12-52 - R TOWN OF PROSPER, TEXAS RESOLUTION NO. )off--J��- (R) A RESOLUTION OF THE TOWN COUNCIL OF THE TOWN OF PROSPER, TEXAS, HEREBY ENCOURAGING THE PUBLIC UTILITY COMMISSION OF TEXAS TO ADOPT A SMART METER OPT-OUT PROGRAM FOR SMART METER INSTALLATION BY INVESTOR OWNED UTILITIES AND ELECTRIC COOPERATIVES; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the Town Council of the Town of Prosper, Texas ("Town Council") has investigated and determined that investor owned utilities and electric cooperatives have begun installing smart meters within the Town of Prosper, Texas ("Town"); and WHEREAS, it has come to the attention of the Town Council that the installation of smart meters is of great concern to the citizens of the Town because citizens currently do not have a choice with regard to whether a smart meter is installed on their property; and WHEREAS, the Public Utility Commission of Texas ("PUC") has begun the rule making process in Project #40190 "PUC Proceeding to Evaluate the Feasibility of Instituting a Smart Meter Opt-Out Program" and is currently accepting comments on this Project; and WHEREAS, in a letter to Donna L. Nelson, Chairman of the PUC, dated, February 10, 2012, Dennis Bonnen, Texas State Representative, District 25, stated that it was not the intent of the Texas Legislature to force smart meters on customers; and WHEREAS, as a result of the findings above, the Town Council has investigated and determined and finds that it will be advantageous, beneficial and in the best interests of the citizens of the Town to encourage the PUC to adopt rules and regulations providing, to the greatest extent possible, a smart meter opt-out program for smart meter installation by investor owned utilities and electric cooperatives. NOW, THEREFORE, BE IT RESOLVED BY THE TOWN COUNCIL OF THE TOWN OF PROSPER, TEXAS: SECTION 1: Findings Incorporated. The findings set forth above are incorporated into the body of this Resolution as if fully set forth herein. SECTION 2: Adoption of Smart Meter Opt-Out Program. The Town Council hereby encourages the PUC to adopt rules and regulations providing, to the greatest extent possible, a smart meter opt-out program for smart meter installation by investor owned utilities and electric cooperatives.
