Regarding Item 3f., the Commission inquired about the proposed development. Mendez: Provided a summary of the proposed development. Regarding Item 3e., the Commission inquired about the alignment of proposed First Street, as shown on the Malabar Hill Preliminary Plat, in relationship to the Thoroughfare Plan. Ingalls: Provided a summary of the proposed Preliminary Plat and the Thoroughfare Plan. Informed the Commission the Thoroughfare Plan is a guide showing general roadway alignments and classifications, noting the proposed Preliminary Plat is in conformance with the Thoroughfare Plan. Indicated the Final Plat for the northern adjacent property, Whitley Place, Phase 1, filed in 2008, depicted the alignment preferred by the developer of Whitley Place, consistent with the alignment on the proposed Preliminary Plat for Malabar Hill. Mary Hammack (Whitley Place Resident): Expressed support for the request; however, noted concern regarding the proposed alignment of First Street, as compared to the Thoroughfare Plan, specifically regarding the safety of the intersection of Whitley Place Drive and First Street. Dennis De Mattei (Whitley Place Resident): Expressed concern regarding the proposed alignment of First Street as shown on the Preliminary Plat, as compared to the Thoroughfare Plan. Warren Corwin (Applicant): Provided information regarding the proposed development. Glushko: Informed Commission the Town Attorney indicated the Preliminary Plat does not violate any Town ordinance and shall be approved. Webb: Provided information regarding the existing water line along First Street and detailed the considerations that were given in order to set the alignment. Informed Commission of the design constraints related to removal of the existing reverse curves on First Street, and realigning the roadway in a manner that connects with the Whitley Place entrance and satisfi es all engineering design criteria. The property is zoned Planned Development-88 (PD-88). (D19-0079). Description of Agenda Item: At the September 17, 2019, Planning & Zoning Commission meeting, this item was tabled due to concerns with the proposed alignment of First Street, as shown on the Preliminary Plat, as compared to the alignment of First Street shown on the Thoroughfare Plan. Since that meeting, the applicant has not revised the Preliminary Plat. The Preliminary Plat shows 96 single family residential lots and twelve (12) HOA/open space lots. Access is provided from First Street. The Preliminary Plat conforms to the Planned Development-88 development standards and the Thoroughfare Plan. Background Information: Since 2006, the Thoroughfare Plan has shown a conceptual alignment of First Street, depicting a realignment of First Street west of Custer Road to eliminate the two existing curves near the Whitley Place development (Attachment 3). Staff has also prepared an exhibit showing the alignment of First Street in context with the subject area, as it is depicted on the Thoroughfare Plan (Attachment 4). As noted on page 75 of the Comprehensive Plan, “The Transportation element of this Plan is intended to serve as a guide for transportation decisions within the Town” (Attachment 5). In other words, the conceptual alignment of roadways shown on the Thoroughfare Plan are not intended to set the exact alignment of roads, but rather to identify a general network and classifications. In 2008, the Final Plat of Whitley Place, Phase 1 was filed, which showed the anticipated alignment of First Street, AKA County Road 79 (Attachment 6). Further, since the September 17th Planning & Zoning Commission meeting, staff was contacted by the Whitley Place HOA, which provided a Whitley Place development rendering that was generated by the developer of Whitley Place (Attachment 7). It is the Town’s understanding the exhibit may have been used as a marketing tool for the development which depicts the alignment of First Street in a location consistent with the alignment shown on the Malabar Hill Preliminary Plat. In 2015, water line improvements along First Street were completed. During the design of the water line in 2012, the Town worked with the affected property owners on acquiring the water line Prosper is a place where everyone matters. PLANNING Page 2 of 3 easements so that the water line would be located within the future southern parkway of First Street, per Town standards. That way when First Street was widened, the water line would not have to be relocated. In the area of First Street near Whitley Place, consideration was given to ensure future roadway construction of First Street would, 1) allow adequate access to Whitley Place Drive as depicted in the Final Plat of Whitley Place, Phase 1, and 2) to ensure the reverse curve of First Street could be realigned to meet all engineering design standards. If First Street was constructed in the exact location as depicted on the Thoroughfare Plan, there would be several resulting factors. Right-of-way for First Street would need to be acquired from the cemetery, which is not feasible. Also, right-of-way would need to be acquired from two residential properties in Whitley Place that back up to First Street adjacent to the cemetery. The Town would have to reconstruct the recently installed water line to the new alignment of First Street. In addition, the subject property, as well as the eastern adjacent property, would be severely bisected, reducing the potential development area of the two tracts. Lastly, access to Whitley Place Drive may become compromised, as continued access to Whitley Place Drive would be subject to the layout of the Malabar Hill property. Legal Obligations and Review: Town Attorney, Terrence Welch of Brown & Hofmeister, L.L.P., has reviewed this matter and determined the Preliminary Plat does not violate any ordinances, complies with Town standards, and shall be approved. Planning & Zoning Commission Action: If the Commission votes to conditionally approve or to deny the preliminary plat, per State Law, the Commission is required to provide the applicant a written statement of the conditions for the conditional approval or the reasons for denial and include a citation of the specific ordinance that is the basis for the action. After the conditional approval or denial of the preliminary plat, the applicant has the right to submit to the Commission a written response that satisfies each specific condition for the conditional approval or remedies each reason provided for the denial. In the event the Commission receives such a response from the applicant, the Commission shall determine whether to approve or deny the applicant’s previously conditionally approved or denied plat not later than the 15th day after the date the response was submitted. It was developed based upon past transportation planning efforts, connectivity efforts on key thoroughfares with adjacent communities and input from the CPAC, Town Staff and public input. This Plan should be used as a reference when updating the Town’s Thoroughfare Plan, Thoroughfare and Circulation Design Standards and any related ordinances, and should be referred to when considering a wide range of decisions related to both transportation and land use. Transportation decisions do not exist within a vacuum, but are directly related to decisions regarding land use and building form. Therefore, the ultimate objective of this Plan is to create a balanced transportation system within Prosper which provides for the safe mobility of residents, considers both current and future needs, enhances connectivity and mobility options, and promotes a more livable community through a proactive approach to the Town’s appearance. The Thoroughfare Plan is reflected in Plate 3. Street classifications were developed based upon a number of factors including the roadways regional significance, current or projected traffic volumes, and land use. It is important to note that although a roadway may be identified as a Major Thoroughfare, the roadway design should not be rigid, but should consider a multitude of factors during its design including adjacent land use and context, among others. The segment of artificial turf is approximately three feet (3’) deep by 350’ wide, as shown in the picture below: The applicant has indicated the use of artificial turf is to help maintain water quality, as the turf area drains towards the Lagoon and the use of artificial turf will reduce the amount of organic material that may be drained into the Lagoon. Additional Structure – The applicant is proposing to update the PD site plan by accounting for an existing elevated viewing platform that was not included in the original PD site plan. Description of Agenda Item: In August 2018, the Town Council approved Planned Development-91 (PD-91) for Cook Children’s Medical Center, which included a hospital, urgent care and primary care center, an ambulatory surgery center, a medical office building, and an outpatient imaging and data center. The Zoning Ordinance allows the Planning & Zoning Commission to modify Planned Development exhibits without a Public Hearing if the proposed changes do not: 1. Alter the basic relationship of the proposed development to adjacent property, 2. Alter the uses permitted, 3. Increase the density, 4. Increase the building height, 5. Increase the coverage of the site, 6. Reduce the off-street parking ratio, 7. Reduce the building lines provided at the boundary of the site, or 8. Significantly alter any open space plans. With this amendment, Cook Children’s is proposing to update Exhibit D (Conceptual Site Plan) and Exhibit F (Elevations) to add approximately 3,794 square feet for a partial second-story on the outpatient imaging and data center, located east of the three-story medical office building, as shown below: APPROVED ELEVATION Prosper is a place where everyone matters. With regard to item #4 above, Increase the building height, the proposed amendment does not increase the overall height of the building, and meets all zoning height regulations. Staff believes this request satisfies the above noted criterial and recommends approval. The Planning & Zoning Commission has the authority to review and approve the proposed amendments. No further action is required with the Commission’s approval.
