Webb, Jr., P.E., Director of Development Services/Town Engineer Re: Town Council Meeting —June 1, 2010 Date: May 26, 2010 Agenda Items: Consider and act upon the 2010 Denton County Annexation Agreements and Involuntary Annexation Ordinances. History: On March 9, 2010, the Town Council called two public hearings to be held on April 27, 2010 and May 11, 2010 to consider the 2010 Denton County Involuntary Annexations, per the approved involuntary annexation schedule. Both public hearings have been held per state law. Description of Agenda Items: Items 02-13 are two annexation agreements signed by property owners in Denton County, who have an agricultural use on the property and have agreed to the conditions of the Annexation Agreement, and ten annexation ordinances, which will annex in approximately 1,384.9 acres from Denton County into the Town of Prosper. Budget Impact: Annexing in approximately 1,384.9 acres from Denton County into the Town of Prosper will increase the amount of property the Town receives ad valorem taxes from, which will increase revenue, but it will also increase the amount of property the Town must provide services to. Legal Obligations and Review: The Town Attorney reviewed the annexation schedule to ensure compliance with state law. Annexation notices have been mailed to the property owners per state law. Two public hearings have been held by the Town Council per state law. Attached Documents: 1. Two (2) Annexation Agreements between the Town of Prosper and G&R STX Investments, and the Town of Prosper and RH-TWO, LP, along with resolutions authorizing the Town Manager to enter into the agreements on behalf of the Town Council. 2. Ten (10) annexation ordinances, annexing in approximately 1,384.9 acres from Denton County into the Town of Prosper.
