RE: House Bill 621 / Exemption of goods in transit
Dear Mr. Land:
In November 2001, Texas voters approved Proposition 10 (SJR by Duncan, et al.),
amending the Constitution to allow the Legislature to exempt from taxation goods -in -transit that
are stored temporarily en route to another location in Texas or outside the state (Art. 8, sec. 1-n).
Exempt property would include the same types of goods and products eligible for the freeport
exemption. The 77th Legislature, however, did not enact enabling legislation to accompany the
constitutional amendment, nor did subsequent legislatures do so until the 80t1i Legislature acted
bypassing House Bill 621.
Under Art. 8, sec. 1-n, property eligible for the exemption must be acquired in or brought
into Texas and stored at a location not owned or controlled by the property owner for not more
than 270 days after acquisition or importation. Unlike "freeport goods," goods in transit need not
be shipped out of state to qualify for the exemption. Governing bodies of taxing entities may
choose to tax goods in transit but must hold a public hearing before acting to do so. Owners of
property eligible for the freeport exemption may apply for the goods -in -transit exemption if the
Legislature enacts enabling legislation, subject to the decisions of local taxing entities. However,
an owner receiving the goods -in -transit exemption may not claim the freeport exemption for the
same property.
HB 621 implements the goods -in -transit exemption authorized by Texas Constitution,
Art. 8, sec. 1-n. The bill defines "goads -in -transit" as tangible personal property stored in a
location whose owner did not have direct or indirect ownership of the property. The property may
be held at that location for no more than 175 days before being forwarded to another location in
Texas or outside the state. The bill excludes the following from the definition of goods -in -transit:
oil; natural gas; petroleum products; aircraft; dealers' inventory of motor vehicles, vessels, and

outboard motors; heavy equipment; and retail manufactured housing.
The governing body of a local taxing entity may elect to tax goods -in -transit, but only
after holding a public hearing. The decision must be made before January 1 of the first tax year
in which the entity proposed to tax these goods. So, if your taxing unit chooses to tax goods -in -
transit for the tax year 2008 and subsequent years, the governing body must act prior to
January I, 2008. If your taxing unit elects to tax goods -in -transit, those goods will remain
taxable until the governing body takes action to rescind or repeal its previous action and grant the
exemption.
If your governing body favors the exemption, then your taxing unit need not take any
action. In the event that your governing body wishes to take the affirmative action necessary in
taxing the property, we are enclosing herewith a form of Resolution or Order which needs to be
passed and approved by the governing body prior to January 1, 2008. Note, however, that before
acting to tax the property, the governing body must first hold a public hearing for the purpose
ofproviding your citizens the opportunity of expressing their opinions on the subject.
A copy of HB 621 is also enclosed. We hope you find this material helpful, regardless of
which policy your taxing unit chooses to follow. Please feel free to call on us if we can be of

RELATING TO APPROVAL OF TAXATION OF GOODS -IN -TRANSIT THAT ARE
OTHERWISE EXEMPTED FROM TAXATION BY PROPERTY TAX CODE
SECTION 11.253
WHEREAS, the Texas Legislature during the 80t" Regular Session passed
House Bill 621 which added Section 11.253 to the Texas Property Tax Code that
grants an exemption from property taxation for certain goods -in -transit personal
property;
WHEREAS, Section 11.253 of the Texas Property Tax Code provides for a
local option under which a taxing unit may tax such property otherwise exempt, if the
governing body of such taxing unit after a public hearing takes official action to tax
such personal property;
WHEREAS, on the governing body of the Town of Prosper
held a public hearing at which members of the public were permitted to speak for or
against the taxation of certain goods -in -transit personal property;
WHEREAS, the governing body of the Town of Prosper has determined that
such personal property, as exempted by Texas Property Tax Code Section 11.253,
should be subject to taxation by the Town of Prosper for tax year 2008 and all
subsequent years;
THEREFORE, BE IT RESOLVED BY THE TOWN COUNCIL OF THE TOWN
OF PROSPER THAT:
(1) all of the above recitals are incorporated and made a part of this
Resolution and,
(2) all such goods -in -transit personal property as covered by Texas Property
Tax Code Section 11.253 shall be, and are hereby declared to be, taxable by the
Resolution, Page 1 of 2
Town of Prosper for tax year 2008 and for every year thereafter, all as provided for
and in accordance with Texas Property Tax Code Section 11.253.

AN ACT
relating to the exemption from ad valorem taxation of tangible
personal property held temporarily at a location in this state for
assembling, storing, manufacturing, processing, or fabricating
purposes.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1. Subchapter B, Chapter 11, Tax Code, is amended by
adding Section 11.253 to read as follows:
Sec. 11.253. TANGIBLE PERSONAL PROPERTY IN TRANSIT. (a) In
this section:
(1) "Dealer's motor vehicle inventory," "dealer's vessel
and outboard motor inventory," "dealer's heavy equipment
inventory," and "retail manufactured housing inventory" have the
meanings assigned by Subchapter B, Chapter 23.
(2) "Goods -in -transit" means tangible personal property
that:
A) is acquired in or imported into this state to
be forwarded to another location in this state or outside this
state;
(B) is detained at a location in this state in

which the owner of the property does not have a direct or indirect
ownership interest for assemblina, storina, manufacturing,
processing, or fabricating purposes by the person who acquired or
imported the property;
(C) is transported to another location in this
state or outside this state not later than 175 days after the date
the person acquired the property in or imported the property into
this state; and
D) does not include oil, natural aas, petroleum
roducts, aircraft, dealer's motor vehicle inventory, dealer's
vessel and outboard motor inventory, dealer's heavy equil2ment
inventory, or retail manufactured housing inventorv.
(3) "Location" means a physical address.
(4) "Petroleum roduct" means a liquid or gaseous
material that is an immediate derivative of the refining of oil or
natural gas.
(b) A person is entitled to an exemption from taxation of the
appraised value of that portion of the erson's property that
consists of goods -in -transit.
(c) The exemption provided by Subsection (b) is subtracted
from the market value of the property determined under Section
23.01 or 23.12, as applicable, to determine the taxable value of
the property.
(d) Except as 2rovided by Subsections (f) and ( ), the chief

appraiser shall determine the appraised value of goods -in -transit
under this subsection. The chief aj2j2raiser shall determine the
percentage of the market value of tangible personal property owned
by.the property owner and used for the production of income in the
preceding calendar year that was contributed by goods -in -transit.
For the first year in which the exemption ap2lies to a taxing unit,
the chief appraiser shall determine that percentage as if the
exemption applied in the preceding year. The chief appraiser shall
apply that percentage to the market value of the property owner's
tangible personal property used for the production of income for
the current year to determine the appraised value of goods -in -
transit for the current year.
(e) In determining the market value of goods -in -transit that
in the preceding year were assembled, stored, manufactured,
processed, or fabricated in this state, the chief appraiser shall
exclude the cost of equipment, machinery, or materials that entered
into and became component parts of the goods -in -transit but were
not themselves goods -in -transit or that were not transported to
another location in this state or outside this state before the
expiration of 175 days after the date thev were brouaht into this
state by the property owner or acquired by the property owner in
this state. For component parts held in bulk, the chief appraiser
may use the average length of time a component ]2art was held by the
owner of the component parts during the preceding year at a

location in this state that was not owned by or under the control
of the owner of the com onent parts in determining whether the
component parts were transported to another location in this state
or outside this state before the expiration of 175 days.
(f) If the property owner was not engaged in transporting
goods -in -transit to another location in this state or outside this
state for the entire preceding year, the chief appraiser shall
calculate the percentage of the market value described in
Subsection (d) for the portion of the year in which the 2roperty
owner was engaged in transporting goods -in -transit to another
location in this state or outside this state.
(g) If the property owner or the chief appraiser demonstrates
that the method provided by Subsection (d) significantly
understates or overstates the market value of the propert
qualified for an exemption under Subsection (b) in the current
year, the chief appraiser shall determine the market value of the
oods-in-transit to be exempt by determining, according to the
proper y owner's records and any other available information, the
market value of those goods -in -transit owned by the property owner
on January 1 of the current year, excluding the cost of equipment,
machinerv, or materials that entered into and became component
parts of the goods -in -transit but were not themselves goods -in -
transit or that were not transported to another location in this
state or outside this state before the expiration of 175 days after

the datethey were brought into this state by the property owner or
acquired by the property owner in this state.
(h) The chief appraiser by written notice delivered to a
property owner who claims an exemption under this section may
require the property owner to 2rovide copies of property records so
the chief appraiser can determine the amount and value of goods -in -
transit and that the location in this state where thegoods-in-
transit were detained for assembling, storing, manufacturinq,
processing, or fabricating urposes was not owned by or under the
control of the owner of the Goods -in -transit. If the property
owner fails to deliver the information requested in the notice
before the 31st day after the date the notice is delivered to the
property owner, the property owner forfeits the right to claim or
receive the exemption for that year.
(i) Property that meets the re uirements of this section
constitutes goods -in -transit regardless of whether the person who
owns the property on January 1 is the person who transports the
roperty to another location in this state or outside this state.
(j) The governing body of a taxing unit, in the manner
required for official action by the governing body, may provide for
the taxation of goods -in -transit exempt under Subsection (b) and
not exempt under other law. The official action to tax the goods -
in -transit must be taken before January 1 of the first tax year in
which the aovernina bodv proDoses to tax goods -in -transit. Before

acting to tax the exempt property, the governing body of the _taxing
unit must conduct a public hearing as re uired by Section 1-n(d),
Article VIII, Texas Constitution. If the governing body of a
taxing unit provides for the taxation of the goods -in -transit as
provided by this subsection, the exemption prescribed by Subsection
(b) does not apply to that unit. The goods- in -trans it remain
subject to taxation by the taxing unit until the governing body of
the taxing unit, in the manner required for official action,
rescinds or repeals its previous action to tax goods -in -transit, or
otherwise determines that the exemption prescribed by Subsection
(b) will apply to that taxing unit.
(k) A property owner who receives the exemption from taxation
provided by Subsection (b) is not eligible to receive the exemption
from taxation provided by Section 11.251 for the same property.
SECTION 2. Section 26.012(15), Tax Code, is amended to read
as follows:
(15) "Lost property levy" means the amount of taxes
levied in the preceding year on property value that was taxable in
the preceding year but is not taxable in the current year because
the property is exempt in the current year under a provision of
this code other than Section 11.251 or 11.253, the property has
qualified for special appraisal under Chapter 23 [af a -tee] in
the current year, or the property is located in territory that has
ceased to be a part of the unit since the preceding year.

SECTION 3. Section 403.302(d), Government Code, is amended to
read as follows:
(d) For the purposes of this section, "taxable value" means
the market value of all taxable property less:
(1) the total dollar amount of any residence homestead
exemptions lawfully granted under Section 11.13(b) or (c), Tax
Code, in the year that is the subject of the study for each school
district;
(2) one-half of the total dollar amount of any residence
homestead exemptions granted under Section 11.13(n), Tax Code, in
the year that is the subject of the study for each school district;
(3) the total dollar amount of any exemptions granted
before May 31, 1993, within a reinvestment zone under agreements
authorized by Chapter 312, Tax Code;
(4) subject to Subsection (e), the total dollar amount
of any captured appraised value of property that:
(A) is within a reinvestment zone created on or
before May 31, 1999, or is proposed to be included within the
boundaries of a reinvestment zone as the boundaries of the zone and
the proposed portion of tax increment paid into the tax increment
fund by a school district are described in a written notification
provided by the municipality or the board of directors of the zone
to the governing bodies of the other taxing units in the manner
provided by Section 311.003(e), Tax Code, before May 31, 1999, and

within the boundaries of the zone as those boundaries existed on
September 1, 1999, including subsequent improvements to the
property regardless of when made;
(B) generates taxes paid into a tax increment fund
created under Chapter 311, Tax Code, under a reinvestment zone
financing plan approved under Section 311.011(d), Tax Code, on or
before September 1, 1999; and
(C) is eligible for tax increment financing under
Chapter 311, Tax Code;
(5) for a school district for which a deduction from
taxable value is made under Subdivision (4), an amount equal to the
taxable value required to generate revenue when taxed at the school
district's current tax rate in an amount that, when added to the
taxes of the district paid into a tax increment fund as described
by Subdivision (4)(B), is equal to the total amount of taxes the
district would have paid into the tax increment fund if the
district levied taxes at the rate the district levied in 2005;
(6) the total dollar amount of any exemptions granted
under Section 11.251 or 11.253, Tax Code;
(7) the difference between the comptroller's estimate of
the market value and the productivity value of land that qualifies
for appraisal on the basis of its productive capacity, except that
the productivity value estimated by the comptroller may not exceed
the fair market value of the land;

(8) the portion of the appraised value of residence
homesteads of individuals who receive a tax limitation under
Section 11.26, Tax Code, on which school district taxes are not
imposed in the year that is the subject of the study, calculated as
if the residence homesteads were appraised at the full value
required by law;
(9) a portion of the market value of property not
otherwise fully taxable by the district at market value because of:
(A) action required by statute or the constitution
of this state that, if the tax rate adopted by the district is
applied to it, produces an amount equal to the difference between
the tax that the district would have imposed on the property if the
property were fully taxable at market value and the tax that the
district is actually authorized to impose on the property, if this
subsection does not otherwise require that portion to be deducted;
or
(B) action taken by the district under Subchapter B
or C, Chapter 313, Tax Code;
(10) the market value of all tangible personal property,
other than manufactured homes, owned by a family or individual and
not held or used for the production of income;
(11) the appraised value of property the collection of
delinquent taxes on which is deferred under Section 33.06, Tax
Code;

(12) the portion of the appraised value of property the
collection of delinquent taxes on which is deferred under Section
33.065, Tax Code; and
(13) the amount by which the market value of a residence
homestead to which Section 23.23, Tax Code, applies exceeds the
appraised value of that property as calculated under that section.
SECTION 4. This Act applies only to taxes imposed for a tax
year beginning on or after the effective date of this Act.
SECTION 5. This Act takes effect January 1, 2008.

Whereas, the Town of Prosper has successfully partnered with Collin
County in past bond programs which have brought about much needed
roadways and open spaces to serve our growing City; and
Whereas, these partnerships have resulted in sharing the construction costs
for these major roadways and open space projects between the Town of
Prosper and Collin County; and
Whereas, our taxpayers have benefited greatly from this leveraging of our
tax dollars by partnering with Collin County and these partnerships have
also allowed Collin County to move ahead with much needed criminal
justice facilities which also serve our City and our citizens; and
Whereas, the 2007 Collin County Bond Election, will not require a
County tax rate increase, and the Town of Prosper will benefit from
additional criminal justice facilities, open space funding and, more
specifically, the Town of Prosper will also be able to move forward on
essential transportation projects such as:
• Prosper Trail from DNT to Preston Rd.
• First Street from Preston Rd. to Coit Rd.
• Coit Road from First St. to US 380
Now, Therefore, We, the Town Council for the Town of Prosper do,
hereby, declare our support for passage of the November 6, 2007 Collin
County Bond Election and do, hereby, encourage our citizens to vote for
passage of all three bond propositions relating to transportation, facilities
and open space because they will benefit both the Town of Prosper and
Collin County and insure that our quality of life will be maintained during
this period of rapid growth and development.

Agenda Item:
An update on the Town's sports fields and/or the construction of future sports fields.
Description -of Agenda Item:
At the June 12, 2007 meeting, a request was made by Councilmember Wadsworth to have an
update on the Town's sports fields and/or the construction of future sports fields on future
agendas. Currently, the Parks and Recreation Board (PARBd) and Town staff are considering
the following options at Folsom Park and on the 57 acre community park site.
1. Folsom Park (located next to Folsom Elementary in the La Cima subdivision): The
PARBd discussed future improvements to Folsom Park at their August 23, 2007
meeting. The development of Folsom Park would provide up to eight (8) youth
soccer/multi-purpose permanent fields. Town staff has initiated contact with Brian
Griffitt, Prosper Sports Association (PSA) President, Lloyd Mills, Prosper Area Soccer
Organization (PASO) President, and Brenda Keener, Folsom Elementary School
Principal to receive input concerning the fields and potential relocation of the existing
playground equipment.
The two grant applications, one to Collin County ($390,000) and one to Texas Park &
Wildlife ($390,000) both matching grants, are still pending.
Staff and Park Board Member Loren Moulder have met with the two sports organizations
and received input concerning their respective needs. Staff has ceased negotiations
with PBK for the design and construction documents for this project. Staff, as directed
by the Park Board, is working towards securing a proposal from another design firm, with
the intent of having a contract for approval late October or early November. This project
is on schedule to meet the Fall 08' goal.
2. 57 acre community park site (adiacent to the future Prosper ISD athletic stadium, south
side of Frontier Parkway, west of the BNSF Railroad):
At the August 23, 2007 PARBd meeting Fred Montes, AIA of PBK presented conceptual
master plans for the 57 acre community park site (see attached). The Parks Board
directed Town staff to meet with Prosper ISD, Prosper Sports Association (PSA), and
Prosper Area Soccer Organization (PASO) to discuss the proposed design. Staff

initiated contact with PSA and PASO, and should be meeting with Prosper ISD in the
near future. Town staff has requested a formal proposal for design services from PBK to
present to PARBd and Town Council.
Town Manager Mike Land has met with Prosper ISD to discuss the creation of a Master
Plan for the entire site, including the Prosper ISD parcel.

AN ORDINANCE AMENDING PROSPER'S ZONING ORDINANCE NO. 05-20; REZONING A
TRACT OF LAND CONSISTING OF 0.7342 ACRE, MORE OR LESS, AT 104 EAST
BROADWAY STREET, IN THE TOWN OF PROSPER, COLLIN COUNTY, TEXAS,
HERETOFORE ZONED SINGLE FAMILY-15 (SF-15) IS HEREBY REZONED AND PLACED IN
THE ZONING CLASSIFICATION OF DOWNTOWN OFFICE (DTO); DESCRIBING THE TRACT
TO BE REZONED; PROVIDING FOR A PENALTY FOR THE VIOLATION OF THIS
ORDINANCE; PROVIDING FOR REPEALING, SAVING AND SEVERABILITY CLAUSES;
PROVIDING FOR AN EFFECTIVE DATE OF THIS ORDINANCE; AND PROVIDING FOR THE

WHEREAS, the Town Council of the Town of Prosper, Texas (the "Town Council") has investigated and
determined that Zoning Ordinance No. 05-20 should be amended; and
WHEREAS, the Town of Prosper, Texas ("Prosper") has received a request from Joe A. Martinez
("Applicant") to rezone 0.7342 acre of land, more or less, at 104 East Broadway, in the Town of Prosper, Collin
County, Texas; and
WHEREAS, the Town Council has investigated into and determined that the facts contained in the request
are true and correct; and
WHEREAS, all legal notices required for rezoning have been given in the manner and form set forth by law,
and public hearings have been held on the proposed rezoning and all other requirements of notice and completion of
such zoning procedures have been fulfilled; and
WHEREAS, the Town Council has further investigated into and determined that it will be advantageous and
beneficial to Prosper and its inhabitants to rezone this property as set forth below.
TEXAS:
NOW, THEREFORE, BE IT ORDAINED BY THE TOWN COUNCIL OF THE TOWN OF PROSPER,
SECTION 1: Findings Incorporated. The findings set forth above are incorporated into the body of this
Ordinance as if fully set forth herein.
SECTION 2: Amendments to Zonino Ordinance No. 05-20. Zoning Ordinance No. 05-20 is amended as
follows: The zoning designation of the property containing 0.7342 acre of land, more or less, at 104 East Broadway,
in the Town of Prosper, Collin County, Texas, (the "Property") and all streets, roads and alleyways contiguous and/or
adjacent thereto is hereby rezoned as Downtown Office (DTO). The Property as a whole and for this zoning
classification is more particularly described in Exhibit "A" attached hereto and incorporated herein for all purposes as
if set forth verbatim.
All development plans, standards, and uses for the Property shall comply fully with the
requirements of all ordinances, rules, and regulations of the Town of Prosper, as they currently exist or may be
amended.
Three original, official and identical copies of the zoning exhibit map are hereby adopted and shall be filed
and maintained as follows:
a. Two (2) copies shall be filed with the Town Secretary and retained as original records and shall not be
changed in any matter.
b. One (1) copy shall be filed with the Building Inspector and shall be maintained up-to-date by posting
thereon all changes and subsequent amendments for observation, issuing building permits, certificates
of compliance and occupancy and enforcing the zoning ordinance. Reproduction for information
purposes may from time -to -time be made of the official zoning district map.
Written notice of any amendment to this District shall be sent to all owners of properties within the District as
well as all properties within two hundred feet (200') of the District to be amended.
SECTION 3: No Vested Interest/Re eal. No developer or property owner shall acquire any vested interest in
this Ordinance or in any other specific regulations contained herein. Any portion of this Ordinance may be repealed
by the Town Council in the manner provided for by law.
SECTION 4: Unlawful Use of Premises. It shall be unlawful for any person, firm or corporation to make use
of said premises in some manner other than as authorized by this Ordinance, and shall be unlawful for any person,
firm or corporation to construct on said premises any building that is not in conformity with the permissible uses under
this Zoning Ordinance.
SECTION 5: Penalty. Any person, firm, corporation or business entity violating this Ordinance or any
provision of Prosper's Zoning Ordinance No. 05-20, or as amended, shall be deemed guilty of a misdemeanor, and
upon conviction thereof shall be fined any sum not exceeding Two Thousand Dollars ($2,000.00). Each continuing
day's violation under this Ordinance shall constitute a separate offense. The penal provisions imposed under this
Ordinance shall not preclude Prosper from filing suit to enjoin the violation. Prosper retains all legal rights and
remedies available to it pursuant to local, state and federal law.
SECTION B: Severability. Should any section, subsection, sentence, clause or phrase of this Ordinance be
declared unconstitutional or invalid by a court of competent jurisdiction, it is expressly provided that any and all
remaining portions of this Ordinance shall remain in full force and effect. Prosper hereby declares that it would have
passed this Ordinance, and each section., subsection, clause or phrase thereof irrespective of the fact that any one or
more sections, subsections, sentences, clauses and phrases be declared unconstitutional or invalid.
SECTION 7: Savings/Repealing Clause. Prosper's Zoning Ordinance No. 05-20 shall remain in full force
and effect, save and except as amended by this or any other Ordinance. All provisions of any ordinance in conflict
with this Ordinance are hereby repealed to the extent they are in conflict; but such repeal shall not abate any pending
prosecution for violation of the repealed ordinance, nor shall the appeal prevent a prosecution from being
commenced for any violation if occurring prior to the repealing of the ordinance. Any remaining portions of said
ordinances shall remain in full force and effect.
SECTION 8: Effective Date. This Ordinance shall become effective from and after its adoption and
publications as required by law.

Discuss and give direction regarding the Preston 48 Addition development located in the
southwest quadrant of Prosper Trail and Highway 289.
Description of Aoenda Item:
On July 10, 2007, the Preston Lakes Homeowners Association addressed the Town Council on
the erosion issues experienced on Grapevine Court and Bridgeport Drive. Based on the
conversations at that meeting, Town staff and the developer of the Preston 48 Addition
development have been working on addressing their concerns.
Engineering plans for the proposed retaining wall along the south side of the development were
submitted to the Town for review on July 23, 2007. Due to the extent of the review comments,
Town staff and the developer met on site with the retaining wall structural engineer on July 31,
2007, to discuss the proposed revisions to the retaining wall to address existing field conditions.
At that time the developer agreed to contract with the original site engineer to resurvey the
property to adequately design the drainage for the development in conjunction with the
proposed retaining walls.
On August 24, 2007, the original site engineer contacted Town staff to discuss the progress of
the revised plans. He had been working with the structural engineer and was in the process of
revising the plans to address the concerns raised by Town staff on July 31, 2007. Prior to the
discussion at the September 11, 2007, Town Council meeting, staff received the revised plans
and informed the Council that the review would be expedited and sent back to the developer
before the end of that week.
On September 12, 2007, the Town Engineer met with the developer to discuss the plan review
comments and with the design engineer, structural engineer and developer again on September
17, 2007. Prior to the September 25, 2007, Town Council Meeting, the plans were revised and
a meeting was held with the affected homeowners, the developer and the Town Engineer to
answer any questions. Based on the discussions from that meeting it was decided that the
homeowners, developer and the Town Engineer would meet on -site Sunday, September 30,
2007, to walk the site, discuss the proposed improvements and address any concerns.
At the September 25, 2007, Town Council Meeting, the developer and the Town Engineer
updated the Council on the revisions made to the engineering plans, the recent meeting with the
homeowners and the planned on -site visit with the homeowners. It was requested by
Councilmember Wadsworth that a memorandum be prepared and provided to Council outlining

and addressing the concerns raised at the upcoming site visit. A copy of that memorandum is
attached for your review.
Currently the developer is constructing the strip center along Preston Road south of the new
carwash and as a condition of receiving a Certificate of Occupancy, is required to complete the
retaining walls for the development. Based on the outcome of discussions at the October 9,
2007, Town Council Meeting, a Stop Work Order to address a potential unsafe condition may be
requested by the Town Council to address the erosion and drainage issues.

Anenda Item:
Consider and act upon bid proposal for the Highland Meadows Drainage Project and take any
action necessary.
Description of Anenda Item:
On May 8, 2007, staff discussed with the Town Council the drainage situation in the Highland
Meadows Subdivision where an existing drainage channel located along the rear of the
properties fronting Fair Oaks is currently unable to handle the existing drainage from the south
as well as from the adjacent properties. Since there was a chance of flooding, staff authorized
an engineering firm to begin preparing the necessary survey and design plans to remedy the
situation prior to the approval of a contract for these services.
On June 12, 2007, Town Council ratified an Engineering Design Services Agreement with RLK
Engineering which included the following improvements:
• Relocation of the existing wrought iron fences outside the drainage easement.
• Installation of wrought iron gates on the back fence to provide homeowners access to
the easement for routine maintenance
• Regarding of the channel to provide positive drainage.
• Installation of new sod in all disturbed areas.
Once the design of the plans was complete, the Town advertised the project for bids and at the
August 2, 2007, bid opening, no bids were received. The Town then re -advertised the project
and at the bid opening on September 4, 2007, no bids were received once again. It wasn't until
the third bid opening on October 2, 2007, that the Town received a bid from Dickerson
Construction Company, Inc., in the amount of $203,550.
The engineer's estimate of probable construction costs for this project was approximately
$120,000. Due to the significant increase in the bid proposal amount received in relation to the
engineer's estimate of probable construction costs and lack of other bid proposals received on
this project, ascertaining the competiveness of Dickerson's bid is difficult. Staff feels rebidding
this project once again may increase the number of contractors willing to provide a competitive
bid.
On July 20, 2007, the Public Works Department performed some minor grading which has
helped to help alleviate some of the ponding problems. In the meantime, staff will continue to

work with the design engineer to contact potential contractors to notify them of the project in
hopes of receiving more proposals.
Budget Impact:
If awarded, there is approximately $87,000 that will be used from the 2006-2007 Streets Fund
Account (#10-5480-40). The remaining $116,550 would have to be supplemented by the 2006
CO Bonds.
If not awarded, it is requested that the approximately $87,000 that was to be used from the
2006-2007 Street Fund Account (#10-5480-40) be reallocated to the current Prosper Road
Improvement Project 2007 which is being funded from the 2006 CO Bonds. That would make
the credit from the 2006-2007 Street Fund Account to the 2006 CO Bonds available to fund the
Highland Meadows Drainage Project in the future.
Legal Obligations and Review:
The contract is a standard construction contract previously approved by the Town Attorney.

Description of Agenda Item:
Staff has completed the changes to the 2007 Parks, Recreation and Open Space Master Plan
as per direction received during the September 111h Council Meeting. The Town Council,
subject to legal review, approved the Town of Prosper Parks, Recreation, and Open Space
Master Plan during the September 251h Council Meeting.
Budget Impact:
Budget implications are addressed in the Parks, Recreation, and Open Space Master Plan.
Legal Obligations and Review:
On October 4, 2007 the Town Attorney's office completed their review of the Parks, Recreation
and Open Space Master Plan with the changes directed by Council during the September 11th
meeting (see attached. The two general topics of concern, being;
1) Vesting Rights.
2) Decreased park land within the Town.

At their May 31, 2007 meeting, the Parks and Recreation Board unanimously approved a
motion to recommend that the Town Council approve the proposed Parks, Recreation, and

The Town Attorney recommends the following statement be removed from the document -

Rebecca asked me to assist her with this letter in response to your request for a legal opinion
on possible issues related to inclusion of the following proposed wording in the Town's Parks
Recreation and Open Space Master Plan (the "Plan"):
"Properties which have been zoned prior to the adoption of the Plan will not be
subject to the requirements of the Plan."
You have asked whether there are any potential risks or adverse consequences that could result from
including the proposed language.
My first, and most concerning, observation is that all property presently within the existing
corporate limits of the Town should already be zoned, even if it still has its initial designation of
agricultural zoning. Therefore, a consequence of the proposed language is that only property
annexed into the Town in the future will be subject to the Plan, as that is the only property. not zoned
at this time.
Including the proposed language in the Plan, has other possible consequences and raises other
issues, some of which are as follows:

(1) If there will not be any more parks within the present Town limits because all property
previously zoned is exempt from the Plan, then the Town could potentially be precluded
from collecting park fees because there will not be anywhere to expend the fees collected.
(2) There may not be anywhere for park land and open space to be located in the Town if all
property with zoning is exempt.
(3) The suggested language could potentially create vested rights in the property located in the
Town at the present time that parks are not required, which could be an impediment to the
Town in the future if it were to retract the proposed language and seek to have parks in the
Town.
(4) A developer that wants to develop a park/open space as an amenity to its development could
be adversely affected by this language (e.g. if no other landowner has to allow park land on:
their property, the developer who wants to develop a park/open space maybe encouraged not
to do so because it is not in the developer's economic interests).
(5) Most surveys show that the amenity home buyers most want (and thus the homebuilder can
charge more for its home) is open space. The absence of park land could potentially lower
the quality of homes built in Prosper.
In order to address the above issues, and to help prevent vesting from occurring, we recommend
adding the following language, in lieu of the proposed language quoted at the beginning of this letter;

certified roll as of July 25, 2007; and
WHEREAS, The Town Council of the Town of Prosper, Texas does hereby adopt the 2006 appraisal
roll with a certified taxable value of $762,250,305.

Section 1. That all matters stated in the preamble of this resolution are true and correct and are hereby

Description of Agenda Item:
This past Tuesday the Planning and Zoning Commission began their review of the proposal. Their
focus will ultimately be on land use and development standards. Currently their hope is to be
complete with their review by October 16th, forwarding a recommendation to the Council for its
consideration during the Council's October 23rd meeting. You have been provided a copy of
Rebecca's comments as well as staff's. Rebecca and I are scheduled to meet with the ForestCity
team on Monday afternoon to go over all the comments, find our common ground and clarify where
we have any differences. There are multiple policy related issues contained within the document
based on the way it is currently styled, with many being infrastructure and reimbursement related.
As an aside, ForestCity is participating in the Western Prosper Development Group discussions.
Per my previous e-mail, the document you are reviewing is the "final" proposal from Forest City as
a result of all of the input from the Mahard Development Committee and previous staff comments.
At this point there may be changes resulting from our meeting on Monday, and there may be
changes as a result of their response to Planning and Zoning concerns. By having ForestCity
present the project to you on Tuesday night, you will be given the opportunity to see the big picture
and ask questions related to the project as a whole, and discuss with the developer any of the key
agreement points you are needing clarification on or would like to see changed, with the full
understanding that Planning and Zoning is examining the plan from their perspective at the same
time. I know this is a little different than what you are accustomed to, but do to the scale of the
project and the implications of the pre -annexation agreement and the amount of time it has taken
to get to this point, I thought it was important to have you begin the process of working your way
through the document. There is no pressure that I am aware of that requires this agreement to be
considered and acted upon by the Council on October 23rd. Additionally, the Council may consider
holding a workshop with ForestCity at a later date outside of the normal Council meeting to help
facilitate the discussion.
