First Street, Prosper, Texas A Place Where Everyone Matters Tuesday, May 23, 2023 Call to Order/ Roll Call. The meeting was called to order at 6:15 p.m. Council Members Present: Mayor David F. John Fowler with First Presbyterian Church led the invocation. The Pledge of Allegiance and the Pledge to the Texas Flag were recited. Announcements of recent and upcominq events. Councilmember Kern made the following announcements: Residents are invited to attend a Broadband Public Input meeting on Thursday, May 25 from 5:30 to 7:00 p.m. in the Council Chambers of Town Hall. This meeting aims to gather input from Prosper residents regarding the available internet services in their community. More information is available on the homepage of the Town's website under the News & Updates section. Page 1 of 5 The Library's Summer Reading Program kicks off on Wednesday, May 30. Children may sign up anytime in June for the reading challenge. Additional information can be found by visiting the Library page through the Town's website and clicking on the 2023 Summer Program icon. Come join the excitement as Prosper gears up for the second annual P-Town Throwdown. This fun -filled family -oriented pickleball tournament will be held at Reynolds Middle School tennis courts on June 3. Visit prospertx.gov/parksandrec to register by Wednesday, May 31. Registration is open for the Citizens Fire Academy. Classes will run for 10 weeks and will take place every Thursday evening from 6:30 to 9:00 p.m. starting Thursday, August 3. Residents may register by visiting the Fire Department page through the Town's website and viewing the Citizens Fire Academy page. Deadline to register is July 13 with limited space available. Residents are encouraged to take a survey regarding the Town's ADA Transition Plan as the Town is reviewing accessibility, safety, and suggestions for improvements in the Town. The survey may be taken by visiting prospertx.gov/adasurvey. Mayor Bristol read a Proclamation issued by the Collin County Judge recognizing Public Works Week in Collin County. Presentations. 1. Administer Oaths of Office to re-elected Councilmembers and present Certificates of Election. (MLS) Ms. Lewis Sirianni administered the Oaths of Office to re-elected Councilmembers Amy Bartley and Jeff Hodges. Mayor Bristol presented their Certificates of Election. CONSENT AGENDA: Items placed on the Consent Agenda are considered routine in nature and non -controversial. The Consent Agenda can be acted upon in one motion. Items may be removed from the Consent Agenda at the request of Council Members or staff. 3. Consider and act upon the minutes from the May 9, 2023, Town Council Regular meeting. (MLS) 4. Consider and act upon the minutes from the May 16, 2023, Town Council Special meeting. (MLS) 5. Consider and act upon approving a contract with Weatherproofing Services utilizing the Interlocal Purchasing System (TIPS) for the renovation of the Town Hall water feature; and authorizing the Town Manager to execute documents for the same. (CE) 6. Consider and act upon Ordinance 2023-37 to amend 168± acres Planned Development-40 (PD-40) for Residential Use (Phases 7F and 7G) regarding building materials, located on the northside of First Street and west of Windsong Parkway. (ZONE-23-0006) (DS) 7. Consider and act upon authorizing the Town Manager to execute a Third Amendment to Development Agreement between VP Windsong Operations LLP, VP Windsong Investments LLP and the Town of Prosper relative to Page 2 of 5 Windsong Ranch, as described in Planned Development 40 (PD-40) (DEVAGREE-23-0004) (DS) 8. Consider and act upon Ordinance 2023-38 to rezone 13.3± acres from Single Family-15 (SF-15)to Planned Development -Retail (PD-R), generally to allow for an office/retail development, located on the east side of Preston Road, north of St. Peter Lane. (Z21-0003). (DS) 9. Consider and act upon authorizing the Town Manager to execute a Development Agreement between MQ Development Partners and the Town of Prosper, related to the MQ Prosper North Development, located on the east side of Preston Road, north of St. Peter Lane. (DEVAGRE-23-0007) (DS) Councilmember Ray requested to pull item 5. Mayor Pro-Tem Hodges made a motion to approve items 2 through 4 and 6 through 9. Deputy Mayor Pro-Tem Andres seconded that motion, and the motion was unanimously approved. Councilmember Ray expressed his concerns with the costs associated with item 5 and requested for the consideration of staff to revisit the item. Mr. Ewings described the work associated with the renovation and reasoning for associated costs. The Town Council discussed the history of the project leading up to the proposed contract for consideration. Councilmember Ray made a motion to deny a contract with Weatherproofing Services utilizing the Interlocal Purchasing System (TIPS) for the renovation of the Town Hall water feature. Further discussion was had by Council. Motion dies due to lack of second. Councilmember Ray amended his motion to table a contract with Weatherproofing Services utilizing the Interlocal Purchasing System (TIPS) for the renovation of the Town Hall water feature. Councilmember Bartley seconded the motion. Motion carried with a 6-0 vote. CITIZEN COMMENTS No comments were made. Items for Individual Consideration: 10. Discuss and consider making appointments to the Council Subcommittees. (MLS) Ms. Lewis Sirianni presented a list of the current Town Council's Subcommittees with an opportunity for the Town Council to make any changes to each subcommittee. No changes were made. Page 3 of 5 11. Discuss and consider Town Council Subcommittee reports. (DB) Mayor Bristol provided an overview of the recent Finance Subcommittee meeting that included a budget update and discussion regarding the Town's Fleet Management contract. 12. Discussion regarding a review of activities and services of Town Council and staff from May 2022 to May 2023. (DB/MC) Mayor Bristol provided highlights from the Town Council over the last year since taking office as a recap of some key accomplishments. Possibly direct Town staff to schedule topic(s) for discussion at a future meeting. Councilmember Bartley requested staff to examine the intersection at Star Trail and Star Meadow Drive due to numerous reports of safety concerns and if a barrier of some kind could be installed. Councilmember Kern requested an update regarding the road construction project on First Street, east of Coit Road until August. EXECUTIVE SESSION: Recess into Closed Session in compliance with Section 551.001 et seq. Texas Government Code, as authorized by the Texas Open Meetings Act, to deliberate regarding: Section 551.087 — To discuss and consider economic development incentives and all matters incident and related thereto. Section 551.072 — To discuss and consider purchase, exchange, lease or value of real property for municipal purposes and all matters incident and related thereto. Section 551.074 — To discuss and consider personnel matters and all matters incident and related thereto. Section 551.074 - To deliberate the appointment of Mayor Pro-Tem and Deputy Mayor Pro-Tem. Section 551.074 - To discuss appointments to the Board of Adjustment/Construction Board of Appeals, Parks & Recreation Board, Library Board, Prosper Economic Development Corporation Board, Planning & Zoning Commission, Community Engagement Committee, the Comprehensive Plan Advisory Committee, and all matters incident and related thereto. Section 551.076 — To deliberate the deployment or specific occasions for implementation of security personnel or devices at Town Hall. The Town Council recessed into Executive Session at 7:01 p.m. Reconvene in Regular Session and take any action necessary as a result of the Closed Session. The Town Council reconvened into Regular Session at 8:49 p.m. Mayor Pro-Tem Hodges made a motion to appoint Glen Blanscet to the Planning and Zoning Commission. Councilmember Bartley seconded the motion. Motion carried with a 6-0 vote. Page 4 of 5 Mayor Pro-Tem Hodges made a motion to nominate Craig Andres as Mayor Pro -Tern and Marcus Ray as Deputy Mayor Pro-Tem. Councilmember Kern seconded the motion.
