Please note the Site Plan depicts areas on the tower for future carriers’ antennas and the ground lease area for the equipment for the initial carrier, Verizon, and future carriers’ ground equipment. The proposed zoning permits an office development on the entire tract and limits retail uses to a Prosper is a place where everyone matters. Wet/Retention Pond – The applicant is seeking relief from the requirement for wet/retention ponds, for the proposed detention pond which is located in the northeast corner of the property, at the intersection of Preston Road and Broadway Street. The requirement for wet/retention ponds, which was adopted by Town Council on October 10, 2017, states: “1. Wet ponds, aka Retention Ponds, are required in the Town of Prosper to satisfy detention requirements. Wet ponds provide amenities and increased water quality functions as compared to dry ponds.” The requirement for wet ponds also provides for a waiver process, which states, “if a development is unable to utilize either retention or underground detention due to physical constraints, hydraulic limitations or other hardships, the use of a dry detention pond will require Town Council approval.” The applicant has provided the following information to substantiate their request for a waiver of the requirement for a wet/retention pond: “This request is also to remove the requirement for above ground detention pond to be a “wet pond” or “retention pond” for this site. The existing drainage onsite is approximately 12-14 feet below the Preston Road curb elevation. In order to accomplish an above ground pond, the normal water level would be at or below this elevation, 12-14 feet below the roadway, and practically invisible as an amenity, unless viewed from directly next to the pond. Additionally, Town standards requiring six feet of standing water in a retention pond increases the cost of the retaining walls substantially, while not adding a tangible benefit to the Town. This applicant suggests adding a civic monument or other feature as an amenity, to be coordinated with Town staff and stakeholders, in lieu of the retention pond.” Town Engineering staff has reviewed the proposal for dry detention has indicated that the proposed detention pond is an “on-channel” pond, which means that the pond has been placed in the path of the drainage channel that flows through the site. This channel also carries the drainage for portions of Broadway Street and Preston Road. Town requirements do not restrict the use of on- channel detention but it can be problematic for environmental and maintenance reasons. The applicant has not been able to provide support material that justifies any physical constraints, hydraulic limitations, or other restrictions that would prevent the development of a wet pond. As shown on Exhibit F, the proposed elevations illustrate the proposed façade plans for the office and retail buildings. The applicant is proposing both pitched roof and flat roof architecture. The proposed office buildings will have pitched roof architecture, and the two (2) retail buildings along Preston Road will have flat roof architecture. The proposed elevations comply with the Zoning Ordinance requirements. Proposed landscaping is shown on Exhibit G, which complies with the Zoning Ordinance requirements. Page 3 of 3 In general, staff is supportive of the proposed rezoning request, with regard to permitted uses, site layout, elevations, and landscaping. However, staff does not support the request for a dry detention pond, due to the fact that the proposed detention pond is located at such a prominent location within the Town, and specifically at a key gateway into the downtown. The approval by the Town Council of this requirement represents the preferred vision of development within the Town. Future Land Use Plan – The Old Town insert of the Future Land Use Plan recommends Retail and Office for the property; the proposed development conforms to the Future Land Use Plan. Thoroughfare Plan – The property has direct access to existing Broadway Street, an ultimate four- lane divided thoroughfare, Preston Road, an existing six-lane divided thoroughfare, and Craig Road, a two-lane commercial collector. The zoning exhibit complies with the Thoroughfare Plan. Water and Sanitary Sewer Services – Water and sanitary sewer services are directly adjacent to the property. Access and Circulation – The property has access from Broadway Street, Preston Road, and Craig Road. Adequate access is provided to the property. Schools – This property is served by the Prosper Independent School District. It is not anticipated that a school site will be needed on this property. Parks – It is not anticipated that this property will be needed for the development of a park. Environmental Considerations – No 100-year floodplain exists on the property. As part of the review process, the proposed project was reviewed by the Executive Development Team (EDT) on September 25, 2018, with the EDT providing the following input on the request: • General support for the request, as presented; • General support for dry detention to be located in the northwest corner of the site rather than a wet pond/retention pond; • Support to adding an additional inventory display row along US 380; • Revising the request to move the proposed landscape berms farther north to avoid conflicts with future TxDOT right-of-way acquisition, associated with the imminent widening of US 380 in the future; • Maximizing the building areas to allow for modifications once the specific dealerships are known; and • Revising the request to propose each of the two (2) dealership buildings be on separate lots. Based upon the comments from the EDT, Town staff requested the applicant submit a letter tabling this request to the October 16, 2018, meeting to allow the applicant time to revise the exhibits per the EDT recommendations. To keep the request moving forward, staff offered to schedule both the Town Council Public Hearing and proposed Ordinance on the November 13, 2018, Town Council agenda. The applicant does not wish to table the item to October 16, 2018, Planning & Zoning Commission meeting, and has indicated a desire to move the proposed project forward without addressing the comments from the EDT. In lieu of recommending denial of the request, Town staff is recommending the Planning & Zoning Commission table this item to the October 16, 2018 meeting, so the EDT comments can be incorporated into the PD exhibits. The applicant is proposing to remove an existing 80-foot light pole that illuminates soccer fields and replace it with a 115-foot support structure for wireless antennas and affix lights at a point 80 feet high on the support structure. A 10-foot tall masonry enclosure, constructed of brick and stone consistent with other structures in Frontier Park, is proposed to screen the ground equipment used in conjunction with the wireless communication facility. PLANNING Page 2 of 3 Exhibit A shows the 600 square-foot lease area and the proposed location of the cell tower, which is located approximately 650 feet from the subdivision to the south (Lakes of Prosper) and 1,500 feet from the subdivision to the west (Lakes of Prosper North). Exhibit B shows the elevations of the cell tower and masonry enclosure. The support structure will be painted bronze to match the existing light poles at the park, and the antennas will be flush-mounted to the tower. The masonry enclosure will be constructed of brick and stone to match the building materials of the existing structures at the park. This request is for approval of a SUP for the use; however, the applicant will also need to seek approval from Town Council for a Tower Site Lease Agreement, since the facility will be on Town- owned property. The Zoning Ordinance contains the following four (4) criteria to be considered in determining the validity of a SUP request. 1. Description of Agenda Item: The Comprehensive Plan states, “Planning for the Town's future should be a continuous process, and this Plan is designed to be a dynamic tool that can be modified and periodically updated to keep it in tune with changing conditions and trends…Elements of the Town that were treated in terms of a general relationship to the overall area may, in the future, require more specific and detailed attention.” On August 23, 2018, Town staff held a public meeting to discuss the proposed design and improvements to Coit Road. There were approximately 100 residents of the area in attendance. Based on feedback received at this meeting, as well as from Town Council, the Town is proposing to revise the design and approach to construction of Coit Road, between Prosper Trail and Frontier Parkway. While the Comprehensive Plan generally recommends construction of outer lanes when the entirety of an ultimate roadway section is not constructed in a single phase, the proposed amendment recommends construction of the inner lanes on a section of Coit Road, between Prosper Trail and Frontier Parkway, where 4 lanes of an ultimate 6-lane divided section are currently proposed for construction. The recommendation to amend the Comprehensive Plan to add these cross sections is necessitated due to an inadequate amount of right-of-way in this area. There is not 120 feet of right-of-way, which is typical for an ultimate 6-lane divided thoroughfare. The proposed cross section provides for an ultimate 6-lane, divided thoroughfare, with 110 feet and 101 feet of right- of-ways, and recognizes the construction of the inner lanes initially, and construction of the outer lanes in the future, as warranted.
