Chairman Alzner opened the Public Hearing.
Kevin Patel (Representative): Informed Commissioners that the Preston Road access drive will
be constructed at the time of development.
Gayle Bridgeman (Resident): Expressed support for the proposed use and concern about
increased traffic on Hays Road. Requested information regarding the landscaping along Hays
Road.
There being no other speakers the Public Hearing was closed.
Commissioners voiced support for the request.
Motioned by Hema, seconded by Robertson, to approve Item 4 subject to Town staff
recommendations. Motion approved 5-0.
5. Review actions taken by the Town Council and possibly direct Town Staff to
schedule topic(s) for discussion at a future meeting.

Description of Agenda Item:
On April 18, 2017, the Planning & Zoning Commission approved a preliminary plat for Lakes at
Legacy for 346 single-family residential lots and 15 HOA/open space lots, on 112.9± acres. The
Final Plat for Phase 1 contains a mixture of Type A lots that are fifty-five (55) feet in width and
Type B lots that are sixty-five (65) feet in width per the development standards. The Final Plat
conforms to the approved Preliminary Plat and the Planned Development-65 development
standards.

Consider and act upon a request for a Variance to the Subdivision Ordinance regarding
thoroughfare screening, for Parkside, located on the west side of Coit Road, 1,500± feet south of
Prosper Trail. (V17-0006).
Description of Agenda Item:
The applicant is seeking a variance regarding the Subdivision Ordinance requirements for
Thoroughfare Screening. A letter from the applicant detailing the basis for the request is attached
for reference. The Subdivision Ordinance regulates thoroughfare screening adjacent to all single
family attached and detached residential developments siding and backing to rights-of-way of 60
feet or greater. Thoroughfare Screening is required to consist of ornamental metal fencing with
masonry columns, meandering sidewalks, berming, and landscaping, within a minimum 25-foot
landscape buffer/common area to be owned and maintained by a Homeowner’s Association
(HOA). The Parkside Planned Development-77 (PD-77), however, requires a 40-foot landscape
buffer/common area along Coit Road. The minimum 40-foot landscape buffer is required to be
exclusive of all required streets, right-turn rights-of-way, drainage easements, and utility
easements, unless otherwise approved by the Town Council.
The applicant is requesting a variance to allow a proposed 10-foot electric utility easement to
encroach within the required 40-foot landscape buffer. The variance would allow an existing
overhead power line, located within the Coit Road right-of-way to be buried in the Parkside HOA
lot, as Oncor Electric has indicated that they will not bury the power line within the Town’s right-
of-way. All required landscaping will be provided in accordance with Town standards. No large
trees are located within the easement, but small trees, shrubs and portions of the sidewalk may
be located within the 10-foot electric utility easement, which is permitted by the easement holder;
however, the Parkside HOA will be responsible for any disturbed landscaping. Details of the
location, extent, and the profile of the landscape buffer are depicted on the attached exhibit and
described in the request letter.

Conduct a Public Hearing and consider and act upon a request to amend Chapter 3, Permitted
Uses and Definitions of the Zoning Ordinance regarding temporary buildings. (Z17-0007).
Background and Purpose of the Proposed Amendment:
The Zoning Ordinance permits public schools, public agencies, and churches the process for
applying for temporary buildings with the condition that the buildings be permitted for three (3)
year and a maximum one-year extension. Upon advice of the Town Attorney, staff is
recommending the standards be amended to remove the time limit for public schools and public
agencies.
Applications for temporary buildings are processed in a manner similar to a preliminary site plan
or site plan with action by the Planning & Zoning Commission. The attached “red line” notes the
recommended changes. While the primary change is related to the removal of the time limit, staff
desires to take the opportunity to “clean-up” this section by removing redundant and unnecessary
requirements.
Legal Obligations and Review:
Zoning is discretionary. Therefore, the Planning & Zoning Commission is not obligated to
recommend approval of the request. Notice of the Planning & Zoning Commission Public Hearing
was provided in the newspaper as required by the Zoning Ordinance and state law. To date, no
correspondence has been received.

Chapter 3 – Permitted Uses
Section 1.4 – Conditional Development Standards
7. Temporary Building
A. Temporary buildings are permitted by right for houses of worship, public schools (kindergarten
through twelfth grade only), and government agencies (see Chapter 3, Section 2.2), subject to the
conditions below.
B. Temporary buildings for private enterprises are permitted by Specific Use Permit. subject to the
conditions below.
C. A permit to erect a temporary building for a house of worship may be issued for an initial period of
three (3) years. provided the applicant submits
D. The application for temporary building(s) shall be submitted to the Development Services
Department in the form of a Preliminary Site Plan or Site Plan application with the accompanying
material and exhibits: documented evidence of an immediate need for space to the Building Official,
who shall evaluate each application for a temporary building based on the following criteria:
1) Written report documenting the following:
a) capacity of the existing permanent building(s), which is located or planned to be located on
the same property for which the temporary building permit is being sought, compared to the
enrollment, employment, and/or number of people attending the existing permanent
building(s) at one time;
b) total enrollment, employment, and/or membership size;
c) documentation of growth records depicting the number of people in the congregation,
school and/or office;
d) whether the facility is a start-up or new facility;
e) indication of alternative options that were explored before a temporary building application
was considered;
f) acts of nature; and/or
g) any other evidence which is reasonably related to the immediate need for additional space;
2) A Preliminary Site Plan or Site Plan depicting the following:
a) a preliminary site plan to the Planning Department, providing for a permanent solution to
the immediate need for a new temporary building(s) showing the permanent building(s),
b) the temporary building(s), and
c) the required parking, which is subject to the review and approval of the Planning & Zoning
Commission; and
3) Where an approved Preliminary Site Plan or Site Plan is in effect on the property, the applicant
may note the location of the proposed temporary building(s) on the approved plan in lieu of
submitting a new plan.
2) a site plan for the temporary building(s) to the Planning Department, which is subject to the
review and approval of the Planning & Zoning Commission
E. The temporary building(s) shall be removed within thirty (30) days of the date:
1) a Certificate of Occupancy is issued for the permanent building; or
2) the permit for the temporary building expires, whichever occurs first.
F. After the initial three-year period, a request for a one-year extension of the temporary building permit
for a house of worship may be granted by the Planning & Zoning Commission provided the applicant:
1) has an approved and valid preliminary site plan or site plan for the permanent building(s) and
an approved and valid site plan for the temporary building(s);
2) has a specific plan of how an additional year would allow the applicant to construct the
permanent building(s) by providing:
a) evidence of numeric growth, beyond that which was specifically anticipated by the applicant;
b) membership, enrollment, and/or employment growth records;
c) evidence that alternative options were explored before an extension of the temporary
building permit was requested; and
d) any other criteria reasonably deemed appropriate by the Planning & Zoning Commission.
G. The applicant may challenge a decision of the Building Official or Planning & Zoning Commission,
by appealing, in writing, to the Town Council within fourteen (14) days of a decision of the Building
Official or the Planning & Zoning Commission. The Town Council’s decision is final.
H. Three (3) or more members of the Town Council may appeal the decision of the Planning & Zoning
Commission by submitting a written notice of appeal to the Planning & Development Department.
The Town Council shall consider and act on whether it will appeal the Commission’s decision no
later than fourteen (14) days from the date of such decision or at its first regular meeting (for which
there is time to post an agenda as required by law) that occurs after the Commission meeting at
which the decision was made, whichever is later. Written notice of the Town Council’s vote to appeal
shall be submitted to the Planning Department within seven (7) days of the Town Council’s vote.
The Town Council shall consider the appeal at a public meeting no later than forty-five (45) days
after the date on which the notice of appeal is submitted to the Planning Department. The Town
Council may affirm, modify, or reverse the decision of the Planning & Zoning Commission.
