12.23.2008 Town Council MinutesTOWN OF R1._J SPER Call to Order / Roll Call. The meeting was called to order at 6:06 p.m. Roll call was taken by the Town Secretary. MINUTES Regular Meeting of the Prosper Town Council Prosper ISD Central Administration 605 E. Seventh Street, Prosper, Texas Tuesday, December 23, 2008 at 6:00 p.m. Council present included: Mayor Charles Niswanger, Mayor Pro -Tem Ray Smith, Deputy Mayor Pro -Tem Kenneth Dugger, Dave Turley, David Vestal, Meigs Miller, and Danny Wilson. Staff present included: Mike Land, Town Manager; Hulon Webb, Director of Development Services; Chris Copple, Senior Planner; Wade Harden, Senior Planner; Matthew Garrett, Finance Director; Kirk McFarlin, Police Chief, David Ledwitz, Code Enforcement Officer; and Matthew Denton, Town Secretary. 2. Invocation and Pledge of Allegiance. The Invocation was given my Councilmember Meigs Miller. Mayor Niswanger led the pledge of Allegiance. 3. Announcements of dates and times of upcoming community events. Mayor Niswanger congratulated the Prosper High School Football team for their recent State Championship, CONSENT AGENDA 4. Consent Agenda MINUTES a. Consider and act upon minutes from the following Council meetings. (MD) December 9, 2008 — Town Council Meeting ORDINANCES. RESOLUTIONS. AND AGREEMENTS b. Consider and act upon renewing the Interlocal Agreement with the City of Plano for radio service for the Police and Fire Departments. (GM) C. Consider and act upon 1) an Interlocal Agreement between the Prosper Independent School District and the Town of Prosper, Texas for the 57 acre community park and lease agreement and 2) adopt a resolution authorizing the Town Manager to execute the same. (WIT) d. Consider and act upon 1) an Interlocal Agreement between the Prosper Independent School District and the Town of Prosper, Texas for the multi-purpose facility and 2) adopt a resolution authorizing the Town Manager to execute the same. (MG) Motioned by Deputy Mayor Pro -Tem Dugger, seconded by Councilmember Turley to approve the consent agenda. Motion approved 7-0. CITIZEN'S COMMENTS 5. Other Comments by the Public. George Dupont, 1400 Harvest Ridge, addressed the council regarding several issues. REGULAR AGENDA PUBLIC HEARINGS 6. Presentation of Service Plans and First Public hearings to consider the involuntary annexations of (A) 33.658 acre tract of land located north of Hwy 380 and 1720' west of the North Dallas Parkway, (B) a 9.619 acre tract of land located west of the North Dallas Parkway and 1990' south of West First Street, (C) a 19.960 acre tract of land located on Dallas North Parkway and 445' south of West First Street, (D) a 29.684 acre tract of land located north of West First Street and 350' west of Dallas North Parkway, (E) a 80.031 acre tract of land located north of West First Street and east of Dallas North Parkway, (F) a 12.561 acre tract of land located south of West First Street and 891' east of Dallas North Parkway, (G) a .0935 acre tract of land located east of Coleman Street and 671' south of First Street, (H) a 1.999 acre tract of land located west of Preston Road and north of East Broadway Street, (1) a 21.464 acre tract of land located west of Preston Road and 1340' south of Prosper Trail, (J) a 151.078 acre tract of land located east of Preston Road and west of Coit Road and 1554' south of Prosper Trail, (K) a .069 acre tract of land located in the William Butler Survey Abstract Number 112, (L) a 32.667 acre tract of land located north of First Street in the Larkin McCarty Survey Abstract Number 600, (M) a 6.787 acre tract of land located in the Larkin McCarty Survey Abstract Number 600 and the Jeremiah Horn Survey Abstract Number 411, and (N) a 3.876 acre tract of land located west of Custer Road in the Jeremiah Horn Survey Abstract Number 411. (ML) Mike Land, Town Manager, gave a presentation regarding the involuntary annexation project and how it would affect the Town and the affected properties. Motioned by Councilmember Turley, seconded by Deputy Mayor Pro -Tem Dugger to open the public hearing. Motion approved 7-0. Mayor Niswanger opened the public hearing at 6:33 p.m. George Dupont, 1400 Harvest Ridge, addressed the council regarding the timeline for the next phase of involuntary annexations. Motioned by Deputy Mayor Pro -Tem Dugger, seconded by Mayor Pro -Tem Smith to close the public hearing. Motion approved 7-0. Mayor Niswanger closed the public hearing at 6:38 p.m. DEPARTMENT ITEMS 7. Consider and Act upon and Annexation Agreement by and between the Town of Prosper and the following landowners and adopting a Resolution authorizing the Town Manager to execute the same; Page 2 of 3 a) Larry Bridgefarmer, b) Scott and Janis Mays, c) Eve Long Koa, d) Virgil Dan Tolleson, e) Persepolis Oriental Rugs of Dallas, Inc., f) Raymond and Mary Herman, and g) Stephen and Karla Witt. (ML) Mike Land, Town Manager, gave council background information on this item. 8. Consider and Act upon an Annexation Agreement by and between the Town of Prosper and the following landowners and adopting a Resolution authorizing the Town Manager to execute the same; a) Charles and Cynthia Stuber, b) Glen Miller, c) Leila Weems, and d) David M. Leinen, Y -C Nurseries. (ML) Mike Land, Town Manager, gave council background information on this item. 9. Consider and act upon an increase to solid waste rates on the Comprehensive Fee Schedule effective February 1, 2009. (MG) Matthew Garrett, Finance Director, gave council a presentation on this item. Motioned by Mayor Pro -Tem Smith, seconded by Councilmember Wilson to approve item 9 subject to staff recommendations. Motion approved 7-0. 10. Possibly direct Town Staff to schedule topic(s) for discussion at a future meeting. 11. Adjourn. Motioned by Mayor Pro -Tem Smith, seconded by Councilmember Turley to adjourn. Motion approved 7-0.
