LANDSCAPE EASEMENT

Department, Police, and emergency use in along, upon, and across said premises, with the right and privilege at all times of the
Town of Prosper, its agents, employees, workmen, and representatives having ingress, egress, and regress in, along, upon, and

FIRE LANE EASEMENT
The undersigned covenants and agrees that he (they) shall construct upon the fire lane easements, as dedicated and shown
hereon, a hard surface paved in accordance with Town standards and that he (they) shall maintain the same in a state of good
repair at all times and keep the same free and clear of any structures, fences, trees, shrubs, or other improvements or
obstruction, including but not limited to the parking, loading, or unloading of motor vehicles, trailers, boats, or other
impediments to the access of fire apparatus. The maintenance of pavement in accordance to Town standards of the fire lane
easements is the responsibility of the owner, and the owner shall post and maintain signage in accordance to Town standards in
conspicuous places along the fire lanes, stating “Fire Lane, No Parking”. The police or their duly authorized representative is

Agenda Item:
Conduct a Public Hearing, and consider and act upon a request for a Specific Use Permit for a
Wireless Communication and Support Structure, on 0.5± acre, located in Frontier Park, on the
south side of Frontier Parkway, south and west of Stadium Drive. (S18-0007).
History:
At the July 17, 2018, Planning & Zoning Commission meeting, this item was tabled to allow the
applicant an opportunity to identify another location within Frontier Park where the facilities would
be farther away from the adjacent residential subdivisions. Following the meeting, the applicant
worked with staff to identify an alternative location within the park. At the October 2, 2018,
Planning & Zoning Commission meeting, the Commission unanimously recommended approval
of the alternate location, as currently proposed.
At the October 23, 2018 and November 27, 2018, meetings, the Town Council tabled the request.
And most recently, at the February 12, 2019, meeting, the Town Council tabled this item to the
April 23, 2019, meeting. This item was tabled to allow the applicant an opportunity to discuss with
Prosper ISD the possibility of placing the Wireless Communication and Support Structure on their
adjacent property.
Since that time, it has been determined Frontier Park is the most appropriate location for the
proposed wireless communication and support structure. This item is tentatively scheduled for
Town Council consideration at their March 26, 2019, meeting.
This request has not changed since approval was recommended by the Planning & Zoning
Commission on October 2, 2018. However, because staff has re-advertised the Public Hearing
for Town Council on March 26, 2019, the Town Attorney has indicated a Public Hearing is required
to be re-held by the Planning & Zoning Commission.

Requested Zoning – The purpose of this request is to allow for a Wireless Communication &
Support Structure in Frontier Park. The applicant is proposing to remove an existing 80-foot light
pole that illuminates soccer fields and replace it with a 115-foot support structure for wireless
antennas and affix lights at a point 80 feet high on the support structure. The applicant has
indicated a willingness to work with the Town and any necessary sports association to ensure no
scheduled activities are disrupted as a result of the relocation of the lights. A 10-foot tall masonry
enclosure, constructed of brick and stone consistent with other structures in Frontier Park, is
proposed to screen the ground equipment used in conjunction with the wireless communication
facility.
Exhibit A shows the 600 square-foot lease area and the proposed location of the cell tower, which
is located approximately 650 feet from the subdivision to the south (Lakes of Prosper) and 1,500
feet from the subdivision to the west (Lakes of Prosper North). Exhibit B shows the elevations of
the cell tower and masonry enclosure. The support structure will be painted bronze to match the
existing light poles at the park, and the antennas will be flush-mounted to the tower. The masonry
enclosure will be constructed of brick and stone to match the building materials of the existing
structures at the park.
This request is for approval of a SUP for the use; however, the applicant will also need to seek
approval from Town Council for a Tower Site Lease Agreement, since the facility will be on Town-
owned property. The lease agreement is also being considered by Town Council at the March
26, 2019, meeting.
The Zoning Ordinance contains the following four (4) criteria to be considered in determining the
validity of a SUP request.
1. Is the use harmonious and compatible with its surrounding existing uses or proposed uses?
2. Are the activities requested by the applicant normally associated with the requested use?
3. Is the nature of the use reasonable?
4. Has any impact on the surrounding area been mitigated?

Staff believes the applicant has mitigated the impact of the proposed Wireless Communication &
Support Structure by locating it away from the adjacent residential subdivisions, as well as
constructing the tower and enclosure in a complementary manner to the existing improvem ents
in Frontier Park. As such, staff believes the applicant has satisfied the criteria and recommends
approval of the request, subject to approval of a Tower Site Lease Agreement.
Future Land Use Plan – The Future Land Use Plan recommends Medium Density Residential
uses for the property. This request conforms to the Future Land Use Plan.
Conformance to the Thoroughfare Plan – The SUP exhibit complies with the Thoroughfare Plan.
Water and Sanitary Sewer Services – Water and sanitary sewer services are located directly
adjacent to the site.
Access – Access to the property is provided from Stadium Drive. Adequate access is provided
to the property.
Schools – This property is located within the Prosper Independent School District (PISD).
Parks – The property is located in a park.
Environmental Considerations – There is no 100-year floodplain located on the property.
Legal Obligations and Review:
Notification was provided to neighboring property owners as required by state law. To date, Town
staff has not received any Public Hearing Notice Reply Forms.

Planning & Zoning Commission Recommendation:
At the October 2, 2018 meeting, the Planning & Zoning Commission recommended the Town
Council approve the request, by a vote of 7-0; however, because the Public Hearing has been re-
advertised, the Planning & Zoning Commission is required hold a Public Hearing.
Town Staff Recommendation:
Town staff recommends that the Planning & Zoning Commission approve the request, subject to
the following:
1. Town Council approval of a lease agreement to allow for the use of facilities on Town property.
2. Coordination with the Town and any necessary sports associations to ensure no scheduled
activities are disrupted resulting from the relocation of the lights from the existing pole to the cell
tower.
3. Acquisition of any off-site access easements necessary to serve the subject property at the time of
Site Plan.

Description of Agenda Item:
Town staff has received a request to rezone 9.1± acres from Agricultural (A) to Office (O). The
property is proposed to be redeveloped for office uses. Rezoning requests, which do not
conform, to the Future Land Use Plan shall be accompanied by a request to amend the Future
Land Use Plan. The Comprehensive Plan document anticipates the Town will encounter
“development proposals that do not directly reflect the purpose and intent of the land use
pattern as shown on the Future Land Use Plan map.”
The document recommends that “development proposals that are inconsistent with the Future
Land Use Plan map (or that do not meet its general intent)” should be reviewed based on the
following questions and should be reviewed on their own merit.
Will the proposed change enhance the site and the surrounding area?
Is the proposed change a better use than that originally envisioned and depicted on the
Future Land Use Plan map?
Will the proposed use impact adjacent residential areas in a negative manner?
Will the proposed use be compatible with and/or enhance adjacent residential uses?
Are uses adjacent to the proposed use similar in nature in terms of appearance, hours of
operation, and other general aspects of compatibility?
Does the proposed use present a significant benefit to the public health, safety, welfare
and/or social well-being of the community?
Would it contribute to the Town’s long-term economic stability?
The Plan states, “it should be incumbent upon the applicant making such a proposal to provide
evidence that the proposal meets the aforementioned considerations, supports community goals
and objectives as set forth within this Plan, and represents long term economic and/or social
benefits for the community as a whole, not just a short-term financial gain for whoever is
developing the project.”

In response, the applicant provided a Request Letter and Exhibit, Attachments 4 and 5. As
shown on the Exhibit, the subject property includes plans for development of a middle school,
church campus, and elevated water storage tank, and is bound by floodplain to the north and
east. Due to the proposed development on the subject property, t he applicant believes resident
development is unviable in this location.
The Plan recommends that “it is important to recognize that proposals not directly consistent
with the Plan could reflect higher and better long-term uses than those originally envisioned and
shown on the Future Land Use Plan map for a particular area. This may be due to changing
markets, demographics and/or economic trends that occur at some point in the future after the
Plan is adopted. If such changes occur, and especially if there are demonstrated significant
social and/or economic benefits to the Town of Prosper, then these proposals should be
approved and the Future Land Use Plan map should be amended accordingly.”

The Planning & Zoning Commission is required to hold a Public Hearing prior to acting on an
amendment to the Future Land Use Plan. Town staff has not received any Public Hearing
