Call to Order /Roll Call. The meeting was called to order at 6:00 p.m. Roll call taken by Melanie Videan, Planning Technician. Commissioners present included: Chair Mark DeMattia, Vice Chair Mike McClung, Secretary Christopher Blair, Rick Turner, Chris Keith, Jim Cox, and Terri McCutcheon. Staff present included: Hulon T. Webb, Jr., Director of Development Services/Town Engineer; Chris Copple, Planning & Zoning Manager; and Melanie Videan, Planning Technician. 2. Recitation of the Pledge of Allegiance. 3. A public hearing to consider and act upon an amendment to the Town's Thoroughfare Plan (Section 13 of the Town's Comprehensive Plan) revising the alignment of F.IVI. 1355, Gee Road, and Fishtrap Road. (CAll-0001). Summary Webb: Summarized current road alignments in the west part of town, the regional thoroughfare plan set by the North Central Texas Council of Governments in 1993 for 2010, Little Ehn's Thoroughfare Plan, the lack of current road connectivity, alternative connections discussed in the past, the preliminary plat of Three Stones with regards to the alignment of Fishtrap and Gee Roads, and the need to reduce the impact on the floodplain and properties. Reminded that funding and design perimeters are not being discussed at this time, as construction is still several years from commencement, but the amendment to the Town's Thoroughfare Plan is the first step. Reiterated the proposed alignment poses the least amount of impact on existing homes and floodplain. Discussion Cox: Asked questions about the platting and approval of Three Stones with regards to the cuu-ve of Fishtrap Road into Gee Road. Blaij•: Asked questions regarding time constraints for decisions regarding the connectivity of Fishtrap and Gee Roads. Page 1 of 6 YYehb: Informed the Three Stones preliminary plat was originally approved in 2008, and no time constraints exist — that decisions will be based on what develops. Motioned by Turner, seconded by McCutcheon to open the public hearing. Motion passed 7-0 at o:12 pMR Public Hearin5 Discussion Michael Snzith (Dove Cz°eek Estates resident): Spoke in opposon to the amendment, as the proposed alignment passes through his house on the southeast corner of existing F.M. 1385 and Dove Creek Circle. Requested staff shift the alignment a little west to go around his property so he would not have to relocate. Steve Rollins (representative for Dezzton Coznzty Cozzznzissiozzer Precinct One, Hzrgh Coleman): Recited a letter of support from Commissioner Coleman. Noted staff has been in discussions with the Commissioner regarding the proposed alignment with topics including connectivity as well as congestion. Reported on traffic patterns and construction schedules for F.M. 423 south of U.S. 380, which has a completion date of mid 2012, DeMattia: Asked Mr. Rollins questions regarding the completion of F.M. 423 south of U.S. 380. Chez}�l Williazzzs (representatn�e for propez•tJ� at the northeast corizer of F.M. 1385 and Fishtrap Road): Spoke in opposition to the amendment. Informed her client's request to rezone the northeast corner of existing F.M. 1385 and Fishtrap Road was based on the current alignment and conversations with the Texas Department of Transportation (herein called "TXDOT"). Claimed staff did not discuss proposed alignment at the time her client rezoned his property, TXDOT representatives were unaware of the proposed alignment, and zoning case Z10-0019 was approved in January 2011 without the proposed alignment. Requested the item be tabled so additional discussions between staff and property owners can take place before the amendment is acted upon by the Commission. Mandy Brown (Tea:as Development Services, z°epr°esentative for• pz°operty at the northeast corner of F.M. 1385 and Fishtrap Road): Spoke in opposon to the amendment. Questioned why alternative alignments have not been tinder more consideration. Spoke of the major connections being proposed, observing traffic will have to make three maneuvers to continue on an east/west route. Requested to view a traffic impact analysis for the area and additional time to analyze alternative alignments. Dirk Leidecker (Prosper resident): Spoke in opposition to the amendment. Noted which alternative aligmnent (map titled "CA 11-0001 Alternative B-2) given in staffs presentation he preferred, and questioned why the alternative was abandoned, as it would also allow connectivity between F.M. 1385 and Gee Road, despite a long stretch that would traverse his property on the southeast corner of F.M. 1385 and Noles Road. Concerned about traffic flow with the proposed alignment. DeMattia: Asked staff questions about cost effectiveness with proposed alignment in regards to land acquisition and compensation to affected property owners. Cox: Asked for confirmation that F.M. 1385 is planned to be a six lane roadway, no matter the outcome of the proposed amendment. McClung: Asked staff if the right -of --way for the six lanes of F.M. 13 85 is acquired at this trine. Page 2 of 6 Webb: Reiterated motive to align the proposed roadways with the existing road system to minimize impact on the floodplain and property owners. hnformed when the State releases funding for the project, design, land evaluations, offers of compensation to property owners, and right-of-way acquisition will follow. Confirmed F.M. 1385 is planned to be a six lane roadway whether the proposed amendment is approved or not. Ron Berlin (under contract for pzn^chase of propel°ty for zoning case Z11-0007): Spoke in favor %J the amendment. Cited the importance of the proposed alignment to the vitality of commercial development, noting the alternative alignments provided no yield to such development. hnformed he spoke successfully with neighboring property owners regarding the alignment. Julie Holrngziest (ETJ/Denton Coirnt)� resident): Spoke in opposition to the amendment. Concei7ied regarding the value and re -sale of her property, as the alignment would position the intersection of Fishtrap Road and F.M. 1385 farther from her property, of which it's southeastern tip touches the northwest intersection of existing F.M. 1385 and Fishtrap Road, Stacy Standridge (fornaer property owner of northeast corner, current property owner of existing southeast corner of F.M. 1385 and Fishtrap Road): Spoke in opposition to the amendment, stating a connection into F.M. 1385 farther north would be preferable, as the proposed connection would remove his property from a hard comer and extinguish two commercial corners that could be had. Recalled no discussion of the proposed amendment during the ZIO-0019 zoning case. Spoke in favor of economic development and understood traffic issues, but questioned the two T-intersections into Fishtrap Road, John Rose (representing zoning cases Z11-0007 and Z11-0008): hifon�led during the due diligence process of his zoning cases, the F.M. 1385 curve surfaced in many plans, and David Hensley with TXDOT had been working on the curve. Reported the spacing of the alignment and T-intersections are harmonious with planning concepts, as there is commercial zoning at Parvin Road and an agreement exists with Comanche Ridge. Noted northbound traffic issues on F.M. 423 and past discussions for said roadway to expand to eight lanes. Webb: hnfonmed David Hensley of TXDOT attempted to secure funding to shady the proposed alignment, and that he (Webb) tried to assist in acquiring what funds TXDOT could not, as TXDOT wanted to implement the study of the proposed alignment approximately five years ago. Conveyed TXDOT has no preference where the connection occurs along F.M. 1385, but acknowledges a connection is needed. Reported he spoke with David Hensley earlier in the day, and Mr. Hensley informed he would not be able to attend the meeting. Carter Kendall (representati>>e for property at the northeast corner of existing F.M. 1385 and Fishtrap Road): Spoke in opposition to the amendment. Stated his opinion on traffic patterns, and questioned the urgency to secure this alignment when it will only be a minor north/south bound roadway according to traffic patterns. Motioned by Keith, seconded by Cox to close the public hearing. Motion passed 7-0 at 6:56 p.m. Discussion Cox: Understood the current and future traffic issues on F.M. 423 due to northbound development and the need to utilize the existing roadway, but questioned where and how an alternative connection could be made. Commented on the planned alignment with the Three Stone preliminary plat. Voiced no opposition to tabling the item for further discussions to occur. Page 3 of 6 Blair: Concurred with utilizing the existing roadways where possible for efficiency of tax dollars and to minimize impact on floodplains. Preferred to minimize the impact on existing homes and to better understand the effects of three way intersections as opposed to four way intersections. Agreed with tabling the item. McClanzg: Agreed to utilize existing roadbeds and rennaui cost effective. Spoke in favor of the proposed alignment, commenting it the best option for the Town. Turner : Agreed the proposed alignment is the most effective, though he encouraged a design that would route the roadway around any homes. Supported tabling the item. Keith: Concurred with Commissioners on alignment points. Supported tabling the item. McCutcheo»: Agreed with Commissioners on alignment points. Supported tabling the item. DeMattia: Concurred, adding the economics and efficiency appear well utilized and researched by staff. Conveyed the east/west fracture seemed an odd proposal. Supported tabling the item and solicited staff on an adequate time to table. htformed those in attendance the public hearing will be re -noticed. Webb: Recommended tabling the item for thirty calendar days. Motioned by Turner, seconded by Blair to table item 4 until the July 5, 2011 Planning &Zoning Commission meeting. Motion approved 7-0 at 7:08 p.m. 5. A public hearing to consider and act upon a request to rezone 39.4E acres, located on the north side of Fishtrap Road, SOOt feet east of existing F.M. 1385, from Planned Development-51-Retail (PD-51-R) and Agricultural (A) to Planned Development -Retail (PD-R). (Zl1-0007). Summary Copple: Noted agenda item four directly affects the applicant's request to rezone. Altered staff report's recommendation and requested tabling the item, due to item 4 being tabled. Offered suggestion to continue the public hearing to the July 5, 2011 Planning & Zoning Commission meeting. Motioned by Cox, seconded by McClung to open the public hearing. Motion passed 7-0 at 7:10 p.m. Public Hearing Discussion McC11177g.• Confnmed procedures regarding closing, continuing, and re -noticing public hearings. DeMattia: Requested the public bearing be re -noticed to those property owners within two hundred feet of the subject property according to State law. Motioned by Blair, seconded by Turner to close the public hearing. Motion passed 7-0 at 7:11 p.m. Motioned by McClung, seconded by Turner to table item 4 until the July 5, 2011 Planning &Zoning Commission meeting. Motion approved 7-0 at 7:11 p.m. 6. A public hearing to consider and act upon a request to rezone 47.7± acres, located on the south side of Fishtrap Road, 1,400E feet east of F.M. 1385, from Agricultural (A) and Planned Development-40 (PD40) to Planned Development -Single Family (PD-SF). (Zll- 0008). Page 4 of 6 Summary Copple. Summarized request to rezone, noting the following standards in the proposed planned development (herein called the "PD"): number of lots and densities, lot types, landscape setbacks, open space, playground amenities, driveways, fencing, exterior lighting, garages, repetition of elevations, and accessory structures. Noted recommendations set forth in the Future Land Use Plan and confirmed the request does conform to said Plan. Informed notification was provided according to State law and three public hearing notice reply forms were received by the Planning Division, with none in opposition to the request. Recommended approval. Discussion McClur'tg: Asked questions regarding the size of the lots in Glenbrooke Estates. Blair: Asked gtrestiaris regarding the Single Family-10 reference ui the request. Copple: Informed of the lot size and density in the Glenbrooke subdivision and of the reference to Single Family-10 in the requested PD. Motioned by Blair, seconded by McCtrtcheon to open the public hearing. Motion passed 7-0 at 7:17 p.m. Public Hearnlg Discussion John Rose (applzcant): Gave presentation on The Preserve at Doe Creek which included the following: a reference to area subdivisions and floodplain, standards that exceed the Single Family-10 district, how and why lot count is vital to make the project viable, how and why the design is an appropriate transition between Glenbrooke Estates to the west and southwest and the proposed Three Stones development to the northeast, and the importance and preservation of the floodplain area. McClarzg: Asked applicant if 1) a compromise from 15% Type B lots to 25% Type B lots would be acceptable, and 2) if prohibiting front facing garages on the elevations would be acceptable, and if not, then perhaps limiting the number of front facing garages would be acceptable. DeMattia: Asked applicant to explain those standards that exceed Single Family-10 standards. Blair: Asked questions regarding the fencing against Glenbrooke lots. Asked for confirmation the following are inchided iil the 25% of undevelopable land: floodplain, playground, hike and bike trail, gas easement, detention pond, and landscape buffer. Keith: Asked if agenda item 4 affects the proposed development. John Rose: Agreed to increase Type B lots to 24%, to have front facing garage doors be carriage style, and to limit the munber of those garage doors to one third. Explained standards in the PD which exceed Single Family-10 standards. Informed the PD leaves no intention for a buffer between the proposed lots and those of Glenbrooke, and the option of fencing is at the homeowner's (of The Preserve) discretion, also noting the fencing along the floodplain must be wrought iron per Town requirements. Offered to add language to the PD to mandate homeowner fences be board on board. Apprised the PD mitigated for a six lane roadway; however, if it remains a four lane roadway, the PD will still dictate a forty foot landscape buffer with berms, but the median spacing may be impacted. Confirmed items included in the 25% of undevelopable land. Copple: Noted where the planned development standards that exceed Single Family-10 standards can be found in the staff report. Motion passed 7-0 at 7:43 p.m. Discussion Blair: Preferred to see language regarding separation between the proposed lots and those in Glenbroolce. McClung: Preferred to revise language to reflect 24% of the lots be Type B, and no more than 30% of elevations have front facing garage doors. DeNlattia: Confii7ned with applicant if the dwelling area on Type A lots can be adjusted. Johrz Rose: Affirmed Type A lots can be adjusted. Tirrner: Concur-r•ed with preferences stated, noting the appropriateness of the proposed use. Keith: Mirrored preferences stated and agreed on the appropriate use of the property. McCtrtcheorr: Agreed with previously stated predilections, adding the preference to have carriage garage doors. Coat: Agreed with preferences, noting the appropriateness of the h•ansition between Glenbrooke and the proposed Three Stones development. Motioned by McClung, seconded by Cox to approve a request to rezone 39.4� acres, located on the north side of Fishtrap Road, 500± feet east of existing F.M. 1385, from Agricultural (A) and Planned Development40 (PD40) to Planned Development -Single Family (PD-SF) subject to: 1) Type A lots shall have a minimum dwelling area of 1,900 square feet, 2) the amount of Type B lots shall be a minimum of 24% of the total lots, 3) garage doors in front of the house shall be carriage style, and 4) the shared fencing between the proposed single family lots and those of Glenbroolce Estates shall be a consistent, wooden board on board fence. Motion approved 7-0 at 7:49 p.m. 7. Receive an update on items discussed by the Capital Improvements Advisory Committee and the Comprehensive Plan Advisory Committee. DeMattia: Gave update on discussions during the Comprehensive Plan Advisory Committee's meeting, noting visions and values exchanged. Copple: Gave update on schedules of the Capital Improvements Advisory Committee and the Comprehensive Plan Advisory Committee meetings. 8.
