Conduct a public hearing and consider and act upon a request to amend a Specific Use Permit-19 (S-19)for a Child Care Center,Licensed on 2.3±acres,located on the north side of Prairie Drive,west of Legacy Drive.(S22-0010)(DS) Agenda Item 16. Consider and act upon a resolution expressing official intent to reimburse costs of Town capital improvement program projects that may be funded with proceeds of bonds or other obligations,if those costs are paid prior to the issuance of such bonds or other obligations.(CL) Citizen Comments The public is invited to address the Council on any topic.However, the Council is unable to discuss or take action on any topic not listed on this agenda.Please complete a “Public Comment Request Form”and present it to the Town Secretary prior to the meeting. Please limit your comments to three minutes.If multiple individuals wish to speak on a topic,they may yield their three minutes to one individual appointed to speak on their behalf.All individuals yielding their time must be present at the meeting,and the appointed individual will be limited to a total of 15 minutes. Regular Agenda Pursuant to Section 551.007 of the Texas Government Code, individuals wishing to address the Council for items listed as public hearings will be recognized when the public hearing is opened.For individuals wishing to speak on a non-public hearing item,they may either address the Council during the Citizen Comments portion of the meeting or when the item is considered by the Town Council. Agenda Item 17. Conduct a public hearing and consider and act upon ordinances adopting the following International Codes with local amendments: A.2021 Existing Building Code; B.2021 Building Code; C.2021 Residential Code; D.2021 Plumbing Code; E.2021 Mechanical Code; F.2021 Fuel Gas Code; G.2021 Energy Conservation Code; H.2021 Property Maintenance Code; I.2021 Fire Code; J.2020 National Electric Code; and repealing all prior versions of said International Codes,to the extent referenced in each applicable ordinance.The foregoing codes are contained in Chapter 3,"Building Regulations,"of the Town's Code of Ordinances,as amended.(BC) 2021 Building Code Updates Importance of updating: •Primary component of ISO’s BCEGS score •Regional uniformity.6 of our 10 comparison cities have already moved to the 2021 I-codes •Code updates address new products and changes in the industry •10 codes are being updated-IBC,IRC,IEBC,IECC,IFC,IPC, IMC,IFGC,NEC,IPMC 2021 Building Code Updates Previous Code Updates: •January 2014-Town moved from the 2006 I-codes to the 2012 I-codes •January 2019-Town moved from the 2012 I-codes to the 2015 I-codes* •April 2023-Effective date for proposed move from 2015 I- codes to 2021 I-codes if approved by Town Council Building Code (IBC) •Several chapters of the IFC (Fire Code)mirror the IBC •Updating the IFC is part of the Strategic Plan •Amendments were coordinated with FMO and based on those put forth by NCTCOG •Updated occupant load factor for business areas (100 to 150) •Accessory storage spaces of any size are now permitted to be classified as part of the occupancy to which they are accessory Residential Code (IRC) •Elimination of “Residential Green Building Program” originally adopted in 1998 and unmodified since •Additional smoke detector required on main level in many new homes in Prosper •Solar installs-protected pathway to EE&R opening •Adds back some prescriptive methods for installing walls greater than 10’in height and updates fastener requirements Electrical Code (NEC) •TDLR licensing law already requires electricians to follow the 2020 NEC •New provisions included: •Emergency disconnects at exterior for all new homes •Whole-house surge protection for all new homes •Multiple receptacles on most kitchen islands •Additional GFCI requirement for plugs over 20 Amps (i.e.-clothes dryer) Plumbing, Mechanical, Fuel Gas, and Existing •Vacuum testing of DWV piping as an alternative test procedure (IPC) •Added a minimum clearance of 3’from dryer duct to building opening (IMC) •Clarification that gas shut-offs are allowed behind moveable appliances such as dryers and refrigerators,added provisions for Schedule 10 steel pipe,added provisions for arc-resistant CSST (IFGC) •Intent is to provide flexibility to use alternative approaches to achieve compliance with minimum requirements (IEBC) Energy Conservation Code (IECC) •Third-party inspections and testing •Code updates are particularly impactful in our specific climate region (3A). •Further increasing the required R-value for ceiling insulation and duct insulation to meet prescriptive requirements •Additional testing requirements for ducts and ventilation •Amendments mirror NCTCOG amendments and allow for alternative compliance pathway via Energy Star Certification while also addressing issues that are specific to our location International Property Maintenance Code •Minimum requirements for maintaining sanitary and safe structures •Specific requirements for maintaining fences and retaining walls •Disallowing portable containers on properties for over 45 days •Removes requirement for Town to review cross-lot drainage (Civil matter) Possibly direct Town Staff to schedule topic(s) for discussion at a future meeting. Section 551.072 –To discuss and consider purchase,exchange,lease or value of real property for municipal purposes and all matters incident and related thereto. Section 551.074 –To discuss and consider personnel matters and all matters incident and related thereto. Section 551.089 -Deliberation of security information collected,assembled,or maintained by or for a governmental entity to prevent,detect or investigate criminal activity,pursuant to Section 2059.055 of the Texas Government Code,and all matters incident and related thereto. Section 551.071–To discuss retention of legal services to assist in NEPA EIS evaluation,and all matters incident and related thereto. The Town Council Meeting will resume after the Executive Session.
