename the north -south segment of former First Street as "Wildcat Way" and the east -west
segment of former First Street as "Wear Cemetery Lane", all as depicted in attached Exhibit A.
NOW, THEREFORE, BE IT ORDAINED BY THE TOWN COUNCIL OF THE TOWN OF
PROSPER, TEXAS, THAT:
SECTION 1
The findings set forth above are incorporated into the body of this Ordinance as if fully set
forth herein.
SECTION 2
From and after the effective date of this Ordinance, the Town hereby renames the north -
south segment of former First Street as "Wildcat Way" and the east -west segment of former First
Street as "Wear Cemetery Lane".
SECTION 3
The Town Manager is hereby charged with notifying any and all public agencies, property
owners and others of the foregoing name changes and to take any and all necessary steps and
acts to effect immediately such name changes. The Town Manager is also further authorized to
make all appropriate revisions to street signage and Town maps and take all other necessary
actions incident and related thereto.
SECTION 4
All provisions of any ordinance in conflict with this Ordinance are hereby repealed to the
extent they are in conflict. Any remaining portion of conflicting ordinances shall remain in full force
and effect.
SECTION 5
If any section, subsection, sentence, clause or phrase of this Ordinance is for any reason
held to be unconstitutional or invalid by a court of competent jurisdiction, such decision shall not
affect the validity of the remaining portions of this Ordinance. The Town of Prosper hereby
declares that it would have passed this Ordinance, and each section, subsection, clause or phrase
thereof, irrespective of the fact that any one or more sections, subsections, sentences, clauses,
and phrases be declared unconstitutional.
SECTION 6
This Ordinance shall take effect and be in full force from and after its passage and
publication, as provided by the Revised Civil Statutes of the State of Texas.
