Council present included: Mayor Ray Smith, Mayor Pro-Tem Kenneth Dugger, Deputy Mayor Pro-Tem Meigs
Miller, Dave Benefield, David Vestal, Danny Wilson, and Jason Dixon.
Staff present included: Mike Land, Town Manager; Hulon Webb, Director of Development Services; Chris
Copple, Senior Planner; Matthew Garrett, Finance Director; Ronnie Tucker, Fire Chief, and Matthew Denton,

2. Invocation and Pledge of Allegiance.
The Invocation was given by Reverend Michael Gilton, St. Paul's Episcopal Church of Prosper.
Mayor Smith led the Pledge of Allegiance.
3. Announcements of dates and times of upcoming community events.
Mike Land, Town Manager, announced National Night out on October 6, 2010 and Community Worship on
August 22, 2010 at 6:00 p.m. at Prosper High School.
Mike Land also announced The Boyer Park ribbon cutting with be August 20, 2010 at 9 a.m.

items a, b, d, and e.

C. Consider and act upon 1) awarding the bid for Prosper Road Improvement Project 2010 Frontier
Parkway, Talon Drive to North Dallas Toll Road in the amount of $351,400.00 to Quality
Excavation, LTD, 2) enter into a contract agreement with Quality Excavation, LTD, regarding the
construction services for Prosper Road Improvement Project 2010 Frontier Parkway, Talon Drive
to North Dallas Toll Road and 3) approve a resolution authorizing the Town Manager to execute
the same. (FJ)
Motioned by Councilmember Dixon, seconded by Councilmember Vestal to approve item 4c.

Mike Land, Town Manager, submitted the FY2010-2011 Budget and Budget Message to the council.
7. Consider and act upon a schedule for public hearings on the FY 2010-2011 Budget. (ML)
Mike Land, Town Manager, gave council background information on this item.
Motioned by Deputy Mayo Pro-Tem Miller, seconded by Councilmember Vestal to schedule one public
hearing on the FY 2010-2011 Budget on August 24, 2010 at 6:00 p.m. during the regularly scheduled Town
Council meeting.
Motion approved 7-0.
8. Consider and act upon a proposed 2010 property tax rate. (ML)
Mike Land, Town Manager, gave council background information on this item.
Motioned by Mayor Pro-Tem Dugger, seconded by Deputy Mayor Pro-Tem Miller to propose a 2010 tax rate of
$0.52 per $100 valuation, which is 0.6995 cents lower than the effective rate and 1.6003 cents lower than the
rollback rate.

9. Consider and act upon a schedule for public hearings on the proposed 2010 tax rate. (ML)

Motioned by Councilmember Vestal, seconded by Mayor Pro-Tem Dugger to schedule one public hearing
regarding the tax rate for August 24, 2010 during the regularly scheduled Town Council meeting.
Motion approved 7-0.
10. Consider and act upon a bad debt write off policy for EMS billing. (RT)
Ronnie Tucker, Fire Chief, gave council background information on this item.
Rob Ervin, Southwest General, answered questions for council. ,f,il11111111111"!
Motioned by Councilmember Dixon to direct mike land review and evaluate the current contract and current
contract with Southwest General as it relates to unpaid services during the first 12 months and after 12 months.
The motion was withdrawn by Councilmember Dixon.
Motioned by Mayor Pro-Tem Dugger, seconded by Councilmember Vestal to table item 10.
Motion approved 7-0.
11. Possibly direct Town Staff to schedule topic(s) for discussion at a future meeting.
Councilmember Dixon requested an item regarding Section 8 housing be on a future council agenda.
12. Adjourn.
Motioned by Mayor Pro-Tem Dugger, seconded by Councilmember Wilson to adjourn.
Motion approved 7-0.

Agenda Item:
A public hearing to consider and act upon an amendment to Chapter 4, Section 9.4 (D) of the
Zoning Ordinance, regarding the side yard setback of the face of a garage that faces a side yard (a
swing -in garage). (Z10-0013).
Description of Agenda Item:
Currently, the Zoning Ordinance requires the face (meaning garage door) of a garage that faces a
side yard (a swing -in garage) to be setback twenty-eight feet (28') from the side property line.
Town staff believes the intent of the requirement is to allow for a twenty foot (20') parking
space/maneuvering area between the face of the garage and the side property line. In the past
several months, the Inspections Division has received several building permit requests for a house
with a swing -in garage where the face of the garage is setback a few feet less than twenty-eight
feet (28'). Upon further review by Town staff, the face of the garage door only needs to be setback
a minimum of twenty-four feet (24') to allow for a twenty foot (20') parking space/maneuvering area
and a drainage swale between the face of the garage and the side property line. Therefore, Town
staff has drafted an amendment to the Zoning Ordinance to reduce the requirement from twenty-
eight feet (28') to a minimum of twenty-four feet (24').
Budget Impact:
There are no significant budget implications associated with the approval of this amendment to the
Zoning Ordinance.
Legal Obligations and Review:
Town staff has notified the public hearing as required by state law.

Currently, the Zoning Ordinance prohibits a non-commercial antenna from exceeding 45 feet in
height. The antenna being installed behind Town Hall to serve the Town's Dispatch Center is
approximately 50 feet in height. Town staff has drafted an amendment to the Zoning Ordinance,
which would exclude a non-commercial antenna located on property owned by the Town of
Prosper from the 45 foot height requirement. The amendment will alleviate any conflict between
the height of the Town's non-commercial antennas and the Town's Zoning Ordinance.
Budget Impact:
There are no significant budget implications associated with the approval of this amendment to the
Zoning Ordinance.

a) Satellite Dishes and Wireless Broadband Antennas
1. In the A, SF, DTSF, 2F, and MH districts, satellite dishes and wireless broadband
antennas are permitted only on the back half of a residential structure or in the back
yard of a residential lot unless a signal cannot be received in these areas. Should a
satellite dish or wireless broadband antenna be placed somewhere other than on the
back half of a residential structure or in the back yard of a residential lot, it shall be
limited to not more than two (2) feet in diameter. Only three (3) satellite dishes and/or
wireless broadband antennas shall be permitted per lot or primary structure. One (1) of
the three (3) satellite dishes and/or wireless broadband antennas on a residential
structure and/or lot may be up to twelve (12) feet in diameter. The other two (2) satellite
dishes and/or wireless broadband antennas shall not exceed two (2) feet in diameter.
2. In the TH and MF districts, satellite dishes and wireless broadband antennas are
permitted only on the back half of a residential structure or in the back yard of a
residential lot unless a signal cannot be received in these areas. Should a satellite dish
or wireless broadband antenna be placed somewhere other than on the back half of a
residential structure or in the back yard of a residential lot, it shall be limited to not more
than two (2) feet in diameter. Only three (3) satellite dishes and/or wireless broadband
antennas shall be permitted per residential unit. One (1) of the three (3) satellite dishes
and/or wireless broadband antennas on a residential unit may be up to twelve (12) feet
in diameter. The other two (2) satellite dishes and/or wireless broadband antennas
shall not exceed two (2) feet in diameter.
b) Non-commercial antennas shall not interfere with radio or television reception of adjoining
property owners, and shall comply with all regulations of the Federal Communications
Commission (FCC). In no case shall the height of such antennas exceed forty-five (45)
feet, unless located on property owned or leased by the Town of Prosper, and proper guy
wire securement shall be followed. In no manner shall the use of such equipment infringe
upon adjoining property owners. Roof mounted satellite dishes in excess of fifty (50)
pounds shall be approved by a registered architect or professional engineer by written letter
to the building official, prior to installation, stating the antenna's stability and support and
shall not extend more than six (6) feet above the first story.
Chapter 3. Section 2.2 (paragraph 9)
Antenna, Non -Commercial - An antenna and its support structure not exceeding forty-five (45)
feet in height above the ground elevation at the base of the support structure, unless located on
property owned or leased by the Town of Prosper, designed for transmitting or receiving any
portion of the radio, microwave, or electromagnetic spectrum. This definition shall also include a
satellite dish antenna not to exceed twelve (12) feet in diameter.

Following the Budget Proposal by the Town Manager
during our August 10th meeting, the Town Council
approved a proposal to consider a tax rate equal to $0.52
cents per $100 dollars of taxable appraised value.
This is the first and only scheduled public hearing to
discuss the proposed tax rate. Given that the current
and proposed rate is less than the effective and rollback
rates, additional costly public notices and multiple
meetings were avoidable this year.
The Town Council will vote on both the proposed budget

Presentation by Mike Simpson, Executive Director of the Arts of Collin County and consideration
and action on the Town of Prosper becoming a member city.
Description of Agenda Item:
Mayor Simpson will be making a presentation on the status of the Arts of Collin County
Performing Arts Center and is requesting that the Town of Prosper become a member
community. I recommend that the Council go to www.artsofcollincountv.org to find out more
about the organization, the financial reports of the organization and view their various slide
presentations on the project.
Member communities currently are Allen, Frisco, Melissa, Fairview, and Plano. Mayor Simpson
recently made a presentation to both Prosper and Celina Mayors thus leading to this
presentation Tuesday night.
The attached documents provided by Mayor Simpson detail membership benefits and projected
costs to the Town.
Budget Impact:
The estimated budget presentation from Mayor Simpson includes two scenarios, the cost to
Prosper with or without Celina's participation. The costs are estimated based on a per capita
factor using population figures provided by the NCTCOG.
For example this year's cost (2010-2011 budget year) without Celina's participation is estimated
to be $7,937.65, with Celina's participation it would be $7,856.24 Projecting out to the 2012-
2013 our costs participation could grow to approximately $30,000.00.

the 2010 Town of Prosper Employee Compensation Analysis.
Description of Agenda Item:
On April 13, 2010, Town Council engaged Public Sector Personnel Consultants ("PSPC") to
perform a comprehensive compensation analysis. It has multiple phases and includes a
compensation analysis, plan implementation and evaluation system design. PSPC began with
interviewing the leadership team, meeting and interviewing employees and a thorough review of
current job descriptions. In reviewing certain position duties and its job description, it was found
that several positions required some reclassification to be matched up correctly in the
marketplace.
On May 11, 2010, Town Council approved a list of comparator municipalities to be considered
during the study. From these comparators, survey data reflected that Town salaries were less
competitive than the market. On average, each position level was below the market as follows:
Front Line positions at 9.5% below, Supervisor positions at 8.5% below and Executive positions
at 11.7% below.
On June 22, 2010, Town Council passed a resolution setting the target base salary range
assignments at 100% of the comparator market. That is, the midpoints for Town salary ranges
should match the midpoints of the market average ranges. This very common strategy neither
leads nor lags the market, but rather elects to set pay at the market 50t' percentile. To be put
succinctly, we have adopted a median competitive pay strategy. The recommendation to
implement the strategy has several steps.
First, bring all employees up to the minimum salary for their respective pay ranges at a cost of
$108,000 net of benefit costs. Second, employees already in the range require some
adjustment to be more competitive for two reasons. Compression exists when employees with
differences in years of experience are too closely compensated. Additionally, an employee who
was already at the midpoint of the Town's pay structure would "lose ground" if no adjustment
were made beyond minimums. In range adjustments are proposed by PSPC and would cost
$55,500 net of benefit costs under the scenario assumed by staff of 0.25% per Y2 year of
service. More options and study details can be found in the attached report.
During this meeting, PSPC will be seeking input from the Town Council on an incentive/merit
pay system. The Town's ODP team is finalizing the performance evaluation process for review.

Budoet Impact:
As Proposed, the Fiscal Year 2010- 2011 Budget included a phased -in implementation with half
the increase occurring October 2, 2010 and the other half effective April 2, 2011. The additional
cost to implement the full increases on October 2, 2010 would add approximately $50,000 to the
General Fund appropriations budget.

1. EXECUTIVE SUMMARY
It is with substantial pleasure that we present this report describing the recommended FY 2010-11 Salary
Plan for the Town of Prosper, hereinafter "the Town."
A. SUMMARY OF FINDINGS
1. The Town Is a competitive employer (greater than or within 5% of the prevailing rates) for 34%
of its thirty-five (35) current salary survey benchmark job classes in comparison to the Council -
approved comparator employers Table 1, page 7).
2. The Town Is not a competitive employer (-5% or more below the prevailing rates) for 66% of its
salary survey benchmark job classes in comparison to the Council -approved comparator
employers able 1, page 7).
3. When salary ranges are proposed at the average of the market ("100% of market" or 50t'
percentile), the current salaries of 45 employees are below the Minimum of the salary range for
their position, for a cost of $107,776 (3.36% of payroll) to bring them to Minimum.
4. The Town's current General Employee Pay Schedule has a uniform 10% between pay ranges,
and varying amounts between Minimum and Maximum ranging from 40% to 48% (page 8).
B. SUMMARY OF RECOMMENDATIONS
Utilize the recommended Permanent Salary Range Table which has a uniform 2.5% between
sequential Midpoints, and within range salary opportunity of 35% from Minimum to Maximum
(page 9).
2. Adopt the proposed IY 2010-2011 salary ranges according to one or more of the following
combinations of scenarios:
• Adopt the FY 2010-2011 base salary range assignments utilizing a market -based and
Council -recommended approach at 100% of market (also "market average" or "50t'
percentile") (Tables 2 and 3, pages 11 and 12), or alternatively adopt the base salary range
assignments at 95% (or 5% below market), illustrated in appendix II.
• Bring the salaries of all employees to the Minimum of the approved / adopted salary range for
their position's job class on the plan's effective date (page 14).
• Make additional in -range adjustments to employee salaries on the plan's effective date to
alleviate compression and ensure salary range penetration based on performance and tenure,
using one of the scenarios or variation thereof illustrated on pages 10 and 11.
3. Develop and implement a comprehensive program and materials to communicate the Town's
updated FY 2010-11 salary plan to staff.

2. EXTERNAL COMPETITIVENESS COMPARISONS
The following paragraphs and tables compare the Town's current salary structure (salary range Mldpoint)
to those for similar occupations at public and private employers with whom the Town competes to obtain
and retain high quality staff. The following Items highlight key factors about our approach to salary
surveys.
• Competitors are those employers, both public and private, with whom the Town competes to
obtain and retain employees
• Occupations are being compared, not employees
• Structural comparison — comparator employers' salary range Midpoint to the Town's calculated
Midpoint in its current grade and step salary plans
• Comparisons or job matches were made on a detailed and cautious analysis based on the scope
of duties and areas of responsibility as well, rather than job title matching
• Salary survey results do not suggest that employees are under or overpaid, and are used as a
guide in salary plan development

B. DATA PROJECTION
We factored or "aged" the external data from all sources forward from their effective date to the
common date of October 1, 2010 which Is the beginning of the Town's FY 2010-11 salary plan year,
by the annual prevailing rate increase (PRI) factor of 1.5%, as reported by World at Work, formerly the
American Compensation Association.
C. SALARY RANGE MIDPOINT COMPARISON
We utilized a standard "structure -to -structure" method to compare the Town's salary structures to the
prevailing rates. The Town's salary structures and the prevailing rates are represented by their
Midpoints, which are the amounts employers pay for sustained competent job performance.
The Midpoint is the most objective, occupation -specific and consistent component of salary structures
among employers, as the varying widths of salary ranges are too great to utilize Minimum or
Maximum. Midpoint is not affected by actual salary averages which may reflect longevity, pay -for -
performance, and a myriad of subjective salary plan administration characteristics of the comparator
employers. When individual salary plans were comprised of steps, the beginning and ending steps
were added and the sum divided by two (2) to calculate a true midpoint.

There is no such thing as a "perfect" job match in a salary survey. Some comparator matches are
more or less complex than the Town's benchmark jobs, and may or may not fall at the same relative
level in the comparators' organization. Imperfect job matches were adjusted by (+/- 15%).
We recommend that the Town utilize the above referenced prevalling rate comparisons for the
following reasons.
• Provides the largest sample of job classes for the most reliable comparisons
• Focuses on the employers most like the Town in scope and type of services
• Contains the most specialized jobs found primarily in school Towns
• Reflects a high correlation to the local/regional municipal rates
• Increases level of understanding by the employees of the comparison process
E. EXTERNAL PREVAILING RATES COMPARISON
Table 1, which follows on page 7, summarizes the comparison of the Town's current salary structure
midpoints for the 35 existing benchmark job classes, to the prevailing rates of all the comparator
employers from all the salary survey sources. For clarity, the benchmarks have been grouped into
three categories: front line, supervisors and executive benchmarks.

3. RECOMMENDED SALARY RANGE STRUCTURE
The Town's current General Employee Pay Schedule has a uniform 10% between pay ranges, and
varying amounts between Minimum and Maximum ranging from 40% to 48%.
A. RECOMMENDED SINGLE SALARY TABLE STRUCTURE
The recommended Permanent Salary Range Table, on page 9, provides equal in -range salary
opportunity of 35% from Minimum to Maximum. The salary ranges are separated by a uniform 2.5%,
permitting Job classes to be precisely linked to the external prevailing rates, the Town's salary
competitiveness policy, and internal job relationships, through their Midpoints.
The Table's 91 ranges exceed the dollar ranges required to encompass the FY 2010-11 prevailing
rates, permitting the plan to be updated in future years to accommodate the anticipated increases in
the prevailing rates. Additional salary ranges may be added.
B. ANNUAL SALARY RANGE ADJUSTMENTS
Job classes are individually reassigned to different salary ranges on an annual basis to reflect the
varying movement in the external prevailing rate (if any) for each job class. The Permanent Salary
Range Table should not be adjusted by blanket percentages or flat dollar amounts, as that will
adversely impact the Town's external competitiveness and the internal equity of the salary plan.
The Town will be provided with the tools and training necessary to update salary survey data and
make informed and accurate salary range determinations based on the prevailing rate movement of
benchmark jobs. Page 14 provides additional details about the steps required to make annual salary
range adjustments.

4. RECOMMENDED FY 2010-11 BASE SALARY PLAN
The following narratives and tables describe the recommended FY 2010-11 salary plan for the Town and
its estimated fiscal impact.
A. ASSIGNMENT OF JOB CLASSES TO SALARY RANGES
Tables 2 and 3, on the following pages are the recommended FY 2010-11 salary ranges for each of
the Town's job classes in occupational group order able 2 and salary range order able 3).
Benchmark job classes (indicated by an asterisk) were placed as close to the prevailing rates for
comparable job classes as was practical, by matching the Town's salary range Midpoints to the survey
benchmark rates.
We utilized our professional judgment to prevent illogical relationships that could result from survey
data directly linked into salary ranges, as there is no automatic logical job content relationship among
survey data collected from various employers. Non -benchmark job classes were linked to benchmark
job classes by professional judgment, as detailed in Tables 2 and 3,
B. ESTIMATED FISCAL IMPACT OF THE RECOMMENDED SALARY PLAN
The current salaries of 45 employees are below the Minimum of the salary range for their position for
a cost of $107,776 (3.36% of payroll) to bring them to Minimum.
Additional in -range adjustments should also be considered to alleviate compression and ensure range
penetration for journey -level staff members, using the illustrations on 16 as a possible template.
C. COMPENSATION COMPETITIVENESS POLICY
For long term planning and goal -setting, and as part of the annual budget process, the Town should
consider adopting a compensation policy or philosophy to maintain the Town's pay ranges at an
established level of competitiveness in. relation to the market prevailing rates. Factors that drive
approaches to compensation include staffing levels, demand for municipal services, performance
levels of staff, portability of staff (turnover risk), and levels of local competition for skilled staff. A policy
that maintains the Town's pay ranges at 100% of market average, would ensure the competitiveness
and equity of the Town's compensation plan.
D. ANNUAL PLAN UPDATE STEPS
1. Obtain latest comparator employers' salary plans and Economic Research Institute salary surveys
to Compute the prevailing rate for each of the benchmark job classes.
2. Re -assign the benchmark job classes to the salary ranges whose Midpoints most closely match
the prevailing rates, and adjust non -benchmarks by similar amounts according to Table 4.
3. Compute the total amount of dollars, and percentage of current payroll, required to bring all
employees to the Minimum of their new salary range, if any.
4. Provide information to the Town Manager and Council for budgeting purposes.
5. Bring all salaries up to Minimum and/or maintain achieved pay range penetration on the updated
plan's effective date (see page 14 for additional details on range penetration).

5. INITIAL IMPLEMENTATION AND ONGOING SALARY ADMINISTRATION
Initial implementation of the Town's updated salary plan for FY 2010-11 will be controlled by the Town's
financial resources, and therefore balanced between the Council's desire to place its salary structure for
all employees at the prevailing rates for their occupations and available funds. Detailed procedures for the
administration and update of the Town's salary plan are contained in the separately provided PSPC Salary
Administration Procedure Guide. Following are several key salary plan implementation and maintenance
procedures.
A. SALARIES BELOW MINIMUM
We recommend that the salaries of all employees whose current amount is less than the Minimum of
the salary range for their position's job class be increased to that Minimum amount on the effective
date of the updated salary plan.
B. ADDITIONAL IN -RANGE ADJUSTMENTS: COMPRESSION AND RANGE PENETRATION
There may be multiple -position job classes whose salary ranges were significantly increased to reflect
the current competitive prevailing rates. This action may result in salary adjustments to range
Minimum of a number of incumbents, placing the salary amounts of newly -hired or shorter tenure
employees at the same rate or close to the salary rates of individuals with significantly more years of
Town service. Optional "tempering" scales follow.
Option 1: Re-create historical "range penetration" by adjusting individual salaries by the same amount
or percentage as their pay range is adjusted for market influence. For example, an employee at
Midpoint in the Town's current pay range plan would stay. at Midpoint within the newly proposed pay
range In the new plan. The estimated cost (after adjustments to Minimum) to maintain historical range
penetration for all staff at 100% of the market is $173,884 and the cost at 95% of market Is $114,220.

C. CONTINUED MAINTENANCE OF COMPETITIVENESS
Upon adoption of an FY 2011 Salary Plan, the Town will have established an overall market
competitiveness position (for example at the 50"' percentile). Presumably, market values for various
jobs will grow in future years. By conducting annual or biennial salary surveys, the Town will be able to
identify and maintain or target 5&, 60t', and 70"' percentile goals for market competitiveness.

6. EMPLOYER -PAID BENEFITS
In addition to base salary data, we also collected select benefits information from the same comparator
agencies listed on page 2. A detailed breakdown of the benefits surveyed, and the benefits provided by
each comparator, appears in Appendix I.
A. FINDINGS FROM BENEFITS SURVEY
1. The Town provides a less than average medical premium contribution compared to other
agencies; this in part is contributed to a lower total premium for employee plus family coverage.
Comparator agencies are paying an average of nearly 60% of the employee plus family medical
premium, while the Town pays 30% of the employee plus family medical premium.
2. The Town is providing a better than average number of vacation leave hours at all tenure
milestones. Most agencies provide 2 weeks paid vacation for employees with one year or less of
service, while the Town provides 3 weeks paid vacation leave. At 5 years of service, the Town
provides 4 weeks paid vacation leave while the average comparator provides 3 weeks paid
vacation leave.
3. Several agencies indicated they pay an Incentive or premium for employees with Associate or
Bachelor Degrees. This may indicate that the minimum qualifications for some comparator jobs
do not require but merely prefer advanced education.
4. Nearly all comparators provide Certification Pay for TCLEOSE Intermediate, Advanced, and
Master Police certifications, as well as for Intermediate, Advanced, and Master Fire certifications.
Some comparators also provide certification pay incentives for utillty-related certifications, while
others require certifications as part of their job. classifications.
B. RECOMMENDATIONS FROM BENEFITS SURVEY
1. Utilize the certification pay findings to identify incentives for Fire, Police, and Utility personnel that
would result in the Town's ability to provide a higher level of service. Identify those certifications
that should be minimum qualifications on the Town's job descriptions as well as "value added"
certifications that result in the Town's ability to deliver a higher level of service.
