Prosper Planning & Zoning Commission
Meeting Minutes of June 20, 2017
School District (PISD), located on the northeast corner of Richland Boulevard and
Coit Road. (Z17-0005).
Webb: Summarized the request and presented exhibits provided by the applicant. Informed
Commissioners that two additional Public Hearing Reply forms have been received, not in
opposition to the request.
Garrett Bradley (PISD Representative): Provided information on current and future student
enrollment at Rogers Middle School. Stated that PISD plans to construct a third middle school
at Rockhill Road and Coit Road and that it is scheduled to open in August 2019.
Danny Roberts (PISD Representative): Stated that when the third middle school is open and
the portables are not needed at Rogers, the buildings will probably be moved to another school,
since the Districts owns the buildings. He noted the concrete walkways to each building,
providing ADA access, can easily be removed when the portables are moved.
Vice Chairman Hema opened the Public Hearing.
There being no speakers, the Public Hearing was closed.
Commissioners voiced concern for the request and questioned why the District installed the
buildings prior to receiving the appropriate approvals from the Town. But the Commissioners
understood that under current constraints approval is necessary.
Motioned by Daniel, seconded by Robertson, to approve Item 4, subject to staff
recommendations. Motion approved 4-0.
5. Conduct a Public Hearing, and consider and act upon a request to amend Chapter
3, Permitted Uses and Definitions of the Zoning Ordinance regarding the permitted
use of restaurants with drive-through service, the definition of restaurants, and
the definition of automobile sales, service and leasing. (Z17-0006).
Webb: Summarized the request and presented information on the proposed amendments.
Vice Chairman Hema opened the Public Hearing.
There being no speakers, the Public Hearing was closed.
Commissioners voiced support for the proposed amendments.
Motioned by Robertson, seconded by Atteberry, to approve Item 5, subject to staff
recommendations. Motion approved 4-0.

History:
At the June 20, 2017, meeting, the Planning & Zoning Commission recommended the Town
Council approve a request to rezone the subject property to allow for reduced building and
landscape setbacks specifically for temporary buildings along Richland Boulevard. On July 11,
2017, the Town Council approved the same. An ordinance rezoning the property is scheduled
for the July 25, 2017, Town Council meeting.
Description of Agenda Item:
At the May 19, 2015, Planning & Zoning Commission meeting, seven (7) temporary buildings
were approved for Rogers Middle School. Currently, there are five (5) permitted temporary
building located on the subject property, and five (5) unpermitted temporary buildings that are
located on the property, which are needed for the 2017-2018 school year. Following Site Plan
approval, building permits for the five (5) unpermitted temporary buildings will be reviewed
accordingly.
To accommodate future growth of the District’s student population, PISD is requesting the ability
to place up to 26 temporary classroom buildings on the site, when the need arises. The Site
Plan shows the location of the 26 proposed temporary buildings. Currently, approval of the
temporary buildings is for an initial period of three (3) years, and the applicant has provided a
letter of intent describing the need for the temporary buildings.

Town staff recommends approval of the Site Plan for Temporary Buildings, subject to:
1. Town Council adoption of an ordinance rezoning the subject property;
2. The issuance of Certificates of Occupancy for each temporary building from the Town’s Building
Inspections Division, which includes a health, life and safety inspection;
3. Staff approval of emergency access points, fire lanes, including striping, widths, radii, and
location, signage, alarm and pull station systems, electrical panels, and fencing and gate
hardware; and

Description of Agenda Item:
On January 6, 2015, the Planning & Zoning Commission approved a preliminary plat for
Meadowbrook. A final plat for Lakewood (aka Meadowbrook), Phase I was approved by the
Planning & Zoning Commission on June 2, 2015. A six-month extension of the preliminary plat
was approved by the Commission on January 3, 2017 to allow the developer time to move forward
with the preparation of the final plat for Phase II.
As the six-month extension was nearing expiration, the applicant submitted a new preliminary plat
application for Lakewood (aka Meadowbrook) on June 19, 2017. Approval of a new preliminary
plat application will provide the applicant a two-year period to prepare a final plat for the remaining
portions of Lakewood. The Preliminary Plat conforms to the Planned Development-25
development standards.

Description of Agenda Item:
The Site Plan shows four single-family residences that will be converted to office buildings.
Access is provided from First Street and Craig Road and cross access is being provided to the
property to the west. Adequate parking has been provided. Five on-street parallel parking spaces
will be constructed along Craig Road. Existing driveways will be removed to prevent vehicles
from backing on to First Street and Craig Road.
The applicant is aware that during the a.m. and p.m. peak drop off and pick up periods at the
elementary school, the queuing of traffic along Craig Road and First Street may hinder egress
and ingress at the office buildings.
The Site Plan conforms to the non-residential design and development standards.

Requested Zoning – The purpose of this request is to allow for a Child Day Care Center (Kiddie
Academy). Exhibit B shows the proposed layout, which consists of a one-story, 10,000 square
foot building, 45 parking spaces allowing for 190 students and 20 teachers/staff.
Exhibit C is a conceptual landscape plan, which depicts the location of required landscaping. The
landscaping meets the minimum standards of the Town’s Zoning Ordinance.
Exhibit D shows a conceptual rendering depicting the architectural look and style of the building.
The development will be required to meet the non-residential design and development standards
of the Zoning Ordinance.

The Zoning Ordinance contains four criteria to be considered in determining the validity of a SUP
request. These criteria, as well as staff’s responses for each, are below.
1. Is the use harmonious and compatible with its surrounding existing uses or proposed uses?
The properties to the north and south are undeveloped and zoned for retail to the north and a
Child Day Care Center to the south. To the west, one tract has a small office building and a
second is undeveloped. The property to the east across Hays Road has an office building
and a storage facility. The proposed use is harmonious and compatible with the surrounding
proposed uses.
2. Are the activities requested by the applicant normally associated with the requested use?
The activities requested by the applicant, as shown on Exhibit B, are normally associated with
the use of a Child Day Care Center.
3. Is the nature of the use reasonable?
The Future Land Use Plan recommends Retail & Neighborhood Services uses for the
property. The proposed use is permitted by SUP within the Retail zoning district; therefore,
the nature of the use is reasonable.
4. Has any impact on the surrounding area been mitigated?
The proposed use will have minimal impact on the surrounding area.
Future Land Use Plan – The Future Land Use Plan recommends Retail & Neighborhood Services
uses for the property. This request conforms to the Future Land Use Plan.
Conformance to the Thoroughfare Plan – The property has direct access to Hays Road, an
ultimate two-lane undivided commercial collector. The SUP exhibit complies with the
Thoroughfare Plan.
Water and Sanitary Sewer Services – Water and sanitary sewer services are located directly
adjacent to the site.
Access – Access to the property is provided from Hays Road and to Preston Road through cross-
access with future development. Adequate access is provided to the property.
Schools – This property is located within the Prosper Independent School District (PISD). It is
not anticipated that a school site will be needed on this property.
Parks – The property will not be needed for a park.
Environmental Considerations – There is no 100-year floodplain located on the property.
Legal Obligations and Review:
Notification was provided to neighboring property owners as required by state law. To date, Town
staff has not received any Public Hearing Notice Reply Forms.

Town Council Public Hearing:
Upon a recommendation by the Planning & Zoning Commission, a Public Hearing on this item
will be scheduled for the Town Council at their Regular meeting on August 8, 2017.
