Regarding Item 3b., the Commission inquired about proposed changes to the Preliminary Site Plan, noting concerns with the drive-through restaurants depicted along First Street. Ingalls: Provided a history of Preliminary Site Plan approval, noting the basis for the proposed Preliminary Site Plan is for the development of the medical office buildings located within the interior of the subject property. Informed the Commission the Preliminary Site Plan complies with all Town standards and Planned Development-7 (PD-7). Michael Doggett (Applicant): Provided information regarding the proposed development and Preliminary Site Plan. Indicated the purpose of the Preliminary Site Plan is to allow for the development of medical office buildings, and the remainder of the plan is conceptual in nature and may not accurately reflect future development. Glushko: Informed the Commission that Preliminary Site Plan and Site Plan approval is ministerial in nature and that plans which meet all Town standards should be approved by the Commission. Consider and act upon a Preliminary Site Plan for an office/retail development (Prosper Center), on 8.2± acres, located on the northwest corner of Legacy Drive and Prairie Drive. Ingalls: Summarized the request, provided information regarding the applicant’s request for solid living screening in lieu of a masonry wall along the western property line , and recommended approval. The property is zoned Planned Development-7 (PD-7). (D19-0049). History: At the August 20, 2019, Planning & Zoning Commission meeting, this item was tabled. The applicant has made no revisions to the Preliminary Site Plan that was considered at that meeting. Description of Agenda Item: The previous Preliminary Site Plan was approved by the Planning & Zoning Commission on December 15, 2015. The proposed revision is primarily intended to accommodate the development of the two (2) medical office buildings (15,000 sq. ft. and 30,000 sq. ft.) located centrally within the subject property. Additional modifications to the Preliminary Site Plan include the removal of a grocery store and pad sites, and the addition of office buildings and drive-through restaurants, which are permitted by PD-7. This item is on the Regular Agenda as the developer is requesting approval of a living screen in lieu of a masonry screening wall along the eastern property line that abuts existing residential lots in Willow Ridge. The solid living screen consists of one (1) large tree, planted on 30- foot centers, 3-inch caliper minimum at the time of planting, and two (2), off set rows of evergreen shrubs, planted on 6-foot centers, 45-gal and eight (8) feet in height at the time of planting. The existing trees may count towards the trees required within the living screen. The existing houses have wooden privacy fences with portions constructed on top of an existing retaining wall. As outlined in Exhibit C, the applicant is proposing modifications to the base Downtown Office (DTO) district, as outlined below: Setbacks – The Zoning Ordinance requires a twenty-five-foot (25’) front yard building setback along Church Street and a fifteen-foot (15’) side yard at corner along Second Street. As shown on Exhibit D, the applicant is proposing a five-foot (5’) front yard setback along Church Street and a ten-foot (10’) side yard at corner along Second Street. The Zoning Ordinance also requires a fifteen-foot (15’) landscape setback along Church Street and Second Street. The applicant is proposing a five-foot (5’) landscape setback along Church Street and a ten-foot (10’) landscape setback along Second Street. The applicant has requested the reduction to building and landscape setbacks in order to accommodate the size of the facility, in addition to providing off- street parking. The reduction to the setbacks along Church Street allows for the parking to be located in the rear (east side) of the property, and creates a more appropriate downtown streetscape along Church Street. Landscaping – The Zoning Ordinance requires perimeter landscaping in the Downtown Office (DTO) District, which consists of a combination of small and large trees. As shown on Exhibit G, the applicant is proposing a modification to the landscape requirements by allowing for a relocation of the trees and a reallocation of tree types. Specifically, the applicant is proposing to relocate the majority of the required trees along the adjacent streets, as opposed to along the rear and side yards. The applicant is also proposing to modify the requirement for small and large trees by providing four (4) additional small trees and allowing for two (2) fewer large trees than required by ordinance. It should be noted that the Fire Department requires a clearance zone of ten feet (10’) surrounding buildings for emergency access. In this instance, given the size and configuration of the building, the clearance zone prohibits landscaping on the north side of the building. As shown on Exhibit F, the proposed building will be constructed primarily of cementitious fiber board and stone, as is permitted in the Zoning Ordinance in the Downtown Office (DTO) District. In response to House Bill 2439, which will go into effect on September 1, 2019, and does not allow municipalities to regulate permitted masonry materials with zoning, and in conjunction with a Development Agreement related to right-of-way and easement dedication, the applicant is proposing to construct the proposed building in accordance with Exhibit F. Future Land Use Plan – The Future Land Use Plan recommends Old Town – Office. The proposed zoning request conforms to the Future Land Use Plan. Thoroughfare Plan – The property does not have direct access to any roads identified on the Thoroughfare Plan. Parks Master Plan – The Parks Master Plan does not indicate a park or hike and bike trail is needed on the subject property.
